A legal practitioner, Kwame Ntow Fianko, has given an in-depth justification of why those found culpable in the number 12 expose by Anas can’t be prosecuted.

Speaking on the issue for the second time on Asempa FM’s Sports Avenue II show, Mr Fianko said only public officials found blameworthy while performing public functions are those that can be prosecuted under the criminal code of Ghana.

According to him, the former GFA president, Kwesi Nyantakyi and the referees who were seen taking bribes in the video were not performing public functions and are not government appointees too so per the law, they cannot be prosecuted.

The former Division One League Board chairman emphasized that in football administration, victims in the expose’ can only be banned.

“In the disciplinary code of FIFA, article 59 clause 1b stipulates that you can be given a lifetime ban if you indulge in bribery and corruption,” he explained.

“In our own GFA criminal code, article 61 clause 1b, bribery and corruption indulgence comes with a lifetime ban,” he added.

Mr Fianko also explained that in the CAF Disciplinary Code, specifically article 127, clause 1b talks about a lifetime ban and not prosecution.

A FIFA taskforce has been formed by the world football-governing body to create various mechanisms to deal with those found guilty in the expose’.
