Lightwave Health Care Solutions Limited has secured a High Court order permitting substituted service on the Minister for Health, Kwabena Mintah Akandoh, in an ongoing defamation case.
The court granted the application after lawyers for the company informed the court that several attempts to personally serve the Minister had been unsuccessful.
Substituted service allows legal documents to be delivered through alternative means when direct service cannot be effected.
Per the court’s directive, the Writ of Summons and Statement of Claim will be served by posting copies on the notice board of the High Court’s General Jurisdiction Registry in Accra, delivering copies to the Clerk of Parliament for onward transmission to the Minister, and publishing the documents online to ensure they come to his attention.
The company is suing the Minister over comments it says were made during public engagements, including media appearances, which it describes as false and damaging to its reputation.
In its statement of claim, the company alleges that the Minister accused it of exaggerating the number of healthcare facilities it had delivered, receiving payments for incomplete work, and fraudulently obtaining about US$11 million.
It also cites remarks in which the Minister is said to have questioned the functionality of the company’s health information systems and suggested possible mismanagement of funds.
According to the company, the claims have created a harmful public perception of dishonesty and misconduct, affecting its credibility both in Ghana and abroad.
It is therefore asking the court to declare the statements defamatory, order a retraction and apology, and award damages for the reputational and financial harm it says it has suffered.
