The motion, filed on March 15, 2025, seeks to restrain the Office of the Special Prosecutor (OSP) from declaring Mr. Ofori-Atta a “wanted person” and a “fugitive from justice.”

On February 12, 2025, the Special Prosecutor publicly declared Mr. Ofori-Atta wanted and a fugitive in connection with four high-profile corruption investigations.

However, Mr. Ofori-Atta contends that the declaration was unlawful and is pursuing compensation.

He is also requesting the court to order the OSP to remove all related declarations from its social media platforms.

The motion was filed by his legal team and is currently being contested by the OSP.

Meanwhile, the former minister, who is seeking an early resolution, is expected to appear before the OSP on June 2, 2025.

Speaking on Joy FM’s Midday News on Monday, Davies expressed disappointment with the OSP’s handling of the case, insisting the office should respond to the latest suit filed by Ofori-Atta rather than seeking media attention.

“You have been served with an originating notice of motion. The OSP has conceded that the process has been duly served. As a trained lawyer occupying such an esteemed office, what should he have done? Respond to the motion—not engage in knee-jerk reactions, showboating, and unnecessary attempts to court public attention through press conferences,” he stated.

His comments follow the OSP’s warning that Ofori-Atta would be re-listed as a wanted person if he fails to appear for questioning on June 2, 2025.

Ofori-Atta recently filed a suit against the OSP, seeking an injunction to prevent his reclassification as a wanted person. His legal team argues that he has cooperated with investigations through his lawyers, and any attempt to label him a fugitive would be unfair and damaging to his reputation.

Previously, the OSP had removed Ofori-Atta’s name from its wanted list after he assured authorities of his cooperation. The prosecuting body has since reiterated that Ofori-Atta had personally requested removal from the list, pledging to be available for questioning on a specific date.

Davies, however, questioned the OSP’s motives, insisting that his client remains available and that an agreement exists for his appearance in June.

“Our client is still outside the country for a reason, and this reason has been communicated through proper procedures. What else should be done? The OSP agreed that he would appear on June 2. Why not wait until then? This is an act of extreme bad faith, unethical and unprofessional conduct coming from a trained lawyer,” Davies argued.

He further emphasized that legal processes exist to ensure Ofori-Atta returns to Ghana if necessary, dismissing claims that his client is evading justice.

Mr. Ofori-Atta has said the declaration was unlawful and is therefore seeking compensation.

Additionally, the former Minister is seeking a court injunction to prevent the OSP from reissuing the declaration, which he claims is baseless and unjustified.

The Special Prosecutor, Kissi Agyebeng at a press conference on February 12 declared Mr. Ofori-Atta wanted and a fugitive as a suspect in four high-profile corruption investigations.

Although the OSP on February 18, removed Mr. Ofori-Atta from the wanted list, he has in his suit, Ofori-Atta stated that the actions have caused significant damage to his reputation and personal life.

According to the OSP, these included investigations into several financial transactions, including the Strategic Mobilization-GRA contract, the termination of the ECG-BXC contract, payments related to the National Cathedral, ambulance procurement, and the utilisation of the Tax Refund Account.

However, he has denied any wrongdoing and defending his tenure at the Finance Ministry, Ofori-Atta insisted that he had always acted in the best interests of Ghana.

In an open letter dated February 26, he stated that throughout his 40-year career, he had upheld integrity and transparency.

Meanwhile, the former minister, who is seeking an early resolution to the matter, maintains that he was neither the originating nor implementing minister in the cases under investigation.

An attempt by the Editor-in-Chief of the Daily Searchlight Newspaper, Kenneth Kwabena Agyei Kuranchie, to have his liberty to restore a suit challenging the constitutionality of the Office of Special Prosecutor (OSP) has failed.

 

This was after a nine-member Supreme Court review panel, chaired by Chief Justice Gertrude Sackey Torkornoo, said his application did not meet the threshold for the Court to review its earlier directive.

Mr. Kuranchie wants the Supreme Court to declare the OSP as unconstitutional, but withdrew the application in July, this year, which was nine months after he filed the writ without a statement of case as required by the rules.

The Apex Court then struck it out as withdrawn, adding that, the Plaintiff had no liberty to apply.

“Writ is struck out without liberty to reapply,” the original Supreme Court panel of seven directed.

Dissatisfied with the decision of the apex court on July 17, the Plaintiff filed an application for the Supreme Court to review its earlier directive for him not to reapply.

In Court on Wednesday, December 11, 2024, while moving his motion for review, the Applicant said, the directive “without liberty to reapply” is unconstitutional.

He also argued that an exceptional circumstance that leads to miscarriage of justice has occurred with that decision and same should be reversed.

Mercy Konadu Mari, a Senior State Attorney from the Office of the Attorney General, relied heavily on all the processes filed.

While, Adelaide Kobiri-Woode, a Principal Prosecutor for the Office of the Special Prosecutor said the process is an abuse of process and same should be dismissed.

The nine-member panel presided over by Chief Justice, Gertrude Sackey Torkornoo said after listening to the applicant in person and the AG and the OSP, the request did not meet the threshold for the apex court to review its earlier decision.

The application seeking a review was subsequently dismissed with the Court deferring its full reasons to December 20.

Other members of the Review panel are – Justice Gabriel Pwamang, Justice Amadu Omoro Tanku, Justice Prof. Mesna-Bonsu, Justice Emmanuel Yonni Kulendi, Justice Barbara Ackah-Yensu, Justice Ernest Gaewu, Justice Yaw Darko Asare and Justice Henry Anthony Kwofie.

Background

He was seeking the Supreme Court to declare the Special Prosecutor Act, 2017 (ACT 957) as contrary to “Articles 11, 17. (1)(2) and (3), 88. (3) and (4), 289.(2) 290. (1) (f)) and 290. (2) to (4), 12. (2) and 107 (b) of the 1992 Constitution.”

The Special Prosecutor Act is an act to establish the OSP as a specialized agency to investigate specific cases of alleged or suspected corruption and corruption-related offenses involving public officers and politically exposed persons in the performance of their functions as well as persons in the private sector involved in the commission of alleged or suspected corruption and corruption-related offenses, prosecute these offenses on the authority of the Attorney-General and provide for related matters.

Article 88 for instance states that “(1) There shall be an Attorney-General of Ghana who shall be a Minister of State and the Principal legal adviser to the government.

The Attorney-General shall discharge such other duties of a legal nature as may be referred or assigned to him by the president or imposed on him by this constitution or any other law.

The Attorney-General shall be responsible for the initiation of all prosecutions of criminal offences.”

Mr Kuranchie wants the Supreme Court to annul the law establishing the OSP.
