The Supreme Court has described as incompetent a writ challenging the appointment of Otiko Djaba as Minister for Gender and Social protection.
The court held it was unable to hear the case because Lawyer for the two plaintiffs, Godwin Tamakloe did not posses a valid Solicitor General’s license at the time of issuing the writ.
Members of Parliament (MPs) for Ashaiman and Juaboso constituencies, Ernest Norgbey and Kwabena Mintah Akandoh respectively headed to the court in February this year to challenge the appointment of Otiko as a minister.
The two Legislators prayed the court to declare Ms Otiko Djaba as unqualified to occupy the position because she failed to undertake the mandatory National Service.
Lawyers for the Minister led by Nutifafa Kuenyehia raised an initial objection when the matter was called today.
The Lawyers argued that Lawyer Godwin Tamakloe lacked a valid lenience to practice at the time he issued the writ.
In his response, Lawyer Tamakloe told the court he had applied for a renewal of the license and had not received it at the time he issued the writ.
CJ Sophia Akuffo who was presiding asked the lawyer:
“Did you have a valid license at the time”
Lawyer Tamakloe replied “No”.
The 7 member Panel thus unanimously dismissed the suit.
The decision read by CJ Akuffo, the court explained it could not hear the matter due to the fact that the plaintiff’s Lawyer did not have a license at the time of issuing the writ.
“The writ is hereby struck out as incompetent”, she said.

Aimless people who don’t have anything better doing with their time and constituents going about uselessly with some unnecessary law suit, they think they are still in Power right? Incompetent lawyer.
One MP who’s highly useless is this man called Akandoh. This buffoonery is in parliament. It affects the dignity of the house. They won’t read. They are in parliament because there’s nobody to challenge them.
