
A private citizen, Daniel Ofori-Atta, has formally petitioned President John Dramani Mahama, seeking the removal of Supreme Court Justice Yonny Kulendi over claims of judicial misconduct.
The petition, filed on September 30, 2025, has accused Justice Kulendi of alleged improper interference in High Court proceedings relating to the ongoing ambulance scandal case, Republic v. Cassiel Ato Forson & 2 Others.
According to the petitioner, Justice Kulendi’s actions breach key provisions of the Code of Conduct for Judges and Magistrates, potentially undermining judicial independence and public confidence in the courts.
Mr. Ofori-Atta confirmed that the petition has been formally submitted and acknowledged by the Office of the President.
This is not the first time the petitioner has raised concerns about Justice Kulendi.
In an earlier petition, he called on the Criminal Investigations Department (CID) to investigate both Justice Kulendi and businessman Richard Jakpa in connection with the same case.
He alleged that when the trial of the accused persons began in January 2023, Mr. Jakpa used his familial connection with Justice Kulendi to obstruct justice, with the ultimate objective of either securing his acquittal or having the prosecution against him abated by the then Attorney-General, Godfred Yeboah Dame.
The petition asserted that the actions of Justice Kulendi and Richard Jakpa may constitute criminal offenses relating to interference with legal proceedings under the Criminal Offences Act, 1960 (Act 29).
While it remains uncertain what immediate steps will be taken, Ghana’s 1992 Constitution outlines in Article 146 the strict procedure for the removal of a Justice of the Supreme Court, which involves an investigation by a committee set up by the Chief Justice or, where necessary, another appointed authority.
