Supreme Court dismisses NAM1’s bid to halt trial

The Supreme Court has dismissed an application filed by the Chief Executive Officer of Menzgold Ghana Limited, Nana Appiah Mensah (NAM1), seeking to halt ongoing criminal proceedings against him at the High Court.

The application, filed after the Court of Appeal rejected a similar request on May 9, 2024, sought special leave that would have effectively suspended the trial in which the Financial and Economic Division of the High Court had earlier ruled that a prima facie case had been established.

NAM1 had been ordered to open his defence, prompting his lawyers to move to the appellate courts in an effort to stay the proceedings.

However, the apex court on Wednesday refused the request, affirming that the trial at the High Court must continue. The court is expected to file its full written reasons on December 17.

NAM1, along with his companies Brew Marketing Consult and Menzgold Ghana Limited, faces 39 charges, including selling gold without a licence, operating an unlicensed deposit-taking business, inducement to invest, defrauding by false pretence, fraudulent breach of trust, and money laundering.
The alleged offences involve more than GH₵340 million.

Following the ruling, the case is expected to return to the High Court on December 16.

Aggrieved customers say they are relieved by the Supreme Court’s decision, describing it as long overdue after years of stalled proceedings.

According to the leadership of the Aggrieved Menzgold Customers, the matter has dragged since 2018, with multiple legal challenges slowing the process. They expressed hope that the dismissal of the application will pave the way for a daily trial to expedite the case.
