SML lawyer dismisses OSP’s GH¢125m recovery claim as unfounded

Lawyer for Strategic Mobilisation Ghana Limited (SML), Cephas Boyuo, has dismissed claims by the Office of the Special Prosecutor (OSP) that the state is set to recover GH¢125 million from the company, describing the allegation as “baseless and without evidence.”

According to him, the OSP’s statement lacks both factual and legal merit and only serves to incite unwarranted public outrage against SML.

“The OSP’s assertion that GH¢125 million is to be recovered by the state from SML has no factual and evidentiary basis. It is mere conjecture and only whips up unnecessary sentiments,” Boyuo said.

Reacting to the OSP’s recent report on SML’s revenue assurance contract with the Ghana Revenue Authority (GRA), the lawyer cited official communication from the GRA as proof that SML had fulfilled all its contractual obligations.

“A letter from the GRA dated October 14 clearly confirms that SML has discharged all its duties. SML fulfilled everything required under the agreement,” he stated.

He explained that the GRA’s own records show that SML provided transaction audits, external price verification services, and revenue assurance within the petroleum downstream sector — as stipulated in the contract.

“The Authority’s records confirm that SML Ghana Limited undertook work relating to transaction audits, external price verification services, and revenue assurance in the petroleum downstream sector. Relevant reports and technical documentation covering the work done are available for review upon request,” he noted.

Mr. Boyuo further clarified that all payments made to SML between January 2019 and December 2024 were properly documented and traceable.

“All payments made to SML Ghana Limited from January 2019 to December 2024 are supported by payment schedules, and copies have been attached to the records at GRA,” he emphasized.

The OSP’s investigation into the SML-GRA contract had alleged irregularities in the company’s operations and recommended the recovery of GH¢125 million, sparking intense public debate over the contract’s transparency and value to the state.

However, SML maintains that its work has significantly enhanced Ghana’s petroleum revenue monitoring system and helped close critical revenue leakages. The company insists that every payment it received was earned under the terms of its agreement with the GRA.

SML’s management has since reaffirmed its readiness to cooperate fully with all lawful investigations while defending its integrity against what it describes as “misleading narratives.”
