The Accra High Court has dismissed Lilwin’s application to suspend proceedings, ruling that the case will proceed in Accra.

The actor had requested a stay of proceedings pending a Court of Appeal decision on whether the case should be transferred from Accra to Kumasi, where he resides. However, the High Court rejected the request and slapped him with a GH¢5,000 cost.

The defamation suit, filed on February 14, 2024, arises from a viral video in which Lilwin allegedly launched a personal attack on Martha Ankomah.

In the video, Lilwin accused the actress of “looking down on Kumawood actors” and refusing to work with them, allegedly due to what she viewed as “poor storylines.” He also cast doubt on her success, suggesting it was due to her connections rather than talent.

In response, Martha Ankomah filed a defamation suit, citing reputational damage.

Reacting to the lawsuit, Lilwin appeared to mock the legal process by posting a video of NDC Chairman Johnson Asiedu Nketia’s infamous quote, “Every idiot can go to court,” suggesting that being sued did not equate to guilt.

Contrary to reports suggesting that she had agreed on a reduced settlement from her initial GHC1 million demand to GHC300,000, Martha stated that no monetary agreement has been made.

“I don’t intend to take a dime from LilWin. Maybe the only money involved will be to cover my legal fees. I want to teach people that it is not okay to say certain things about others, especially people they have never met before,” she stated.

She further noted that while LilWin had previously issued an apology, it was insincere and did not include a retraction of the defamatory statements he made against her.

“He had apologized before, but it was a backhanded apology. Everyone who watched the video can attest to that. He didn’t retract his defamatory statement, so it was rejected. He has to do it again,” she insisted.

The case is set to return to court in April, where LilWin is expected to present a proper apology.

Martha assured the public that whatever decision the judge makes will be made known.

She also shared a message of forgiveness, stating, “I am not perfect. I pray for forgiveness, and I will also forgive. I have said so many times that I want him to do the right thing, apologize, and I will forgive him and let it go.”

She further urged public figures to be mindful of their words and understand the consequences of defaming others.

Terms of the agreement were struck on Tuesday, February 25, after an initial breakdown in negotiations was announced in open court.

Following the agreement, the parties are to file the terms of settlement and appear in court on April 1, 2025, for it to be adopted as a consent judgment by the court presided over by Justice Forson Baah Agyepong.

On Tuesday, February 25, 2025, an initial proposal from Lilwin and his representative to pay GH₵150,000, which includes GH₵50,000 legal fees, was flatly rejected as lawyers of the plaintiff (Martha Ankomah) described it as an “eyesore.”

“We have been chasing the defendant for settlement,” counsel said. “My learned friend (counsel for Lilwin) is here, and I have called her several times just to get something to work with,” but to no avail.

Eyesore Proposal

Counsel said it was only last Saturday that counsel for the defendant (Lilwin) called “to propose something….and what they proposed was an eyesore.”

Nii Applatu Plange, counsel for the plaintiff, said, “In our view, it is not something that we will want to proceed further with, so we are back for the court to proceed with the case,” he said as negotiations for settlement broke down.

Reasonable Proposal

Counsel for the defendant said what counsel for the plaintiff told the court was largely true but stressed that what her client (Lilwin) had proposed was “reasonable.”

She was, however, “surprised to hear (from counsel of the plaintiff that it) is an eyesore.”

In the circumstances, she said, “We are in their (plaintiff’s) hands and the court.”

To clarify matters to the court, counsel for the plaintiff said, “At the last sitting, we (plaintiff and her counsel) came down (from GH₵5m to GH₵2m) significantly, and when my learned friend called, she proposed legal fees and GH₵100,000 for Martha to forgo it.”

This, counsel for the plaintiff said, was unacceptable and formed the basis of his description as an “eyesore.”

We Can’t Afford Martha’s Pedigree

Counsel for Lilwin (defendant) told the court that “We proposed that Martha should receive GH₵100,000 and legal fees of GH₵50,000 (totaling GH₵150,000).”

She explained that, “We are approaching Easter, and I know that the matter is not anything that we can quantify in terms of the injury caused to the plaintiff (Martha Ankomah).”

“We are doing this on the background that we are Christians. …We cannot pay Martha Ankomah for her pedigree,” counsel for Lilwin said as she mitigated for the damages.

Counsel for the defendant intimated that “We are proposing a whopping 1.5 billion (in old currency),” which, for them, is reasonable.

But counsel for the plaintiff also raised concerns about how the new apology that was to replace the rejected one was treated.

Justice Forson Baah Agyepong, the presiding judge who appeared to have had enough of the parties after his previously wise counsel for them to agree on settlement in his chambers, said, “I won’t talk again; I have advised both parties enough.”

GH₵200,000 New Proposal

When it appeared in open court that the plaintiff and her lawyers did not accept the initial GH₵150,000 proposal and wanted the case to proceed in court, Lilwin (defendant), through one of his managers, whispered into counsel’s ear.

Counsel then informed the court that her client had whispered into her ear that he would round the figure up to GH₵200,000, including legal fees.

That triggered a back-and-forth exchange in open court, resulting in the parties approaching the bench. They later agreed to have more discussions in chambers to resolve the matter, but this time without the judge.

After nearly two hours, the parties returned from chambers to inform the judge that they had agreed on terms of settlement.

After consulting their diaries, the parties informed Justice Baah Agyepong that they would be back in court on April 1, 2025, for the terms of the settlement to be adopted by the court as a consent judgment.

It is not immediately clear the final sum in general damages that was agreed on, but the settlement will include a new retraction and proper public apology.

Meanwhile, the High Court in Accra has adjourned the case to February 25, 2025, for the parties to announce the terms of settlement.

The case on Friday, December 13, 2024, was held In-camera (case heard in chambers) and lasted for nearly 3hrs with both parties and their lawyers streamlining how to settle the matter amicably.

Both Martha Ankomah, the Plaintiff, and Lil Win, the Defendant were present in Court together with their respective lawyers.

On February 14, this year, Actress Martha Ankomah initiated a defamation action against popular Kumawood actor, Kwadwo Nkansah over alleged disparaging comments about her.

Nkansah, popularly known as Lil Win, was heard in a viral video, allegedly insulting the actress for comments she is alleged to have made.

But, an incensed Lil Win in the video was heard downplaying Martha’s prominence in the film industry.

In a suit filed at the High Court in Accra on February 14, Martha Ankomah is demanding damages among others in the sum of GH¢5 million.

Ankomah, the Plaintiff in the action is also seeking an apology and a retraction of the said defamatory words with the same prominence.

“Damages in the sum of GH¢5 million for the defamatory statements made by Defendant. Compensatory damages for the damage done to the reputation of Plaintiff.

“Aggravated damages for the reckless and malicious publication of the defamatory words. An order directing Defendant to publish an apology and a retraction of the said defamatory words with the same prominence,” the Plaintiff seeks from the Court.

Lil Win and his lawyers have since entered an appearance while the parties are considering an out-court settlement.

He admitted fault and asked for leniency,noting his status as a first-time offender and expressing a sincere desire to make amends.

He also pledged to avoid defamatory statements in the future and expressed hope of working with her on upcoming projects.

Initially, the case seemed set for court proceedings, with Martha Ankomah demanding GHS 5 million in damages for the harm done to her reputation.

Despite agreeing to an out-of-court settlement, Lil Win failed to appear in court for the proceedings, further complicating the case.

Nevertheless, he has now openly appealed for a resolution outside the courtroom.

As a result, the lawyers for the plaintiff, Martha Ankomah, have informed the court that the matter should proceed in court.

Earlier in July this year, the High Court was informed of the possibility of a settlement, which led to an adjournment. However, that attempt has now failed.

Lilwin, has been taken to court by the actress over alleged disparaging comments made about her in public.

In court on Tuesday, October 15, 2024, the first session of the 2024-2025 legal year, Justice Forson Agyapong Baah was informed by the lawyers of the actress, led by Nii Apatu Plange, that the defendant (Lilwin) was not ready for settlement.

“We made our proposals to the intermediary, but he later informed us that it did not seem the defendant was ready for settlement, so I will say that settlement could not be achieved,” the counsel for the plaintiff informed the court.

“We pray the matter proceeds,” Nii Apatu Plange urged the court.

Justice Baah, after hearing from the counsel of the plaintiff, adjourned the case to November 5, 2024, for hearing.

“In the circumstances, the case is adjourned to 5th November 2024, for hearing to begin at 8:30 a.m. Let hearing notices, along with today’s notes, be issued and served on the defendant,” the court directed.

Lilwin was absent from court again, and there was also no legal representation for him.

The plaintiff, Martha Ankomah, was however present.

Lilwin, is seen in a viral video insulting the actress for her alleged comments. In the video, Lilwin downplayed Martha’s prominence in the film industry.

In a writ of summons filed on February 14, 2024, Martha Ankomah claims that the statements made by Lilwin have harmed her reputation and the brand GTP.

Martha Ankomah insists that Lilwin falsely accused her of expressing disdain towards Kumawood actors by refusing to collaborate with them due to their perceived lack of quality storylines. She argues in the writ that Lilwin’s published words were defamatory.

She is therefore demanding:

a) Damages in the sum of GH¢5 million for the defamatory statements made by the defendant.

b) Compensatory damages for the damage done to the reputation of the plaintiff.

c) Aggravated damages for the reckless and malicious publication of the defamatory words.

d) An order directing the defendant to publish an apology and a retraction of the said defamatory words with the same prominence.

e) An injunction restraining the defendant from further publishing or causing to be published similar words defamatory of the plaintiff.

f) Legal costs.

“Who knows you? If not for GTP and senior government officials who signed you on at GTP, who would have signed you. What kind of star are you? Even your own daughter doesn’t know you.”

I don’t even know why GTP bypassed the likes of McBrown, Mercy Asiedu and co and made Martha Ankomah their brand ambassador.

“If you had been a male actor, you would have suffered. When you become an actress and you become a star, men take care of you, men rent accommodation for you, men buy you houses, men buy cars for you. You would have suffered as a man but for the fact that you are female. It is men who look after you. You have become a star that is why men take care of your needs, you don’t use your money on anything.”

Martha Ankomah indicated in the writ that she is “a distinguished actress who has featured in a number of movie productions both in Ghana and Nigeria for more than 20 years.

“The Plaintiff has, by dint of hard work as an actress, gained respectability amongst members of the movie and creative industry, movie lovers, friends, and well-wishers.

“The Plaintiff used to be a brand ambassador for GTP promoting their products but currently holds ambassadorial deals with Yaba Ghana, Vibrant Skin Care, and Style In Vogue.

“The Defendant is an actor, musician, and comedian. The Defendant is also the founder and director of a school known as Great Minds School.

“The Plaintiff says that on or about the 8th of February 2024, Defendant without any provocation from Plaintiff went on a tirade on social media, raining insults and invectives on Plaintiff for allegedly consistently turning down offers from movie directors to feature in twi local movie productions popularly referred to as ‘Kumawood.’”

“The Plaintiff says that the Defendant according to the video circulating all over social media was enraged by the fact that, a director by the name of Frank Fifi Gharbin had informed him that, Plaintiff had turned down an offer to feature in a Kumawood movie on the basis that most Kumawood movies’ storyline does not make sense.

“The Plaintiff vehemently denies this claim and says that she has never had any such conversation with the said director or said anything to that effect to warrant the verbal attack on her.”v

Lil Win further criticized Martha for her role as a GTP Ambassador, insinuating that she was speaking disparagingly despite her association with the brand.

He said: “Martha, those who are richer than you are rather humble and respect themselves a lot. Do you honestly call yourself a star? Who knows you? What do you have?

“I don’t even know why GTP bypassed the likes of McBrown, Mercy Asiedu and co, and made Martha Ankomah their brand Ambassador. The likes of Van Vicker, Roselyn Ngissah and co, do not do these things. They even work with us. They shoot Kumawood movies. I’m still amazed that you made such statements, were you drunk?”

He continued, “Patience Ozorkwor came to Kumasi to shoot a movie. Aki and Pawpaw, Mr. Ibu and the rest came down to shoot a movie here. But for people like you, who call yourselves refined actors; how many times do these Nigerians come to Ghana to shoot movies? They are the ones who rather send for you guys.”

In response to these allegations, Martha Ankomah filed a writ of summons at the High Court in Accra, seeking redress for the false statements made by Lil Win.

The writ commands Lil Win to appear in court within eight days to respond to the allegations.

The legal action comes as Martha Ankomah vehemently denies the accusations leveled against her, emphasizing her commitment to professionalism and integrity within the Ghanaian film industry.

She said such baseless claims not only tarnish her reputation but also undermine the collaborative spirit necessary for the growth of the entertainment sector.

As the case unfolds, both Martha Ankomah and Lil Win await the legal proceedings to determine the veracity of the statements in question and seek appropriate remedies for any harm caused.
