Wisdom Edem Gomashie, who on Thursday (May 14, 2026) testified as an expert mining engineer for Chairman Wontumi and the other accused persons, said Ghana’s legal framework governing mining operations requires formal procedures and approvals before mineral rights can be transferred or assigned.

Relying on the Minerals and Mining Act, 2006 (Act 703), and the Minerals and Mining (Licensing) Regulations, 2012 (L.I. 2176), the witness said he reviewed the charge sheet and concluded that a valid assignment of mineral rights could not be based on verbal discussions.

He told the court that the assignment of mineral rights constituted a formal legal transaction and, therefore, could not be created through informal or verbal exchanges.

According to him, any transfer or assignment involving mineral rights must comply with laid-down procedures, including authorisation by the minister responsible for mines.

Chairman Wontumi and his company are facing six counts relating to allegations that they permitted Henry Okum and Michael Gyedu Ayisi to mine on the company’s concession without prior ministerial approval, while also facilitating unlicensed mining activities.

The accused persons have pleaded not guilty and are currently on bail pending the determination of the case.

The defence team, led by lawyer Andy Appiah-Kubi, has argued that Chairman Wontumi’s decision to allow the two individuals to operate on the concession did not amount to an assignment of mineral rights because there was no written agreement.

The prosecution, however, maintains that a transfer does not cease to be a transfer merely because it was not reduced into writing.

According to the prosecution, once a mineral rights holder grants another person the right to exploit minerals on a concession, a transfer has effectively taken place, regardless of whether the arrangement was formalised in writing.

During cross-examination, the Deputy Attorney-General, Dr Justice Srem-Sai, challenged the witness’s interpretation of the law, insisting that the expert opinion was not properly grounded.

However, Gomashie maintained that his position was consistent with the legal requirements governing mining licences and mineral rights administration.

He added that mining lease holders often engaged service providers to undertake operational activities, but such arrangements did not necessarily amount to the assignment of mineral rights.

Earlier in his evidence-in-chief, the witness identified his witness statement and signature before the document was tendered in evidence.

However, under further cross-examination, several inconsistencies emerged in the sworn statement.

Dr Srem-Sai pointed to discrepancies relating to the witness’s academic qualifications and the institutions he claimed to have attended.

The court heard that although the witness was born in April 1993, his statement indicated that he obtained his first degree in 1998.

The witness statement also suggested that he obtained his Master’s degree from the Kwame Nkrumah University of Science and Technology, although he later clarified that the qualifications were actually obtained from the University of Mines and Technology and the University of Ghana.

The witness admitted that the errors were mistakes and typographical inaccuracies.

“So it is not true when you told the court that you had a Master of Science Degree in Minerals and Economics in 2003,” the Deputy Attorney-General asked.

The witness responded that it was a typographical error.

The court subsequently allowed the witness to correct the errors in the statement to clarify his credentials.

According to him, his campaign will remain “disciplined, respectful and issue-based,” adding that it would not be characterised by personal attacks, intimidation or actions capable of creating division within the party.

The meetings also highlighted Chairman Wontumi’s role in the growth of the NPP over the years, particularly his grassroots appeal and mobilisation efforts as Ashanti Regional Chairman.

He stressed that rebuilding the party’s grassroots machinery would be crucial to the NPP’s chances of recapturing power in the 2028 general elections.

“There is the need for collective leadership, inclusiveness, reconciliation and healing within the party because the NPP belongs to all its members and stakeholders,” he said.

Chairman Wontumi is expected to call former Deputy Minister for Lands and Natural Resources, George Mireku Duker, as one of his defence witnesses when the case resumes before the High Court on May 14, 2026.

Appearing before the court on Thursday, counsel for Chairman Wontumi, Andy Appiah-Kubi, informed the court that the defence had filed three witness statements in compliance with the court’s directive for the accused persons to open their defence.

The witness statements were filed by Chairman Wontumi himself, former Lands Minister George Mireku Duker, and one Wisdom Edem Gomashie.

According to the defence team, several documents have also been filed in support of the case, including the lease agreement of Akonta Mining Company Limited, correspondence addressed to the Regional Security Council, and investigative cautionary statements.

The court was informed that Mr Gomashie would be the first defence witness to testify when proceedings resume next week.

Charges over Samreboi concession

Chairman Wontumi and his company are facing six charges over allegations that they permitted Henry Okum and Michael Gyedu Ayisi to undertake mining activities on the Akonta Mining concession without obtaining prior approval from the Minister for Lands and Natural Resources.

The prosecution further alleges that the accused facilitated illegal mining activities on the concession.

He has specifically been charged with the assignment of mineral rights without ministerial approval and purposely facilitating unlicensed mining operations, contrary to provisions of the Minerals and Mining Act, 2006 (Act 703), as amended by the Minerals and Mining (Amendment) Act, 2019 (Act 995).

Court orders accused to open defence

The High Court in March this year ruled that the prosecution had established a prima facie case against the accused persons and directed them to file witness statements if they intended to mount a defence.

Subsequently, the defence challenged the ruling through a submission of no case application, but the trial court dismissed the request.

Chairman Wontumi’s legal team later proceeded to the Court of Appeal to challenge the High Court’s decision ordering him to open his defence.

The defence also sought a stay of proceedings pending the outcome of the appeal, but that application was dismissed, paving the way for the substantive trial to continue.

The prosecution alleges that mining operations were carried out on the Samreboi concession without the required authorisation from the sector minister, in contravention of Ghana’s mining laws.

During proceedings on May 7, 2026, the court moved to fix dates for the defence to open its case.

That process, however, ran into resistance from defence lawyer Andy Appiah-Kubi, who initially rejected the proposed dates and asked for longer adjournments.

The exchanges drew a sharp reaction from the presiding judge, Justice Audrey Kocuvie-Tay, who sought to assert the court’s authority over the scheduling of proceedings.

A back-and-forth followed as the court and defence debated available dates.

At one point, a visibly frustrated Justice Kocuvie-Tay questioned the defence’s objections.

“Where’s the rush? You don’t want me to do the case? I have considered all your dates and, in some cases, shifted my sessions to the afternoon to accommodate you. What do you want me to do again?”

The judge also pushed back against public criticism over the pace of Operation Recover All Loot (ORAL) cases, saying lawyers must accept part of the blame for delays.

“When you go and sit on TV and people are insulting the judiciary for the delay in cases, don’t sit there and look at them, tell them you are the one contributing to it.”

“The public continues to criticise us for delays in cases, so we are also sitting up.”

On the prosecution side, Deputy Attorney-General Justice Sai argued that an expeditious trial was also in the accused’s interests.

He told the court that the prosecution had already made significant concessions and was prepared to sit for three out of five days each week, opposing the defence’s proposal of one sitting per week.

“My Lady, we have accommodated the defence enough; an expeditious trial is even in the accused person’s interest, and we who have much of the burden for the rest of the trial are prepared to conduct our cross-examination according to the court’s schedule.

“Our schedule as prosecution has to be taken into account; the defence cannot dictate the pace of this trial.”

The court adjourned proceedings to May 14, 2026, for a case management conference to continue as the accused prepares to open his defence.

Meanwhile, lead counsel for Chairman Wontumi, Andy-Appiah Kubi, said the legal team is reviewing the ruling and will determine its next course of action.

However, when the case was called on April 20, the accused persons had not complied with the court’s directive.

Lead counsel for the accused, Andy Appiah-Kubi, told the court that they were unable to file the witness statements because they had lodged processes at the Court of Appeal challenging the High Court’s ruling.

This comes after an earlier appeal against the same ruling was dismissed by the High Court.

Counsel further informed the court that an application for stay of proceedings had been filed at the Court of Appeal, arguing that continuing with the trial while an appeal is pending would prejudice the outcome of the case.

He therefore urged the High Court to adjourn proceedings pending the determination of the appeal.

Prosecution opposes adjournment

The Deputy Attorney-General, Dr Justice Srem-Sai, opposed the application for adjournment, arguing that the accused persons were not entitled to a stay of proceedings while the appeal is pending.

“Our prayer is that having refused to file a defence or call a witness. There is only one path left for the court, namely, to proceed to convict. We therefore pray that this Honourable Court convict the accused persons,” he said.

Court’s position

Presiding judge, Justice Audrey Kocuvie-Tay, held that the filing of a stay of proceedings at the Court of Appeal does not automatically halt proceedings at the High Court, adding that there are “a plethora of authorities” supporting that position.

She indicated that the High Court would proceed with the matter and would comply with any decision reached by the Court of Appeal when available, referencing the case of Republic v Ato Forson and Others.

The court has granted the accused persons up to May 5, 2026, to file their witness statements should they choose to do so.

The case has been adjourned to May 7, 2026.

Chairman Wontumi and Akonta Mining Company Limited are facing six counts of allegedly permitting Henry Okum and Michael Gyedu Ayisi to undertake mining activities on the company’s concession without obtaining prior approval from the sector minister.

They are also accused of facilitating unlicensed mining operations.

The court, in dismissing the submission of no case filed by the accused, held that the initial evidence presented by the state stood unless the accused persons produced sufficient contrary evidence to disprove it.

It subsequently gave the accused seven days to indicate whether they would remain silent and allow the court to determine the case based on the prosecution’s evidence, or whether Chairman Wontumi would testify in person and file witness statements from individuals he intends to call in his defence.

Proceedings

When the case was called today, both the interlocutory appeal and the motion for stay of proceedings pending appeal were brought to the attention of the court, presided over by Justice Audrey Kocuvie-Tay.

However, the state, represented by the Deputy Attorney-General, Justice Srem-Sai, waived his right to file a formal response opposing the application.

According to the Deputy Attorney-General, Chairman Wontumi’s affidavit in support of the motion contained no factual depositions but rather legal arguments and opinions.

He therefore prayed for an abridgement of time for the motion, which had April 16, 2026, as the return date, to be heard immediately.

However, counsel for Chairman Wontumi said he was not prepared to move the motion.

“I pray that counsel should apply formally if he wants an abridgement of time. We are not prepared to move this application today,” counsel submitted.

Court’s direction

In response, the court stated that it had the inherent jurisdiction to shorten time limits for any application.

The judge further indicated that an opposing party is not required to file an affidavit in opposition before the court can consider an application, adding that the court may determine an application whether or not it has been formally moved.

Following discussions, the court proposed March 27, March 30 and March 31 as possible dates for the hearing.

However, both parties agreed on April 2, 2026.

The case has accordingly been adjourned to April 2 for arguments for and against the motion.

Justice Audrey Kokuvie Tay ruled on Monday that the prosecution had successfully established a prima facie case against Mr Boasiako, his company Akonta Mining, and Mr Kwame Antwi, who is currently at large, warranting them to explain the evidence adduced against them.

The accused persons are standing trial for allegedly undertaking mining operations on a concession at Samreboi in the Western Region without the consent of the sector minister.

They are also accused of permitting two individuals to undertake mining activities on the concession without authority and facilitating those operations.

Lawyers for Mr Boasiako had filed a submission of no case, arguing that after the prosecution called four witnesses who were cross-examined, the State had “woefully failed” to establish the essential ingredients of the charges preferred against their client.

However, the State, led by Deputy Attorney General and Minister of Justice Dr Justice Srem-Sai, prayed the court to dismiss the application, contending that credible, admissible and legally sufficient evidence had been led touching on every essential element of the offences charged.

The prosecution argued that Mr Boasiako admitted in both his investigation caution and charge statements that he allowed the second prosecution witness access to the concession.

The State further maintained that the evidence showed the accused person did not merely allow statutory breaches to occur.

“He financially aligned himself with the unlawful operations, granted operational access, and provided logistical support without the required approvals,” the State had submitted.

The court agreed with the prosecution’s position, ruling that there was sufficient evidence on record to require the accused persons to mount a defence.

The case has attracted significant attention due to Mr Boasiako’s prominent position in the ruling party and the broader national conversation around illegal mining, commonly referred to as galamsey.

With the no-case submission dismissed, the trial will now proceed to the defence stage, where Chairman Wontumi and his co-accused will have the opportunity to present their version of events regarding the alleged mining operations at Samreboi.

Speaking on Joy News’ PM Express, the Abura Asebu-Kwamankese MP revealed that the Economic and Organised Crime Office (EOCO) has moved to secure large sums of money believed to be linked to various investigations.

“For instance, in Chairman Wontumi’s case alone, close to ¢50 million of money in his account has been frozen.”

He said similar financial figures have also been identified in other high-profile cases currently under investigation.

“Similar figures are involved in the former Signals Bureau boss, Adu Boahen, case, for instance, in the National Service case and many others.”

Mr Kwakye Ofosu explained that these actions form part of a broader state effort to trace and secure assets linked to suspected corruption and financial misconduct.

He said the current freeze is part of a larger number of assets that authorities have managed to secure so far.

“But for now, what they can do is to freeze it, and they have done it, ¢1.5 billion.”

According to him, the asset freezes are temporary measures pending the outcome of legal proceedings.

He noted that the state cannot recover such assets outright until courts determine that they were obtained illegally.

“They are not going to be able to recover until the persons involved have been convicted by a court that then will give you an illegal remit to recover whatever it is that is alleged to have or the court would have found to have been stolen.”

The government spokesperson also addressed the earlier public debate over comments by President John Mahama about money recovered by EOCO.

“Indeed, there were those who accused the President of misleading them when he said that EOCO had recovered ¢600 million.”

Mr Kwakye Ofosu clarified that the amount cited by the President referred to routine investigations handled by EOCO.

“That was in respect of the normal everyday cases that the EOCO handles.”

He explained that EOCO’s work covers a wide range of financial and organised crimes.

“Because they deal with issues of money laundering, cyber crime, cross-border crime, carjacking, and what have you.”

“So those are regular things that they do.”

However, he said the investigations currently attracting public attention involve suspected corruption and financial crimes that require legal processes before any recovery can take place.

He added that authorities are still working to identify additional assets linked to ongoing investigations.

“This is even for the cases that they’ve been able to touch, those that they’ve not touched.”

“They are still in the process of tracing this asset.”

Mr Kwakye Ofosu explained that asset tracing is a standard part of criminal investigations involving financial crimes.

“You know that anytime that anybody comes under investigation or is undergoing prosecution, they do concurrent tracing of assets.”

He said the aim is to ensure that suspected proceeds of crime are secured before cases are concluded.

“So that as much as possible we secure what we believe will be commenced with to the amounts involved in offences that would have been completed.”

Dorm 7: The shared history

“I know in this country people are always wondering whether Wontumi went to Prempeh College. Wontumi was my mate. We went into Form One together. Not only was he my classmate, but he was actually my dorm mate,” Dr Tandoh revealed.

The duo belonged to Aggrey House, where they specifically shared Dorm 7, a period Dr Tandoh credits for developing “great friendships” that have sustained them into their professional adult lives.

Dr Tandoh has not only cleared the air on a piece of political trivia but has also underscored the enduring influence of Ghana’s traditional secondary school brotherhoods in national life.

The ‘Amanfoo’ spirit: A house built on loyalty

Beyond settling the Wontumi debate, Dr Tandoh used the platform to highlight the unique and intense loyalty shared by alumni of the school. He described an environment where seniority is respected regardless of age and where support for one another is unconditional.

Recounting a remarkable personal experience, Dr Tandoh shared how a senior colleague he had never met before facilitated his relocation to Ghana from the diaspora.

“When I was relocating to Ghana, my first home that I moved into, the entire one-year rent was paid for by a senior I didn’t know… He left Prempeh College some 15 years before I went there,” he shared.

The senior, identified as Senior Poku-Agyemang, not only secured a home for Dr Tandoh’s wife and children but also provided him with a car and fully paid insurance for a year.

Lessons beyond the classroom

For Dr Tandoh, the Prempeh College experience was defined by a philosophy of collective growth rather than individual success. He noted that the institution taught him to be “focused on growing people around me and supporting things around me.”

The bond between the Amanfuo, he suggests, is a powerful social network that transcends political and professional boundaries.

In a post on X (formerly Twitter) on February 4, Justice Srem Sai stated that prosecutors have officially closed the Republic’s case against Chairman Wontumi, his company Akonta Mining Limited, and a second accused, Kwame Antwi, who is currently at large.

According to the Deputy Attorney-General, the prosecution’s case centres on allegations that Chairman Wontumi unlawfully permitted illegal mining activities on his Samreboi concession without obtaining the required ministerial approval. The state called four witnesses in support of its case.

The first witness, described as a galamsey headman, testified that he supervised illegal mining operations at the site after being arrested at an Akonta Mining office located on the concession.

The second witness, identified as the headman’s employer, stated that he had an agreement with Chairman Wontumi to undertake mining and land reclamation activities. He further alleged that the NPP regional chairman leveraged his political influence to secure national security protection for the operations.

A police detective tendered critical investigative statements, including one in which Chairman Wontumi admitted granting part of the concession for reclamation but denied authorising illegal mining. Additionally, a mining law expert testified that ministerial approval is mandatory before a concession holder can allow another party to engage in mining or reclamation and confirmed that Akonta Mining did not have the required authorisation.

Justice Srem Sai revealed that Chairman Wontumi’s lawyers intend to file a no-case submission, arguing that the prosecution has failed to establish a prima facie case. The defence has 14 days to submit the application, and the state has pledged to vigorously oppose the move.

In an exclusive interview on Adom TV’s Badwam show, Mr. Akuoko said this revelation would form part of his testimony as a prosecution witness for the state.

According to him, this fact was publicly acknowledged by the company’s owner and Ashanti Regional Chairman of the New Patriotic Party (NPP), Bernard Antwi Boasiako, popularly known as Chairman Wontumi, during the ongoing trial.

His comments come after the Office of the Attorney-General (AG) formally withdrew all charges against him, making him the fourth accused person to be discharged in the criminal case involving Akonta Mining and some of its officials.

A notice filed at the Accra High Court (Criminal Division) on Monday and signed by Deputy Attorney-General Dr. Justice Srem Sai stated that the withdrawal was in accordance with Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30).

Mr. Akuoko, however, declined to confirm whether mining activities actually took place within the forest reserve, citing ongoing court proceedings.

He admitted that he was initially terrified when he learned about the charges and their potential 15-year jail term if convicted.

Explaining his decision to cooperate with the Attorney-General’s Office and testify for the state, Mr. Akuoko said it was a personal choice guided by truth and due process.

“I decided to testify not out of disloyalty, but because I want to do what is right,” he stated. “If my former boss, Chairman Wontumi, is ever convicted, he might get a presidential pardon someday. I don’t think that opportunity would be extended to me.”

He also rejected suggestions that he had betrayed Chairman Wontumi, insisting that his cooperation with the prosecution was motivated by integrity rather than ingratitude.

“I am only standing by the truth and helping the court to establish the facts,” Mr. Akuoko emphasised.

At the time, Chief State Attorney Stella Ohene Appiah and her team were present, but the accused and his lawyers failed to appear or offer any formal explanation.

The judge therefore issued a bench warrant, directing law enforcement to arrest the accused.

However, Adom News’ Kodwo Mensah Aboroampa, who was in court, reported that moments after the warrant was issued, Chairman Wontumi and his legal team arrived, prompting the judge to rescind her earlier order.

Chairman Wontumi, together with Kwame Antwi, a director of Akonta Mining Company Limited, and the company itself, is facing six charges, including assigning mineral rights without approval and facilitating unlicensed mining operations, contrary to provisions of the Minerals and Mining Act, 2006 (Act 703), as amended by Act 995.

The case forms part of ongoing investigations into alleged illegal mining operations linked to Akonta Mining in the Samreboi area of the Western North region.

During earlier proceedings on October 7, 2025, the accused persons pleaded not guilty and were granted bail. The court had adjourned the matter to October 28 for case management and disclosure.

Following the brief confusion over his absence, Chairman Wontumi’s case is now expected to continue at the next scheduled sitting, with the bench warrant formally withdrawn.

On Tuesday, October 28, when the case was called at 9:40 a.m., the team of state prosecutors, led by Stella Ohene Appiah, a Chief State Attorney, was present. However, the accused person and his lawyers were absent without any explanation.

Justice Audrey Kocuvi-Tay, the presiding judge, noted that the business for the day was for disclosure to be filed and subsequent case management.

She stated, “Notwithstanding the inability on the part of the republic to execute the exercise today, the accused person and his legal representative are absent in court with no excuse of any sort to the court.”

The court explained that on October 7, 2025, when bail was granted and the matter was adjourned to October 28, it did not fix a specific time for the accused person and his lawyers to be in court.

However, it was expected that they would be in court by 9 a.m. for the business of the day to start.

Justice Kocuvi-Tay added, “Having not given any notice to the court as to their absence, a bench warrant is issued for the arrest of the accused.”

Chairman Wontumi has been charged together with Kwame Antwi, a director of Akonta Mining, and Akonta Mining, the company itself, for allegedly assigning mineral rights without approval. They had pleaded not guilty and were granted bail.

Per the Charge Sheet filed on Monday, October 6, 2025, Chairman Wontumi and the two others are facing a combined six charges, with each facing two counts.

The charges comprise three counts of assignment of mineral rights without approval, contrary to Section 14(1) and Section 99(2)(b) of the Minerals and Mining Act, 2006 (Act 703), as amended by Section 3 of the Minerals and Mining (Amendment) Act, 2019 (Act 995), and another three counts of purposely facilitating an unlicensed mining operation, contrary to Section 99(2)(b) of the Minerals and Mining Act, 2006 (Act 703), as amended by Section 3 of the Minerals and Mining (Amendment) Act, 2019 (Act 995).

Chairman Wontumi is currently before the High Court in Accra to respond to the charges.

Brief facts

Per the brief facts of the case, as filed on October 6, signed by the Attorney General, Dr. Dominic Ayine, the 1st Accused Person (A1), Bernard Antwi Boasiako, alias WONTUMI, a 49-year-old entrepreneur, is a native of Kuntanase in the Ashanti Region.

On paper, he is one of the two shareholders and one of the two directors of Akonta Mining Company Limited – the 3rd Accused Person (A3).

According to the Charge Sheet, Akonta Mining Company was incorporated on November 5, 2010, with “mining and exploration” as its object and principal business activities.

While Tarkwa is listed as its principal place of business, it operates mainly in the Samreboi area.

The Charge Sheet stated that the 2nd Accused Person (A2), Kwame Antwi, is at large and is listed as the other shareholder and director of Akonta Mining (A3).

Chairman Wontumi stated in both his police charge statement and investigative caution statement that he never saw or heard of Kwame Antwi since 2010 after they completed the company registration and other registration formalities.

Investigations have established that Chairman Wontumi (A1) alone has since exercised absolute control over Akonta Mining Company’s (A3) activities.

Further investigation is ongoing to establish the existence and, if so, the identity of Kwame Antwi (A2).

Items retrieved

As part of the Republic’s fight against the galamsey (illegal mining) menace, the Ghana Police Service embarked on a special operation on April 16, 2025, in the Samreboi area.

At the end of the operation on April 17, 2025, the police arrested Michael Ayisi Gyedu, a 50-year-old native of Samreboi, and 28 others within Akonta Mining Company’s (A3) concession in Samreboi.

During the arrest, the police retrieved the following items: eight pump-action guns, one single-barreled gun, five pieces of metal suspected to be gold concealed in a sachet, four machetes, several water pumping machines, 310 AAA/BB cartridges, one grease gun, four motorcycles, two vehicles, cash amounting to One Hundred and Fifty-seven Thousand Ghana cedis only (GH₵157,000.00), 25 serviceable excavators, and four non-serviceable excavators.

The Charge Sheet added that at the end of the trial, the Republic will pray the Court for a forfeiture order in respect of all items of value retrieved from the concession.

Galamsey activities

Per the charge sheet, upon his arrest, Michael Ayisi Gyedu named another, Henry Okum (a 44-year-old native of Krobo Odumase), as his employer who assigned him to supervise the mining activities on the concession.

Further, Michael Ayisi Gyedu stated that he and his fellow employees, as part of the mining activities on the concession, undertook land reclamation on parts of the concession that had been devastated while mining on the unmined portions of the land.

Henry Okum was subsequently arrested and cautioned. During interrogation, Henry Okum told police investigators under caution that sometime in September 2024, he approached and sought permission from Chairman Wontumi (A1) to undertake mining operations within the concession, which he believed belonged to Chairman Wontumi (A1) at Samreboi.

Investigations have established that Chairman Wontumi (A1) did agree to this proposal and gave Henry Okum permission to carry out mining operations within the concession.

Further investigations have, however, established that A1 allowed Henry Okum to carry out mining activities within A3’s concession without seeking or obtaining the legally mandated approval of the Minister.

According to him, the defence team is awaiting the Attorney-General’s next legal steps before deciding on their course of action.

His comments follow recent revelations by Attorney-General and Minister for Justice, Dr. Dominic Ayine, that several offers were made to his office in connection with the ongoing prosecution of Chairman Wontumi over alleged illegal mining activities.

Dr. Ayine, speaking during the Government Accountability Series on Wednesday, said he rejected all such offers, insisting that any plea bargain would only be considered under the supervision of a competent court.

He maintained that no political or external influence has affected his prosecutorial decisions, adding that claims by the NPP suggesting he was “cutting deals” were entirely false.

“No deal has been cut, and no deal will be cut except under the auspices of a court of competent jurisdiction,” the Attorney-General stressed.

Chairman Wontumi is facing prosecution over alleged illegal mining (galamsey) activities linked to Akonta Mining Limited.

He is accused of operating without a valid license, assigning mineral rights without ministerial approval, and facilitating unlicensed mining in the Samreboi Forest Reserve in the Western Region.

A joint security operation in April 2025 uncovered excavators, cash, firearms, and other equipment allegedly used for illegal mining.

Wontumi has pleaded not guilty and was granted bail by the High Court in Accra, with conditions including the surrender of his passport and placement on a stop list.

“It seems the nation is now divided into two—NPP and NDC—which is bad,” he lamented. “Already, some NPP members have vowed to avenge what is happening to Wontumi, and that is dangerous for our peace and unity.”

According to him, the situation has taken on a clear political twist, which does not bode well for national cohesion. However, he noted that Wontumi himself contributed to the current tension.

“But you ask, who caused it? Wontumi brought this upon himself,” Dr. Ansa-Asare said. “The insults while the NPP was in power were too much. People condemned it, but the NPP did not listen.”

The legal scholar also condemned calls within political circles for revenge if the NDC returns to power, describing such rhetoric as unhealthy and unproductive.

“This ‘do me, I do you’ and tit-for-tat game between the NPP and NDC is unhealthy and doesn’t help anything,” he stressed. “We must read and understand the word of God to know that time changes. Today it is Wontumi; tomorrow it will be someone else.”

Dr. Ansa-Asare further criticised the silence of senior statesmen and opinion leaders on the issue, suggesting that fear of losing contracts or political favour has muted their voices.

“The statesmen and elders have all kept quiet—nobody is speaking out because they are afraid to lose one contract or another,” he said. “That is not good. We must unite for the development of the nation.”

Earlier, on October 7, he had failed to meet the bail imposed in the said cases before the Criminal Division of the High Court in Accra.

In one of the cases, the court granted him GH₵15 million bail with two sureties, while a second court later imposed an additional GH₵10 million bail, also with two sureties, one to be justified with landed property.

The court further ordered that Wontumi report to investigators once every week for the first month and not travel outside the country without express permission.

The embattled NPP chairman faces multiple mining-related charges, including unlawfully undertaking mining operations and facilitating environmental destruction in the Tano Nimire Forest Reserve.

He has pleaded not guilty to all charges.

Speaking on Adom FM’s Dwaso Nsem, Mr. Ansa-Asare said the ongoing case involving Ashanti Regional NPP Chairman, Bernard Antwi Boasiako, popularly known as Chairman Wontumi, should serve as a wake-up call for the nation to confront deep-seated problems in the land administration system.

According to him, many Ghanaians have fallen victim to fraudulent activities at the Commission, where officials allegedly falsify documents and reassign registered properties to other individuals.

“The Lands Commission is hurting many Ghanaians. Someone will register their property, but land officials can falsify documents and give it to somebody else,” he lamented.

He explained that such malpractice complicates property verification processes, often leaving legitimate owners at risk of losing their land.

“You may go to cross-check documents, and the landed property may not even be in the person’s name. When that happens, the police cannot work with it,” he added.

Dr. Ansa-Asare noted that the verification exercises being conducted in some high-profile cases, including that of Wontumi, are part of efforts to confirm rightful ownership but insisted that the broader issue is systemic.

“This situation is not an isolated case. There are a lot of wrong things going on at the Lands Commission. If you don’t have a lawyer or you are not careful, someone else will take your property as theirs,” he warned.

Touching on Wontumi’s legal troubles, Dr. Ansa-Asare said while the charges against him appear “excessive,” it remains unclear whether his case stems directly from any of these land registration issues.

He urged the Lands Commission to clean up its operations and restore public confidence, stressing that integrity in land administration is essential for justice and national development.

According to him, the legal team has every right to appeal for a review of the bail conditions imposed on the embattled politician, adding that the court would give a fair hearing.

“The lawyers must be able to go to court and appeal for a revision of the bail conditions, and I know the judge will listen,” he said.

Dr. Ansa-Asare further urged Mr. Appiah Kubi to reach out to the Attorney General, Dominic Ayine, to help bring closure to the issue.

“Appiah Kubi must also try and talk to the Attorney General, Dominic Ayine, for this issue to be resolved. He cannot drag this issue with the government—it will not work,” he cautioned.

The legal scholar expressed concern over reports that Wontumi and his team had vowed to remain in custody in protest, describing such a stance as unhelpful and counterproductive.

“They should not take an entrenched position like what I’m hearing—that they have vowed to sleep in the cells. It will not help anybody. They must prioritise the interest of the nation,” he advised.

Dr. Ansa-Asare emphasised that the situation was attracting negative attention to Ghana and called for restraint and cooperation between both parties.

“Because what is happening is giving Ghana bad press. Both parties must come together and work for the good of the nation,” he added.

He concluded by reminding the parties involved, especially Mr. Appiah Kubi, to demonstrate humility and seek divine guidance in handling the matter.

“Appiah Kubi must look up to God, be humble and go and talk with the Attorney General. The important thing required in this situation is humility,” he stressed.

“The execution of the order itself requires verification of the properties used for the bail and confirmation of their valuation—processes handled by state institutions. The delay is coming from those institutions,” he stated.

Mr. Appiah-Kubi cited the Lands Commission as one of the agencies involved, disclosing that officials initially faced challenges in locating the registration plan for one of the properties submitted as part of the bail requirements.

“I’m told that it has now been identified, and the report is being sent to the registrar of the court,” he added.

He expressed optimism that the necessary processes would be completed by the end of the day to secure Chairman Wontumi’s release.

Chairman Wontumi remains in custody two days after the Criminal Division of the Accra High Court granted him bail in the sum of GH₵15 million on Tuesday, October 7, in connection with two separate cases relating to alleged illegal mining activities.

The cases involve Akonta Mining Limited, a company linked to him and alleged mining operations in the Nimiri Forest Reserve in the Western North Region.

He faces multiple charges, including undertaking illegal mining operations and causing unlawful damage to the environment.

In addition, the NPP regional chairman has been placed on a stop list, preventing him from travelling outside the country until the case is resolved.

“We made an application for bail on Tuesday, and the court granted it with three sureties — two to be justified. We are processing the application, and by God’s grace, we have had people to sign the bail bond and stand as sureties,” he said.

Mr. Appiah-Kubi added that efforts are currently underway to finalise the necessary inspections and verifications required by the court and police.

“It was late after the court proceedings, so we couldn’t complete the process with the police and the court registrar. This morning, the police prosecutor, ASP Godwin, called to inform me that his men are ready to inspect the properties of the sureties so we can expedite the process,” he explained.

He commended both the police and the court registrar for their professionalism and cooperation, saying their proactive approach had helped to move the process forward.

“I really appreciate the effort of the police prosecutor for calling me to inform me they are ready — this is rare. I must also commend the court registrar, who is coincidentally also called Gordon, for his effort to expedite the process,” he said.

Mr. Appiah-Kubi expressed optimism that all formalities would be concluded soon, allowing for Chairman Wontumi’s release.

“I am very hopeful the processes will be finalised today, and Wontumi will be released,” he added.

“You cannot rule out that Wontumi was one major kingpin who was having a lot of tributaries. So that is one big shot you are trying to take down,” he stated.

Mr Kotoko also criticised former President Nana Akufo-Addo for publicly defending Chariman Wontumi and others accused of illegal mining without proper investigations.

“You saw how he always rushed to the defence of these people without any thorough investigation,” he said.

He noted that such political interference weakened the country’s fight against illegal mining.

“Those were the things that should have allowed somebody to realise that this was rather what is called an enabler of the enterprise,” he explained.

“It is not true that MASLOC vehicles were taken from me. These are mere lies. If indeed it was Wontumi who went for the vehicles, then they should come out with evidence and documentation to back it,” he said.

MASLOC CEO Abigail Elorm Mensah, on September 11, had stated that three government vehicles were retrieved from Wontumi’s residence with the support of National Security operatives as part of efforts to recover government loans and assets from defaulters.

Chairman Wontumi, however, clarified that a person who had been staying in his house had brought a vehicle there, and he had no involvement in moving or retrieving it.

“I was at home when I received a call that a task force wanted to enter the house, but it was locked. I gave permission for them to be granted access. The person who was staying there had vacated but left the car behind. When they came, they rather took my Land Cruiser away,” he explained.

He also questioned the reports, asking, “Does MASLOC even give out Land Cruisers? We are still dealing with this matter.”

Wontumi insisted that attempts to link him directly to the alleged MASLOC vehicle retrieval were unfounded and appeared to be part of a deliberate effort to tarnish his image.

He explained that all the vehicles were acquired legitimately and had cleared the necessary port duties.

“At the moment, EOCO has taken close to 15 of my cars, but I have decided not to speak. The vehicles are in EOCO’s custody. I bought them from Bright Selby at Asylum Down near the NPP office. He registered them, paid the duties, and did everything. My Bentley, Rolls Royce, and others are all there,” Wontumi said.

He stressed that despite the development, he had chosen to remain calm and rely on divine intervention.

“I have been quiet because I know that at the right time, God will intervene and speak for me,” he added.

Wontumi was arrested on May 27, 2025, after being invited by the Criminal Investigations Department (CID) for questioning over alleged serious criminal offences, including fraud, causing financial loss to the state, and money laundering.

He described his arrest experience as both physical and spiritual, claiming that he sensed the presence of deceased relatives — a sign, in his view, that his life was close to ending.

He explained that the system leaves no room for any individual—whether chairman, regional, constituency, or polling station—to alter the names of delegates.

“The procedure is clear. NEC decides on a date, which is approved by the National Council. A delegation is then sent from the national level to supervise elections at the polling stations, with constituency executives also involved. Afterwards, electoral area elections are conducted for councils of elders and patrons, who later take part in constituency executive elections,” he outlined.

According to Wontumi, duplicate copies of election records are submitted to both the regional and national offices, supported by both manual and computerized data. Delegates are also given the opportunity to verify registers before elections are held.

“All aspirants are currently engaging delegates and know their whereabouts, whether alive or deceased. Before voting, the list is cross-checked with what is submitted to the Electoral Commission. So there is absolutely no way anyone can remove names,” he stressed.

He further urged members to remain vigilant but reassured them that the process is rigorous enough to safeguard against tampering.

Wontumi’s assurance comes in response to comments by the Bono Regional Chairman of the NPP, Kwame Baffoe, popularly known as Abronye DC, who in a televised interview claimed he could influence the compilation of polling station albums. Abronye DC had threatened to strike out the names of certain delegates from the party’s register, sparking tension among grassroots members.

The Ashanti Regional Chairman, however, maintained that such threats hold no weight since the party’s internal structures and verification systems make manipulation impossible.

Meanwhile, the NPP has rejected the claim, insisting that no individual has the authority to control the process.

Mr Frimpong, in a recent statement, urged the public to disregard pronouncements made by Chairman Wontumi and Bono Regional Chairman Kwame Baffoe (Abronye DC), stressing that their remarks did not reflect the party’s official position.

But in a sharp response, Chairman Wontumi said the General Secretary’s statement wrongly cast him as antagonistic toward the party. He explained that his remarks were meant as constructive input to help the NPP secure victory in the 2028 elections under Dr Mahamudu Bawumia.

Recalling the internal contests that led to John Agyekum Kufuor’s rise as flagbearer between 1995 and 1998, he argued that just as Kufuor gained momentum through strategy and preparation, the current leadership must also position itself strategically. According to him, Dr Bawumia now requires a relative advantage of about nine percent to secure victory in 2028.

“My role as Ashanti Regional Chairman keeps me close to the grassroots, where people share with me their expectations about the future direction of the party,” he said, stressing that his comments have always been grounded in honesty and not personal ambition.

He further rejected claims that he invoked the authority of the National Council in his remarks, calling such suggestions misleading. Chairman Wontumi also criticised Mr Frimpong for not seeking clarification before issuing his statement, warning of the risks of misinformation in the digital age.

“In this era where saboteurs can easily use tools such as AI to distort messages, it would have been prudent for Mr Frimpong to have reached out to me directly for clarification before putting out a statement that does not reflect the truth,” he stated.

The statement addressed two issues. First was Mr Baffoe’s claim in a televised interview that he could influence the compilation of polling station albums. The party rejected the claim, insisting that no individual has the authority to control that process.

“The Party wishes to emphasize that the compilation of polling station albums will follow clear and transparent procedures, to be issued by the National Secretariat at the appropriate time, ensuring integrity, fairness, and credibility,” the release said.

The second issue related to Mr Boasiako’s allegation that fixing the presidential primaries for January 31, 2026, was intended to favour a particular aspirant. The NPP described this as false, clarifying that the early congress was a strategic decision.

“The decision to hold an early congress is solely to provide the Party with ample time and strategic advantage to reorganise, reposition, and prepare to recapture power in 2028,” the statement explained.

“I have gone with National Security operatives to the house of the Chairman of the NPP in Ashanti Region, Chairman Wontumi. Three cars. In fact, the cars were five. We’ve retrieved three. I have collected all from his house. We are still chasing him for the two. He has to pay for them,” she revealed.

She explained that under MASLOC’s operational guidelines, individuals who default on payments or misuse state vehicles are required to either return the assets or settle their debts.

“What we do is that once I seize the cars, the agreement we have with you is that you would have to repay whatever has accrued and we release the cars to you,” she clarified.

According to her, several cases of asset misappropriation have already been referred to the police.

“We’ve reported a lot of the issues to the police,” she confirmed.

Madam Mensah also cited another case involving a relative of former Vice President Dr. Mahamudu Bawumia, who allegedly refused to return a government Nissan Urvan vehicle after acquiring a replacement.

“I have a situation where a brother of former Vice President Seidu Imoro picks a car and he is bold to tell us that, ‘well he has used the car to work and he’s bought his own, so if we want we could come for it.’ So we’ve seized it,” she recounted.

“When I was arrested by EOCO, if you count your legs three times, that’s the width of the place where I was kept,” he told the crowd. “If you look at where I slept, I nearly died.”

He suggested his experience was both physical and spiritual, alleging that he sensed the presence of deceased relatives—a sign, in his view, that his life was close to ending.

“If someone is about to die, you’d know. You would see your relatives who have already passed away; you would begin to sense their presence around you, which literally means you are about to join them,” he said.

Wontumi emotionally compared his suffering to the crucifixion of Jesus Christ, recalling Christ’s cry on the cross as he related it to his own ordeal.

“I felt the presence of death around me in the place I was kept, just like when Jesus Christ shouted, ‘Eli, Eli, lama sabachthani.’ That’s when I also shouted, ‘People of Ghana, arise! Ghana, arise! It is because of you that I am being treated this way,’” he declared.

According to the Attorney General, charges have already been filed and suspects will be arraigned in court in due course.

These developments mark significant progress in the government’s pursuit of accountability in high-profile cases, including the controversial Sky Train scandal.

Dr Ayine assured the public that updates will continue as further action is taken in response to these alleged financial and organised crimes.

Chairman Wontumi was granted bail of GH₵50 million with two sureties to be justified, following his arrest on Tuesday, May 27, in connection with investigations into alleged fraud, money laundering, and causing financial loss to the state.

He made the disclosure on Asempa FM’s Ekosii Sen, expressing concern over Mr Appiah-Kubi’s public claim that he was unaware of a variation application Mr Nimako had filed, which allegedly frustrated the bail process for Chairman Wontumi.

However, Appiah-Kubi admitted that Mr Nimako had previously called to criticise him for not communicating a key decision beforehand.

“He did not inform me that he was going to take another decision,” he stated, adding, “I am a senior to him, and he should take his time.”

Quoting Proverbs 4:7, the former Asante Akyem North MP emphasised the importance of wisdom and understanding in professional and personal conduct.

“Wisdom is the principal thing; therefore get wisdom: and with all thy getting, get understanding,” he said, stressing that there is no basis for comparison between the two of them in terms of academic qualifications.

“The Return of the Galamsey Godfather: EOCO’s Last Laugh.”

That man?

Bernard Antwi Boasiako, aka Chairman Wontumi — mining magnate, political bulldozer, and unofficial patron saint of Ashanti Region’s soundbites.

Once the toast of political rallies and radio rants, Wontumi now finds himself at the centre of a legal jollof—cooked with EOCO’s hottest pepper, garnished with allegations of fraud, money laundering, and causing financial loss to the state. All that’s left is for Interpol to bring the salad.

But how did we get here?

Well, Justice Srem-Sai, Deputy Attorney-General and part-time truth sniper, casually dropped a legal grenade on Facebook (because press conferences are so last season).

He revealed that Wontumi’s case had grown legs, crossed borders, and is now doing a world tour in the arms of EOCO and the Financial Intelligence Centre (FIC).

And here’s the juicy part: Asset recovery is in full swing.
Which means if Wontumi so much as coughs up a golden toothpick, EOCO will weigh it, label it, and auction it with VAT.

But before the EOCO photocopier could warm up, enter the Minority in Parliament — led by Alexander Afenyo-Markin, Ghana’s answer to Aaron Sorkin — who marched straight to EOCO’s gate like Avengers on retainer. Not with fire and fury, but with briefcases and righteous indignation.

Their grievance?
Wontumi, they claimed, was being treated like an armed robber with allergies.
Unable to cough up a GH₵50 million bail, he was detained overnight. According to them, the bail condition was harsher than a Kumasi landlady collecting two years’ rent in advance — plus gas deposit.
They demanded “fairness”, “due process”, and a discount if possible.

But Bernard Ahiafor, the First Deputy Speaker, wore his law like a bulletproof vest.
He reminded them, with courtroom calm, that Parliament isn’t a remand yard. If you have issues with bail, don’t come and hold committee meetings at EOCO. “Go to court,” he essentially said — or in Ghanaian parlance,

“When your soup spills at home, you don’t report it to the chief’s palace.”

Meanwhile, in a plot twist that would make Nollywood jealous, Wontumi was reportedly moved from EOCO to a “small clinic” at the National Intelligence Bureau (NIB). Nobody specified whether this clinic had Panadol or a prayer warrior on standby, but the message was clear: the man dey suffer.

Afenyo-Markin accused EOCO of turning bail into punishment — like asking a guest to pound fufu before giving him water. Worse still, they demanded that properties be justified before posting bail.

In Ghanaian terms:
“Before you use your goat as security, you must prove it’s not your uncle’s.”

Social media, of course, did not disappoint.
Twitter, Facebook, and TikTok lit up like ECG meters during a storm.

Some called it Karma in legal robes. Others invoked the ancestral proverb:

“When the head of a family insults elders, the gods remove his slippers in public.”

One commentator, clearly sipping hot ginger tea, fired at youths who allegedly protested on Wontumi’s behalf for GH₵50 each:

“You collect coins to protect the man mining away your future? Next time, just sell your conscience on Tonaton!”

Another added, almost poetically:

“If you follow a rich man into a river, remember he can dry himself with dollars. You? You’ll catch pneumonia.”

The biggest suspense now?
If Wontumi somehow produces the GH₵50 million, FIC will investigate the money’s origin. If it’s in cash, they’ll count it till Christmas. If it’s in gold, they’ll weigh it with suspicion. If it’s in property, expect EOCO to pull up with a drone and a lawyer.

And so, Wontumi now walks a tightrope, with EOCO on one side, public outrage on the other, and Karma giggling softly in the background, wearing stilettos and a Supreme Court wig.

As the gods of karma dance Adowa on the roof of power, Chairman Wontumi sits in custody, his bail steeper than Afadzato in the rainy season.

And while his gold may shine, it won’t glitter past the scanners of EOCO, FIC, and every acronym that now smells cash like a goat sniffing ripe plantain.

Indeed, in this political season of accountability, let us remember the old Akan proverb:
“When the chicken perches on a rope, neither the chicken nor the rope sleeps well.”

Wontumi is the chicken. The justice system is the rope.

And the rest of us? We’re the curious village spectators… eating roasted groundnuts and taking notes.

Speaking on JoyNews’ The Pulse on Friday, May 30, he confirmed that Wontumi has not been well since his detention began but rejected claims that he is refusing food.

His clarification follows comments by the Majority Chief Whip and Member of Parliament for Nsawam-Adoagyire, Frank Annoh-Dompreh, who alleged that Chairman Wontumi had refused to eat as a form of protest.

Describing the situation as “shocking,” Mr. Annoh-Dompreh said Wontumi was on a hunger strike and that there was a lack of official communication regarding his welfare.

However, Mr. Appiah-Kubi stated that he had not received any such information, revealing that he had shared a meal with his client just days ago.

“Two days ago in the evening, I had dinner with him. I’m going to see him now at EOCO. After that, he will respond whether this happened today or yesterday,” the lawyer said.

Chairman Wontumi is under investigation for alleged involvement in fraud, money laundering, and other financial crimes. He was granted bail set at GH₵50 million with two sureties, both to be justified.

“Only John Dramani Mahama and his brother Ibrahim Mahama have that kind of money. We are on our knees begging Ibrahim Mahama and his brother to make the money available for Wontumi’s bail,” he stated.

Chairman Wontumi was arrested by the Economic and Organised Crime Office (EOCO) on Tuesday, shortly after leaving the CID headquarters in Accra. His arrest has drawn widespread criticism from within the NPP.

He remains in custody after failing to meet his bail conditions of GH₵50 million with two justified sureties on Wednesday, amid reports of ill health.

On Thursday, the Minority in Parliament and some members of the NPP stormed EOCO’s headquarters to protest the bail conditions, describing them as excessive and unreasonable.

His lawyer, Andy Appiah-Kubi, in an earlier interview, disclosed that some individuals who initially agreed to help later became hesitant after their names were made public.

However, Mr. Yandoh asserted that NPP members are living in fear, and given the intense scrutiny anyone who offers to bail Chairman Wontumi will face, no one is willing to provide sureties—even if they can.

In a light-hearted but pointed submission on the floor of Parliament, Adongo criticised the Minority for what he described as a lack of consistency in their protest over the detention of NPP Ashanti Regional Chairman, Bernard Antwi Boasiako, also known as Chairman Wontumi.

“I think Wontumi will be very, very sad that you are here talking. He was expecting you to sleep at EOCO with him,” Mr. Adongo said.

“You abandoned him to sleep there. And today, you promised the people of Ghana that you have abandoned this chamber but you are here making a lot of arguments.”

He continued, “You people should tell Wontumi that his people are deceiving him. He is sleeping there alone and you are here arguing for more holidays.”

Mr. Adongo also ridiculed the manner in which the Minority conducted their protest.

“We were surprised when they were sitting on the floor in front of EOCO yesterday, but when we went there at 7pm, they had disappeared,” he said.

The Minority in Parliament had on Thursday, May 29, boycotted parliamentary proceedings and held a sit-in protest at EOCO to demand the release of Chairman Wontumi, who had been detained for questioning.
