This follows Dr Dominic Kwame Obeng-Andoh’s arrest on January 29 for working as a body sculpting specialist without a licence.

The body shaping hospital was subsequently closed down once again by the Health Facilities Regulatory Authority (HeFRA).

Public Relations Officer of Accra Regional Police Command, Superintendent Effia Tenge, noted that Dr Obengfo was granted bail after the police service received a statement from HeFRA Thursday, February 4, 2021.

Meanwhile, the docket of the case has been forwarded to the Attorney General’s Department for advice, Supt. Tenge stated.

It would be recalled that Dr Obengfo has been arrested for the same reason over the years.

Five years ago, the Medical and Dental Council (MDC) received complaints of medical complications from some persons who had patronised the facility, hence, its shutdown.

In 2019, the MDC warned Ghanaians who patronise Dr Obengfo’s services to desist from it, stressing that, they go to the facility at their own risk.

The Court discharged Dr Obengfo who was standing trial for operating a health facility without a licence and practising medicine without lawful authority but the Police on Monday re-filed at the Circuit Court Registry.

The Police said it would secure the summons for Dr Obeng-Andoh aka Obengfo to be served to appear again before the court.

He is expected to appear before a different circuit court by next week, a source said.

On January 23, this year, the court presided over by Mrs Priscilla Dapaah Mireku discharged Obengfo on the basis of “want of prosecution.”

In her ruling cited by the Ghana News Agency, the trial judge said the prosecution had earlier been ordered by the court to comply with the rules on disclosures and serve Dr Obengfo or his counsel.

According to the court, at its last sitting, the prosecution promised to serve accused at the next sitting but failed to do so.

“The court indicated that if they failed to serve them by January 7, 2019, the accused person will be discharged.

“Today is January 23, 2019, and the prosecution has still not complied with the orders of this honourable and prays for more time,” the court stated.

According to the court, per Article 19 of the 1992 Constitution, “an accused person is presumed to be innocent until proven otherwise or the accused person has pleaded guilty.”

The court said if the prosecution were not ready to prosecute the case, “the accused person should not be made to suffer their actions,” hence discharged Obengfo and struck out the case for want of prosecution.

“The prosecution can go for the accused persons when they are ready to prosecute the matter,” the court added.

Obengfo’s discharge followed defence counsel Nana Kofi Bekoe, who held the brief of Dr Emmanuel Maurice Ankrah, had prayed the court to discharge Obengfo as the matter had been adjourned for three consecutive times as a result of “same reasons.”

Defence counsel prayed the court to take cognisance of the fact that the complainant in the matter had been absent anytime the matter was called.

On January 23, this year, Inspector Princess Tetteh who held brief of Deputy Superintendent of Police (DSP) Mawenyo Nanegbe told the court that her instructions were that the police were preparing documents to serve Obengfo and prayed for a short date.

Obengfo’s arraignment was after the Attorney General Department had advised that the two charges be maintained by the Police for the trial to proceed.

The Ghana Medical and Dental Council in Accra in July 2015 during their routine monitoring exercise received information that accused had failed to renew his annual licence for registration to practice as a medical doctor and to operate a private facility since 2013 but still practised in his hospital.

The Ghana Medical and Dental Council, therefore, reported the matter to the Police and on December 28, 2016, the Police went to the accused’s hospital to arrest him.

The Police, however, met him in the process of performing a certain medical procedure on a witness in the case.

The police after questioning Dr Obeng-Andoh charged him to appear before the court on February 6, 2017.

The accused however petitioned the Criminal Investigations Department and the court process was temporarily halted. The case docket was forwarded to the Attorney General’s Department for advice.

The Attorney General Department on May 8, 2018, advised that all charges preferred against Dr Obeng-Andoh be maintained.

Meanwhile, Obengfo is standing in another trial for murder following the death of Stacy Offie Darko, former Deputy Chief Executive Officer of National Entrepreneurship Innovation Programme who visited his medical facility at Weija, Accra.

He is standing at a District Court in Accra together with his cleaner, Edward Amponsah who is being held for impersonation.

Mr Jonathan Dzaisu, who held brief for Dr Maurice Ankrah, noted that, the police kept saying that the case docket of his client was being worked on and based on that the matter should be adjourned.

According to Mr Dzaisu, the state was swift and effective in arresting but when it came to advise on cases, the Police say the case dockets are being worked on, but all the they would continue to be patient when dealing with the state.

Mr Dzaisu’s made the assertion after the Detective, Chief Inspector Simon Apiorsornu, had told the District Court presided over by Ms Efua A. Sackey that the Office of the Attorney General was almost ready to deliver its advice.

Detective Chief Inspector Apiorsornu was optimistic that the said advice would be ready by the next court sitting.

The matter was therefore adjourned to November 8. The month long adjournment was due to the fact that Obengfo and his accomplice Edward K. Amponsah, a hospital Cleaner, are on bail.

Amponsah is being held for impersonation while Dr Obengfo is being held on a charge of murder.

Obengfo is being held for the death of Ms Stacy Ofei Darko, a deputy Chief Executive Officer of the National Entrepreneurship Innovative Programme (NEIP), who visited his facility.

On May 20, this year, Stacy 37, is said to have gone to Dr. Obengfo’s Hospital for Liposuction and fat transfer surgery but she died the following day at about 1600 hours.

On May 22, this year, based on the alleged order of Dr Obengfo, Amponsah sent the body to three different mortuary facilities but the body was rejected because there was no relative of the deceased present.

Subsequently, the body was sent to the Saint Gregory Hospital Mortuary at Buduburam, where Amponsah allegedly presented himself as the biological brother of the deceased.

The body was then stored at the Morgue without the knowledge of the deceased relations.

On May 24, this year, relatives of the deceased got wind of it and reported the matter to the Police, who proceeded to the morgue and inspected the body.

When the Police inspected the corpse, it allegedly found multiple surgery fresh scars on some parts of her body. Later the body was transferred to the Korle-Bu Teaching Hospital for autopsy and the accused persons were later picked up by the police. Stacy has since been buried.

The Council had said that Dr Obeng Andoh was operating illegally at the time Deputy Chief Executive Officer of the National Entrepreneurship Innovation Programme (NEIP), Stacy Offei Darko, died at his facility.

But Dr Obeng Andoh said he was put on the permanent register of practitioners by the Medical and Dental Council in 2000 after completing his house job and therefore could not have operated illegally.

Speaking exclusively on Asempa FM’s Ekosii Sen Thursday, he said he was accused by the Ghana Medical and Dental Council of operating illegally following a billboard advertisement he carried on hernia.

My license has never been revoked by the Ghana Medical and Dental Council and so they should stop saying that my license has been revoked. I did adverts on hernia and posted them on billboards and as soon as they saw it, they raised concerns because they claim people were having complications so they suspended my operations in 2011,” he said.

He said he wasn’t given a fair hearing and therefore was forced to appeal his suspension when the matter was taken to court and the suspension was put on hold.

“I appealed with the help of my lawyers and the court put the matter on hold. The high court could not rule and the case is still pending so why will they say that my license, which they gave me, has been revoked,” he quizzed.

He said though the case is still in court, he pays his dues to the council every year to ensure that his license is renewed, adding that the payment of the retention fees puts him in good standing.

Appearing before an Accra Circuit Court today, Mr Kofi Bekoe who held brief of Dr Morrison Ankrah, counsel for Obengfo, informed the court that his client was not well and prayed that his client would be made to sit when the matter was called.

The trial judge, Mrs Jane Harriet Akweley Quaye declined and adjourned the matter to August 29.

But Dr Obengfo who appeared under Police guard at the Circuit Court seems not to have executed his bail bond granted him by an Accra High Court in respect of the murder charge.

The Ghana News Agency observed this when after matter was adjourned plain clothes Policemen escorted him out of the court.

Journalists were informed that Dr Obengfo was working on the execution of the bail terms.

Dr Obeng-Andoh aka Dr Obengfo is being held for allegedly murdering Ms Stacy Offei Darko, Deputy Chief Executive Officer of National Entrepreneurship Innovative Programme (NEIP) who had visited the facility.

The High Court presided over by Mr Justice Kofi Dorgu admitted Dr Obengfo to bail in the sum of GH¢100,000 cedis with one surety to be justified.

The Circuit Court has also admitted Dr Obengfo to GH¢50,000 cedis bail.

A High Court in Accra was unable to hear the bail application of the CEO of Advanced Body Sculpt Centre, Dr. Dominic Obeng-Andoh, who is standing trial for murder.

Despite being granted bail by a Circuit court last week on a separate charge, Dr. Obeng-Andoh still remains in the custody of the police, as his lawyers are yet to secure bail in the murder case.

The other case for which bail was secured, has to do with the charges of operating an unlicensed medical facility and practising medicine without a license.

He has pleaded not guilty to the two charges but is before another court over the death of Ms Stacy Offei Darko, a Deputy Chief Executive Officer of the National Entrepreneurship Innovation Plan (NEIP).

Stacy Offei Darko died last month after admitting herself into the Obengfo Hospital, complaining of a headache.

According to the family, the body of the deceased was deposited at the morgue within four hours after her death without any attempt to inform them.

This development infuriated the family and friends of the deceased leading to the arrest of Dr Obeng Andoh.

The suspect’s lawyers had expected to formally make the bail application before an Accra High Court on Thursday, but the court declined to hear it as the Judge noticed the Office of the Attorney-General had only been notified of the bail hearing this morning.

The lawyers maintain Dr. Obeng-Andoh is unwell and must be granted bail.

Justice Justin Kofi Dorgu, therefore, adjourned hearing to July 21 for the application to be argued.

Last week, a visibly unwell Obeng-Addo had to be aided by three persons including a physician, to walk as he made his way out of the courtroom.

The case has been adjourned to July 6, 2018.
