Kissi Agyebeng has “messed up enough” – Lawyer Kwame Adofo calls for his removal

A private legal practitioner, Kwame Adofo, has called for the resignation of the Special Prosecutor, Kissi Agyebeng, following a recent High Court ruling on the powers of the Office of the Special Prosecutor (OSP).

Speaking on Asempa FM’s Ekosii Sen show, Lawyer Adofo criticised Mr Agyebeng’s handling of the office, insisting that he should step down over what he described as missteps in the execution of his mandate.

“I’m surprised he hasn’t resigned by now, as all his cases are null and void. I don’t understand why he is still being paid. Kissi Agyebeng has caused enough issues, and it’s time for him to go,” he stated.

His comments follow an April 15, 2026, ruling by an Accra High Court, which held that the OSP lacks the authority to initiate or conduct criminal prosecutions without prior authorisation from the Attorney-General.

The court further directed the Attorney-General’s Department to take over all ongoing criminal cases being handled by the OSP.

According to Lawyer Adofo, the ruling renders the OSP’s prosecutions invalid, arguing that the office must operate strictly under the authorisation of the Attorney-General as stipulated by law.

He further suggested that a more credible person should be appointed to lead the office, with the appropriate legal backing to carry out its functions.

“The parliament has stated that his mandate requires authorisation from the Attorney-General, rendering all current cases void. If the Office of Special Prosecutor (OSP) had the necessary executive instrument from the Attorney-General, he would be able to prosecute.

“The authorisation is what he needs to work effectively. The real problem lies with the people in the office, so if we could get someone more credible and provide them the appropriate authorisation, that would be beneficial,” he said.
