Two jailed 30 years for robbing banker of vehicle, personal belongings https://www.adomonline.com/two-jailed-30-years-for-robbing-banker-of-vehicle-personal-belongings/ Thu, 28 Nov 2024 08:42:00 +0000 https://www.adomonline.com/?p=2476773 An Accra Circuit Court has sentenced two persons to a total of 30 years imprisonment for robbing a banker of her vehicle at East Legon Christian Centre.

Peter Amuzu, also known as Master Pee, and Isaac Brena Eshun, aka Young, took away the banker’s money in various currencies and other cards.

Amuzu and Eshun earlier denied the charges of conspiracy and robbery.

When the matter was called, the accused persons, through their counsel, told the court they wanted to change their plea from not guilty to guilty.

The court presided over by Kwabena Kodua Obiri-Yeboah, retook their pleas.

The court convicted each of the accused persons on their own pleas and sentenced them accordingly.

On the charge of conspiracy, each was sentenced to 15 years’ imprisonment.

On the charge of robbery, each received 15 years’ imprisonment. Both sentences are to run concurrently.

A third accomplice, Ibrahim Mohammed, will stand trial for charges of abetment of crime and dishonestly receiving.

Police say Mohammed bought a pistol for the two convicts to commit the crime, and he received the complainant’s vehicle.

He has denied the offences.

The prosecution, led by Assistant Superintendent of Police (ASP) Emmanuel Haligah, said the complainant (name withheld) was a bunker residing at East Legon Christian Centre.

The first accused person, Amuzu, claimed to be a steel bunder and was a resident of American House, East Legon, he said, while the second accused, Eshun, was a driver residing at Takoradi.

The third accused, Mohammed, aka King Dawa, was a businessman residing at Gururgu, Tamale.

Prosecution said in March 2024. Amuzu, while on remand in the police cell at Madina for another robbery offence, recruited Eshun, who was also in the cell for an offence of stealing.

The court heard that they planned to embark on a robbery expedition when they got out.

On August 19, 2024, Amuzu and Eshun, armed with a pistol, attacked the complainant at the entrance of her residence at East Legon Christian Centre.

The prosecution said Amuzu ordered the complainant at gunpoint to come down from her vehicle, a Mercedes Benz C180, with registration number AA 1991-21, valued at 60,000 Euros, equivalent to GH¢1,045,738.

The complainant obliged for fear of losing her life.

Eshun, the prosecution said, quickly took over the steering wheel, and they drove the car to an unknown destination. The complainant had her handbag containing a German passport, three iPhones valued at GH¢44.629.43, a Ghana card, ATM cards, a health insurance card, $1500 cash, GH¢16,000, and an unspecified amount of Jamaican dollars.

Prosecution said the same day, Eshun took the car to Tamale on the instructions of Amuzu to sell it to Mohammed, who also agreed to buy it.

Mohammed made a cash transfer of GHC10,000 to Eshun’s mobile money wallet No. 0550571605 as part payment.

Mohammed then removed the registered number plate from the car to conceal its identity.

On August 22, 2024, Eshun was arrested at Dansoman, and a search conducted on him led to the retrieval of one gold-coloured iPhone 14 ProMax. Samsung Galaxy A15, air pods, cash in the sum of GH¢18,000. $1014,000 Uganda shillings, 400 Rwanda francs, 550 Jamaican dollars, and other personal effects of the complainant.

Eshun admitted the offence and mentioned Amuzu as his accomplice.

The prosecution said on August 23, 2024, Amuzu was arrested at American House, East Legon, where an iPhone 13 Pro belonging to the complainant’s friend, Mansour Inusah, a witness in the case, was retrieved.

Amuzu admitted the offence and mentioned Mohammed as his old friend in Tamale whom he instructed Eshun to send the car to.

On August 24, 2024, Mohammed was arrested in Tamale in possession of the complainant’s Mercedes Benz and a Toyota Fortuner 4X4 with registration number GX 2735-19.

He told the police that he bought the Toyota Fortuner 4X4 also from Amuzu and his friend Kwame in February 2024.

Investigations later revealed that the owner of the Toyota Fortuner 4X4 was shot and robbed by Amuzu and his accomplice, Kwame, in another robbery case at Lakeside Estate.

During the investigations, Mohammed admitted that he gave Amuzu an amount of GH¢7,000 to be used to procure a gun, which was used in the robbery, and four days later, he was offered the stolen Mercedes Benz at the cost of GH¢300,000, out of which he made the part payment of GH¢10,000.

The prosecution said on August 31, 2024, Eshun and Mohammed led the police to a location at Techiman where they had dumped the complainant’s personal effects.

The German passport, ATM cards, Ghana Card and other documents belonging to the complainant were retrieved from the scene.

Efforts were being made to apprehend Kwame, who is said to be in possession of the weapon used in committing the crime.

This was after the High Court presided over by Justice Lydia Osei Marfo was of the considered view that, the accused when granted bail would likely not appear to stand trial.

According to the Court, even though the Court has a discretionary power to grant bail, that discretion must be exercised in a manner that will be of interest to the society and the victims involved.

“I am of the considered opinion that looking at the nature of the accusations against the accused and the nature of evidence….I am inclined to believe that he will not avail him to stand trial when granted bail,” Justice Marfo ruled.

While refusing the bail application, the Court assured both parties of an expeditious trial in the matter.

Justice Marfo also said the accused should remain in custody.

In Court on Thursday, Lawyers of the accused led by Paul Assibi Abariga while moving the bail application, said, his client will avail himself to stand trial when granted bail.

“The accused shall always appear to stand trial at all time. He has no motivation of any incentive or power to decide not to appear before your Ladyship,” he submitted.

Ms. Amanda Awadey, a Senior State Attorney while opposing to the bail application said, the accused is a flight risk and would not avail himself to stand trial when granted bail.

“There is overwhelming evidence in support of our case against the applicant (Accused). The applicant upon his arrest confessed to robbing the victims and various robbery scenes and he further identified himself in a CCTV photograph from various scenes,” the Senior State Attorney submitted.

According to reports, the case has been adjourned to May 21 while the Prosecution has been directed to file the second batch of their disclosures.

Mrs. Amissah-Arthur is the wife of the late Paa Kwesi Amissah-Arthur, who was Vice President between 2012 and 2016.

Car washer jailed 17 years for robbery https://www.adomonline.com/car-washer-jailed-17-years-for-robbery/ Tue, 22 Aug 2023 12:39:25 +0000 https://www.adomonline.com/?p=2285631 A 19-year-old car washer has been sentenced to 17 years imprisonment by the Circuit Court in Accra for robbery on Monday.

The incident, according to the prosecution, led to him stabbing a woman he robbed and has left her hospitalized in critical condition.

Christopher Amolee pleaded guilty simpliciter on his first day in court to the charge of robbery contrary to section 149 of Act 29/60.

He was then convicted on his own plea by the Court presided over by Her Honour Mrs Afia Owusuaa Appiah.

Amolee was said to have committed the act on August 9, 2023, at Sakomono in the Greater Accra Region and made away with his victim’s cash of GHc976.00.

Before sentencing, Amolee, who looked sober in the docket, narrated what happened but told the court that he did not know what came over him to commit the act.

He also prayed for the court to have mercy on him and for his master to forgive him and accept him back since he had no place to go.

He also told the court that he does not have anybody—either a father or a mother, but only his master whom he had offended before he was sentenced.

The convict who appeared without legal representation after his conviction, had a lawyer who was acting as a friend to the court to pray the court to tamper justice with mercy and offer him the minimum punishment.

It was his case that, looking at the demeanour of the convict, and his explanation to the court, it appeared it was a stealing gone bad.

The prosecuting officer, Inspector Wisdom Alorwu urged the court to impose a punishment that will reflect the gravity of the offence bearing in mind the critical health condition of the victim.

Her Honour Mrs Appiah, in sentencing the convict said she took into consideration the convict’s plea for mercy and leniency.

The court also said it took into account the age of the convict and the aggravating harm of the victim and the fact that the convict had a fiduciary relationship with the complainant.

He was consequently jailed for 17 years.

The complainant, (husband of the victim), was left in tears after the convict was sentenced.

Brief facts

Per the brief facts of the case as presented to the Court by Inspector Alorwu, were that the Complainant Hisham Seidu is a farmer and resides at Regimanuel Estate Sakumono while the accused Christopher Amolee is a car washer who currently has no place of abode.

According to the Prosecution, on August 9, 2023, at about 3:30 pm, the Sakumono police received a distress call that a thief had stabbed someone and made away with the victim’s handbag containing money and other belongings.

Inspector Alorwu said, a Police team led by Inspector Frank Sampana and two others proceeded to the scene and found the victim (Adiza Tinogah) who is the wife of the complainant lying in a pool of blood.

The Prosecutor said the victim was quickly rushed to the C&J Hospital by G/Sergeant Abraham Dwamena.

Inspector Alorwu said, the remaining police officers combed the area and arrested Christopher Amolee and upon a search on him, a pistol, a lady’s handbag containing money and other belongings of the victim were retrieved.

The Prosecutor said an investigation was extended to the victim’s house where blood stains were found all over including a butcher’s knife with blood stains found lying in the garden of the house.

He said, the Police extended investigations to the C&J Hospital and met the victim in a critical condition about to be transferred to
the Korle-bu Teaching Hospital for further treatment.

The Prosecutor said the Accused admitted the offence in his caution statement. The crime scene has been preserved and the police crime scene team have been contacted to come and process the scene to enhance investigations.
