National Democratic Congress (NDC) is seeking an interlocutory injunction from the Supreme Court to stop the Electoral Commission (EC) from holding the by-election in Ayawaso West Wuogon constituency.

The plaintiff who is the NDC Constituency Chairman for the area, Bismarck Aborbi Ayitey claims the 60-days stipulated in Article 112 Clause 5 of the 1992 Constitution for the by-election to be held has elapse thus the date for the election will be in violation of the law.

The much anticipated by-election is scheduled to take place on Thursday, January 31, 2019.

The EC has cleared candidate of the New Patriotic Party (NPP) Lydia Alhassan and NDC candidate, Delali Kwasi Brempong to contest the seat.

But the NDC Chairman on Asempa FM’s Ekosii Sen programme Monday said, the EC will be acting Ultra varies if it goes ahead with the elections.

As a citizen and not a spectator, Mr. Ayitey said they want to ensure the right things are don’t in the remit of the law.

He explained that, after Parliament wrote to the EC Chairperson, Jean Mensah on November 26, 2019, the by-election should have been held on 26 January which is when the 60 days will elapse and not 31.

“We are hoping the Supreme Court acts on this matter because the EC has exceeded the 60 day threshold” he added.

In the unlikely event the NDC is not successful, Mr. Ayitey said they will contest the election and will snatch the seat from NPP.
