The Special Prosecutor, Kissi Agyebeng, has filed two additional witness statements in the ongoing criminal case involving former Finance Minister, Ken Ofori-Atta, and other accused persons.
The accused are facing charges linked to the Strategic Mobilisation Limited (SML) contract, which prosecutors allege resulted in a financial loss to the state exceeding GH¢1.4 billion.
At a hearing on Thursday, February 26, the court sought clarification on the whereabouts and legal status of Kenneth Nana Yaw Ofori-Atta and his former Chief of Staff, Ernest Darko Akore.
In response, the Office of the Special Prosecutor informed the court that the United States Department of Justice (DOJ), acting through Ghana’s Attorney-General, has formally requested guidance on the appropriate course of action regarding Mr. Akore, who holds dual Ghanaian and US citizenship.
According to the prosecution, the DOJ sought advice on whether US authorities should arrest Mr. Akore before serving him with a summons or serve the summons first. The OSP advised that American authorities should adopt the most expedient and legally sound option available under US domestic law.
Regarding Mr. Ofori-Atta, the court was told that the DOJ has acknowledged receipt of the extradition documents. The summons and charge sheet have reportedly been transmitted to him.
Prosecutors further disclosed that two separate proceedings are currently pending against Mr. Ofori-Atta in the United States — one relating to alleged immigration violations and the other concerning extradition.
Despite these developments in the US, the court was informed that proceedings in Ghana will continue.

In a related development, prosecutors refiled the charge sheet concerning the sixth accused, Kwadwo Damoah.
This follows an earlier application before a different judge requesting that his official titles be properly reflected in the court documents. The amended charges were accordingly read to include his designation as Hon. Col. (Rtd) Kwadwo Damoah.
The case has been adjourned to March 26, 2026. Disclosures are expected to continue during the adjournment period as the prosecution advances its case.
