H. Kwasi Prempeh reacts to High Court ruling on OSP prosecutions

Executive Director of the Centre for Democratic Development (CDD-Ghana), H. Kwasi Prempeh, has reacted to a High Court ruling in Accra directing the Attorney General (AG) to assume responsibility for all criminal prosecutions currently being handled by the Office of the Special Prosecutor (OSP).

The court ruled that such prosecutions are void where they proceed without prior authorisation from the Attorney General, stating that while the OSP has investigative powers, it can only initiate and pursue prosecutions with the consent or approval of the AG in line with Article 88(4) of the 1992 Constitution.

The decision effectively transfers all ongoing OSP-related prosecutions before the courts to the Attorney General’s office.

Reacting to the development in a Facebook post that has since gone viral, H. Kwasi Prempeh wrote:

“Mr. Special Prosecutor, please don’t appeal, and don’t resign o; don’t! Don’t even fight it in the media. Relax koraa. You and your staff should just sit tight and collect your pay and perks and spend your budget as planned, ok. That, too, counts as public service in 🇬🇭. Don’t kill yaself over this! Country broke or no broke, we all dey inside—unequally, of course!”
