You’re not a judge – Kwabena Agyepong slams OSP over ‘fugitive’ tag on Ofori-Atta

Former General Secretary of the New Patriotic Party (NPP), Kwabena Agyei Agyepong, has questioned the legal authority of the Office of the Special Prosecutor (OSP) in declaring former Finance Minister Ken Ofori-Atta a fugitive.

In an interview with Citi FM on Tuesday, 3rd June 2025, Mr Agyapong argued that such a declaration can only be made by a competent court of law—not an investigative body.

“You are not a judge yourself to be able to declare someone a fugitive just because you cannot have access to the person,” he stated.

His remarks follow a public announcement by Special Prosecutor Kissi Agyebeng, who said Mr Ofori-Atta was considered a fugitive after failing to return to the country to respond to ongoing investigations.

Mr Agyapong stressed the importance of due process in the pursuit of justice and accountability, cautioning state institutions to stay within legal boundaries.

“What happens to the basic law which says that you are innocent until you are proven guilty?” he asked.

The OSP, however, has defended its position, insisting that Mr Ofori-Atta failed to provide sufficient medical documentation to justify his absence and has not cooperated with investigative procedures.

As a result, the OSP has reinstated him on its list of wanted individuals.
