The High Court in Sefwi Wiawso has ordered the New Patriotic Party (NPP) to suspend its constituency executive election in the Sefwi Wiawso Constituency pending the determination of an application for an interlocutory injunction.
The order was issued on Friday, July 10, 2026, by the High Court in Suit No. WN/SW/HC/E12/35/2026 involving seven plaintiffs led by Ben Kumi against the National Chairman of the NPP, the party’s Director of Information Technology, the Chairman of the Constituency Election Committee, the Regional Chairman, the Constituency Chairman, the Western North Regional Director of the Electoral Commission and the Bibiani District Director of the Electoral Commission.
The decision followed the court’s dismissal of an application seeking to strike out the suit on grounds that it constituted an abuse of court process and that the plaintiffs had failed to exhaust the party’s internal dispute resolution mechanisms.
According to the court order, the application to strike out the case was supported by an affidavit filed by Benjamin Armah on July 6, 2026, while the plaintiffs, led by Ben Kumi, filed an affidavit in opposition on July 9.
The court heard submissions from counsel for the fourth defendant, Dennis Kumah-Kwarkye, and counsel for the plaintiffs, Alfred Obeng Boateng, before delivering its ruling.
Although the court dismissed the application to strike out the suit, it granted the fourth defendant additional time to file an affidavit in opposition to the pending motion for an interlocutory injunction.
The court noted that the NPP constituency executive election was scheduled to take place between July 10 and July 15, 2026, but ruled that the matter should be stayed until the injunction application is determined.
“It is further ordered that in line with Order 1 Rule 2 of C.I. 47, the NPP Constituency Executive Election shall not be held until the determination of the pending injunction motion,” the court ordered.
The case has been adjourned to July 17, 2026, when the court is expected to hear the interlocutory injunction application on its merits.
