
The High Court (Criminal Division) has dismissed an application filed by former Finance Minister Ken Ofori-Atta challenging the legality of an arrest warrant issued by the Office of the Special Prosecutor (OSP).
In a ruling delivered on Wednesday, July 30, Justice Lydia Osei Marfo ruled that the application lacked merit.
Mr. Ofori-Atta argued that the OSP’s actions in obtaining the warrant were unlawful and violated due process. He also called on the court to nullify all associated proceedings, including an Interpol Red Notice issued against him.
His legal team described the OSP’s move as “procedurally flawed” and an infringement on his constitutional rights.
However, lawyers for the OSP maintained that the warrant was lawfully secured and executed. They insisted there was no evidence of abuse of power, urging the court to reject the application.
Justice Osei Marfo, in her judgment, said there was no sufficient basis to interfere with the actions of the OSP.
“The application is hereby dismissed in its entirety,” she ruled, affirming the validity and enforceability of the arrest warrant and the accompanying Red Notice.
