US-based Ghanaian law Professor Kwaku Asare is urging all LLB students who were denied entrance into the Ghana School of Law to sue the Ghana Legal Council (GLC) for compensation.
According to him, the action is a clear breach of the basic requirements stipulated by the law that regulates the establishment of the law school LI 1296.
“I’m urging the students who wrote the exams and later denied them the admission into the school should sue for damages” Prof. Asare on Wednesday told host of Adom FM’s Burning Issues program hosted by Afia Pokua.
He stated that, LLB holders has a right to automatically qualify to the Ghana Law School without writing any entrance exams but General Legal Council forced them to write the exams as basis to disqualify some students, adding that the student who were denied the admission should go to the High court to seek redress.
Prof. Asare’s comment follows the recent Supreme Court ruling that it is unconstitutional for the General Legal Council to make it mandatory for LLB holders to write entry examinations as well as pass an interview before they are admitted to pursue their professional careers in law.
A seven-member panel of the apex court headed by Justice Jones Dotse reached the unanimous decision in an application brought before it by US-based law Professor Kwaku Asare.
Prof. Asare on October 15, 2015, filled a suit against the GLC challenging the mode of admission of law students into the Ghana School of Law, the constitutionality of the General Legal Council’s imposition of new admission requirements for the professional course and also the constitutionality of the General Legal Council’s policy on reviewing examination scripts and quota admissions system.
The Supreme Court panel also ordered that the General Legal Council should take steps within the next six months to implement the orders of the court. It also declared that the judgment of the court does not take retrospective effect, but rather takes a prospective effect.
But Prof. Asare on the show called on Parliament and the Ghana Bar Association (GBA) to intervene to prevent General Legal Council from engaging in future illegalities.
Contributing to the discussions, some of the students who have been given index numbers to sit for their exams on 14th July called on the Chief Justice, Sophia Akuffo who chairs the General Legal Council  to call off the exams because it’s in contempt of the Supreme Court decision.
Others also threatened to boycott the exams whiles some also threaten to seek court injunction on the upcoming exams.
