Addressing Parliament on the state of prisons in the country, he said the Finance Ministry’s approval has lingered despite all necessary steps taken to get the increment approved.

“Mr Speaker, the Ghana Prisons Service and the Ministry have made various attempts for the upward adjustment of the feeding rate from ¢1.80 to ¢5. I must acknowledge that this move to increase this rate precedes our coming into office.

“It’s not as if it is just us who have seen the need to promote that. We are, however, yet to receive approval for that,” the Nandom legislator said.

Many prison campaigners and activists had previously indicated that the ¢1.80 is inadequate.

In an interview with JoyNews, a Chief Superintendent of Prisons, Courage Atsem, decried the meagre feeding grants allocated to prisoners in the country, saying the money is “woefully inadequate.”

He noted that although interventions were made to supplement government funding, they have not been effective.

But the Interior Minister says their calls for the increment will not be in vain.

The feeding rate for prisoners in the country remains ¢1.80 for three-square meals (per head) per day in spite of the increasing cost of living.

During a meeting with the Judicial Committee of the Council of State at the Nsawam Medium Security Prison, the Eastern Regional Commander of the Service, Deputy Director of Prisons (DDP), Samuel Owusu Amponsah, said the situation make feeding the inmates difficult.

In spite of its meagre nature, the funds are, sometimes, also not released on time, CSP Courage Atsem disclosed.

“Sometimes, the releases don’t even come on time and as a manager, you can’t say ‘I’ve not received anything so I can’t feed my inmates.’ The inmates must eat so you need to perform some magic for the inmates to be able to eat,” he added.

Their liberty comes after the Commonwealth Human Rights Initiative intervened in partnership with OSIWA by settling the court-imposed fines at the Kumasi Central Prisons.

The gesture forms part of an advocacy project aimed at decreasing the criminalisation of petty offences in the country.

Speaking to JoyNews, one of the released inmates, Atta Kwesi Nuako, a taxi driver, said he learned lessons as life in the prison was not easy and advised everyone to be cautious about friends and in all they do.

He was convicted for stealing by the Bekwi Circuit Court. For failing to pay a fine of GH¢336.00 he was sentenced to 10 months imprisonment.

“I have learnt a lot of lessons here; it is not easy to be an inmate in the central prison. A group of 18 inmates, we sleep under one bed, and you cannot even turn whilst in sleeping position,” he said.

The Project Officer for access to Justice at the Initiative, Anthony Sedjo, said there should be a non-custodial sentence law so that some of these people will do community services or communal labour instead of imprisonment.

“We believe that people who commit petty offenses like hawking, like traffic offenses, should not find themselves in jail,” he said.

The Kumasi Central Prison is one of Ghana’s overcrowded prisons as it currently accommodates over 1,800 inmates although the facility was built to house 600 persons.

The Assistance Criminal Records Officer of the Kumasi Central Prisons, DSP Francis Yaw Apaw, said about 40 per cent of the inmates committed petty crimes such as stealing, assaults and traffic offences.

“Some prisoners are with petty fines; ¢300, ¢400, ¢500, ¢600, they are all bunched up here adding up to the serious congestion in our facility,” he said.

He, therefore, called on individuals, groups or organisations to intervene by also paying court fines of inmates with such offences who are languishing in cells.

“When we get such help, it will go a long way to ease the pressure on this facility. Averagely those with petty offences are the people that come in a lot; they contribute to about 40 per cent of the total population,” he revealed.

However, officials of the project hope the initiative, which has already seen some 60 inmates regaining their freedom, will help decongest the overcrowding prisons in the country.

The Minister of Interior, Rauf Aregbesola, announced this at a press conference which was held at the headquarters of the Nigerian Correctional Service in Abuja on April 9. 

According to the Minister, those eligible for the pardon include inmates who are 60 years and above; those suffering from ill-health likely to result in death; convicts serving three years and above and have less than six months to serve; inmates with mental issues; and inmates with an option of fine not exceeding N50,000.

Aregbesola said that out of the said number, 70 inmates will be released today from Kuje maximum custodial centre.

“In a symbolic gesture of the amnesty given to the 2,600 inmates across Nigeria, 41 Federal inmates and 29 FCT inmates making a total of 70 inmates who met the above criteria will be released today from the Kuje Custodial Centre in Abuja. This amnesty will not apply to inmates sentenced for violent extreme offences such as terrorism, kidnapping, armed banditry, rape, human trafficking, culpable homicide and so on.

The Governors of the 36 states under whose jurisdiction most of the inmates were incarcerated will complete the exercise in line with the federal principle,” he said.

Checks by Adom News revealed that the prison, which was built about 70 years ago, has not witnessed any major renovation with about 350 inmates sharing 10 bathrooms.

In an interview with Adom News during a health screening exercise by the Eastwood Ababa Ministries in the facility, they explained that all the inmates rely on 10 dormitories in the facility for accommodation.

“Our dormitories are congested with about 35 people sleeping in a single room leading to the outbreak of diseases in the facility,” they complained.

They are Joseph Addoa, 30 years old, serving 40 years in prison, and Yaw Bio Yakubu, 57, also serving 25 years for robbery.
Yakubu was initially sentenced to life imprisonment but it was later reduced to 25 years.
Joseph Addoa, according to police reports, persuaded the victim that he is an importer and succeeded in collecting the aforementioned money through mobile money.

Narrating the incident to DAILY GUIDE, the victim, (name withheld), said sometime in August 2017, she received a call from Addoa, who introduced himself as an importer and through their subsequent telephone conversations, he proposed marriage to her.
She said a month later, Addoa demanded financial assistance from her to clear his car spare parts from the harbour.
According to the victim, Addoa furnished her with five mobile money numbers to deposit an amount of GH¢8,300 into them.
Addoa allegedly went ahead to tell the victim how much money should be paid into each of the mobile money accounts; and on October 10, 2017, the victim did as he had directed.
Later, the victim said Addoa was still demanding more money and it was at that point that it dawned on her that Addoa might be a fraudster, and reported the matter to the Accra Regional Police Command.
DSP Savior Ahiamadi, the crime officer in-charge of operations, confirmed that since the victim did not know the identity of the said Addoa after reporting the matter, the police asked her to persuade the suspect to come down and act as a guarantor while she sold her parcel of land and any money that would accrue, she would give it to him to clear the goods.
The victim, following the advice of the police, persuaded Addoa in one of their telephone conversations to come down and act as a guarantor for her to sell her land but he immediately gave an excuse that he was busy attending to some important issues in Kumasi and that he would send his nephew to stand in as a guarantor for the land to be sold.

On December 27, Addoa sent one Kwame Mustapha to meet the victim to sign the land documents and was arrested by the police.
The victim again called Addoa to report that his nephew did not turn up and so the following day, Addoa sent one Stella Hadzah – a nursing mother he claimed was his sister – to sign the documents.
It was after Hadzah had been arrested that the police and the victim got to know that Addoa was a prisoner serving his jail term at the Ankaful Maximum Prisons.
Police investigations later revealed that he used Mustapha and Hadzah for his nefarious activity, but they were also innocent.
Mustapha, according to the police, was promised a contract by Addoa, after he (Addoa) had defrauded him of GH¢50.
The police said on January 2, 2018, Addoa was identified at the Ankaful Prison and he mentioned Yaw Bio as the master-mind behind the act and with the help of the prisons wardens, the mobile phone allegedly used for the nefarious activity was seized.

Visitors pay GHc2 to see prisoners https://www.adomonline.com/visitors-pay-ghc2-see-prisoners/ Fri, 10 Nov 2017 05:44:27 +0000 http://35.232.176.128/ghana-news/?p=651011 Prison authorities at the Kumasi Central Prisons are taking GHc2 from each person who comes to visit an inmate in the facility, without issuing receipts to cover the fee, the Chroniclecan confirm.
This conduct is in contravention of section 38 of the Prisons Service Act 1972, (NRCD 46), which does not prescribed payment of fees by visitors to the prisons.
The said Act reads:
1.Every prisoner under sentence of imprisonment shall be entitled, once in every two weeks, to receive a visit from friends or relatives in the presence of a prison officer.
2.A prisoner under sentence of imprisonment, may in exceptional circumstances, be granted permission by the officer in charge of the prison to receive a visit from friends or relatives in addition to the visit to which he or she is entitled under subsection (1).
3.Every prisoner not under sentence of imprisonment shall be allowed all reasonable opportunities daily of receiving visits from friends or relatives.
4.Every prisoner shall be allowed all reasonable opportunities of receiving visits from his legal advisers.
5.If a prisoner who is seriously ill wishes to be visited by any friends or relatives, a medical officer may give an order in writing for the admission of such friends or relatives if he considers it advisable.
Las Friday, when this reporter went to the said facility for the ‘Justice for All Programme,’ uncountable number of visitors who came to the facility to visit some of the inmates were asked to fill the visitors’ pass, after which a prison officer, was seen supervising the illegal exercise of collecting the money from the visitors.
This happened at the forecourt of the PRO’s office.
The Chronicle observed that, the visitor’s form, which was half of an A4 sheet, was halfway filled, with the name of the Assistant Superintendent of Prisons (ASP) R.O. Bonsu, as the officer who appended his signature on it.
The prisons officer was seen collecting the money and keeping it in a red file.
It was established that visitors were asked questions like how they relate to the inmate, what items were bringing to them, as the security officer filled the visitors’ pass.
The Chronicle noticed that, all the visitors were ordered to thumb print.
Speaking to one of the visitors (name withheld), after visiting her brother in the facility, she told the Chronicle that she has been paying GHc2 ever since her brother was thrown into jail for the past eight months.
Approached by the Chronicle, the Public Relations Officer (PRO) of the Kumasi Central Prisons, ASP Richard M. Bukari, confirmed that indeed they have been taking GHc2 from visitors, after they had filled the visitors’ pass.
According to him, they are not the only prison facility that takes money from visitors, and that is done everywhere in Ghana.
Asked about why authorities do not issue receipts to visitors upon taking money from them, the PRO replied that they give back the pass to them, which serves as a receipt.

Amadu Shaibu, alias “Nasiru”, and Kwadwo Poku, alias “Mahala”, were handed down the punishment after they pleaded guilty to possessing narcotic drugs without authority.
They had been taken out of the prison to fetch firewood, escorted by a prison officer, but managed to slip to buy marijuana.
Police Chief Inspector Felix Akowuah told the court, presided over by Mr. John Mensah that the incident happened at the Race Course in Kumasi, on August 19, last year, at the about 1020 hours.
He said the two were caught by officers of the Police Drug Law Enforcement Unit, who had been sent to the place, notorious for hard drugs peddling, to flush out the peddlers and users.
They were caught right in the act of re-wrapping the dried leaves and to smuggle this to the prison by inserting it in the anus.
Once inside the walls of the prison, the drug would be expelled and then sold to the other inmates.
The prosecution put the weight of the marijuana found on the pair at 312.22 grams.
They told investigators that they received the drug from one Faisal at the Race Course but failed to lead the police to the said man.

The four inmates were unconditionally discharged out of the 34 hearing applications received.
Two specialized High courts have been set up at the prison to hear the cases of some of the accused persons on remand.
Joy News’ Maxwell Agbagba who followed the story reported on Adom Midday News that, one of the people who gained his freedom was a 22-year-old boy who has been on remand for two years without trial for stealing an LCD Television.
The young man, Maxwell said after being set free, broke into tears and thanked the court that was constituted to hear his case and the lawyers who defended him.
