Speaking on Adom FM’s Dwaso Nsem morning show, Mr. Awuah said the early morning raid carried out by armed operatives believed to be from the National Intelligence Bureau (NIB) was unnecessary.

He asked, “Why couldn’t they wait and invite the man to explain himself? Why the rush to arrest him at dawn like a hardened criminal?”

Mr. Awuah said the video at the center of the issue does not even show everything and insisted that proper investigations should have been conducted first.

“Explaining himself could have cleared the air. The video does not even contain full footage, so this arrest is excessive and uncalled for,” he said.

He revealed that he was in Kumasi when Kumi’s wife called him around 6 a.m. on Friday, screaming that armed men had stormed their house.

“She was shouting and panicking. Later she told me they had arrested him and taken him away.”

LAWYER AWUAH ON ADENTA KUMI ARREST

The Manhyia South MP said he advised Kumi to stay calm after receiving information the previous night that security officials might come for him.

He has since asked Kumi’s lawyers to follow up on the matter.

Kumi’s arrest follows his recent petition to President John Mahama, calling for the dissolution of the committee investigating the removal of the Chief Justice. In his petition, Kumi alleged misconduct involving committee members.

He claimed that on May 15, 2025, after the committee’s inaugural sitting, Justices Pwamang and Adibu-Asiedu, along with Supreme Court Justice Yonni Kulendi, were seen dining at Santoku Restaurant with Thaddeus Sory, counsel for petitioner Daniel Ofori.

Kumi said they were overheard discussing issues related to the petition, and believes the arrest is linked to that petition.

So far, the motive for the operation remains unclear.

This follows the challenge of the election results by the incumbent Member of Parliament, Lariba Zuweira Abudu, who is also the current Gender Minister.

In court, Samson Lardy Anyenini, counsel for the respondent, aimed to establish whether Wuni Yidana, the 1st witness for the petitioner and Secretary of the NPP for Walewale, had been part of the petitioner’s campaign team and had interacted with delegates before, during, and after the elections.

Mr Anyenini further sought to demonstrate that the witness had engaged one of the alleged impersonators who supposedly voted in the primaries, citing specific dates for these alleged interactions.

The witness, however, denied ever engaging with such a person.

Despite this, Counsel for the defense argued that the witness was not being truthful to the court on the key issues he was called to testify about.

He added that, the witness had allegedly threatened the said impersonator to avoid appearing before the court to testify truthfully. The witness remained firm in his denial of any knowledge of the person in question.

Mr Anyenini asserted that the real reason the petitioner was threatening the alleged impersonator was that the petitioner had procured this person to vote, with the witness playing an instrumental role, even though the person was not a legitimate delegate.

At this point, counsel for the respondent revisited a pending issue from the court’s session on 19 August 2024. The issue concerned Exhibit C, a series of letters the witness had allegedly received via WhatsApp.

During the 19 August session, the witness informed the court that he did not have the exhibit readily available but would check and present it at the next sitting.

These purported WhatsApp messages were said to be letters from absentee delegates who claimed that impersonators had voted in their place.

However, the witness failed to produce the WhatsApp messages and letters. Wuni Yidana explained that the phone containing the messages had been given to his daughter, who had formatted it when it developed a fault, resulting in the loss of the information.

The second witness for the petitioner, Tahiru Braimah, then took the box.
He introduced himself as the polling agent for the petitioner during the primaries.
When asked about the assertions made by the Constituency Secretary, Wuni Yidana, regarding his competence, given that he had been elected three times as Secretary, the 2nd witness responded that he could not question Yidana’s competence, acknowledging that he had won three elections and therefore did not doubt his abilities.
The respondent’s lawyer further inquired whether Tahiru Braimah believed that the 1st witness’s competence was reflected in the conduct of the elections.

According to her, the roles of a judge and a lawyer are distinct, and once a person enters one of these professions, they cannot practice the other.

“You cannot be in this country as a lawyer and at the same time, a judge. Because the work of a lawyer is different from a judge. I cannot go and be an advocate, have clients, or represent anyone in court. That is the work of a lawyer.

“And so once I became a judge, I could no longer be a lawyer even though I have legal professional knowledge and background,” she said during her vetting on Tuesday, August 13.

Her remarks were in response to a question posed by National Democratic Congress MP for Bawku Central, Mahama Ayariga, who pointed out that, according to the Constitution, the qualification to be a Supreme Court judge is based on having at least 15 years of standing as a lawyer.

Mr Ayariga noted that the Constitution states that a person must have high moral character, proven integrity, and at least 15 years of standing as a lawyer to be appointed to the Supreme Court.

Thus, he questioned if Justice Essah had passed the 15-year stipulated time frame.

In response, Justice Essah clarified that she interprets the constitutional provision differently from Mr Ayariga and affirmed that she is eligible under this provision to be appointed to the Supreme Court.

“There is only one country called Ghana. Let’s respect the institution, which is the Judicial Service, because we created it” he said at the 42nd anniversary of the tragic abduction and murder of three High Court judges—Fred Poku Sarkodie, Cecilia Koranteng-Addow, and Kwadwo Agyei Agyapong—on June 30, 1982.

The event was organised the Ghana Bar Association in collaboration with the judiciary in Accra.

Speaking at the event, Mr. Okudzeto bemoaned how judges are subjected to vitriolic attacks when people disagree with their judgements.

As a democratic country, the renowned lawyer said the right thing for aggrieved parties to do is appeal the decision and not insult the judge.

“What do you achieve when you insult the judges? If you disagree with a judge, appeal the decision. Allow the judges to do their work,” Mr. Okudzeto stressed.

Thaddeus Sory argued that, no proper foundation has been laid for the evidence to be tendered into evidence, contending that the WhatsApp chat as presented by the prosecution is not complete.

He is therefore asking the court to compare the AG’s phone records and Jakpa’s phone records to verify the authenticity of what prosecution is trying to tender into evidence.

Mr. Sory argues that some chats on Richard Jakpa’s phone does not appear on what AG seek to present and so it does not give a full picture of the conversation between the AG and Richard Jakpa.

However, Justice Afia Serwah Asare-Botwe in her ruling asserted that the court has already admitted the WhatsApp chat of the 3rd accused.

She stressed that since prosecution is submitting the chat as the complete interaction between himself and Jakpa, the evidence will be admitted as exhibit BE.

Background

During proceedings on Tuesday, June 18, the Director of Public Prosecutions (DPP) Yvonne Atakora Obuobisa, highlighted the substantial number of messages sent by Mr Jakpa compared to the limited responses from the Attorney-General.

The DPP sought to introduce all WhatsApp messages sent by Mr Jakpa into evidence.

Mr Jakpa acknowledged introducing himself to the Attorney General before the trial and obtaining the Justice Minister’s contact information through his cousin, Supreme Court Judge, Justice Yonny Kulendi.

Under cross-examination, Mr Jakpa admitted that the messages presented in court did not encompass the entire conversation but were selected based on relevance to his case.

The attempt by the DPP to submit the WhatsApp conversation faced objections from Mr Sory, counsel for Mr Jakpa, who argued that the defence required additional time to thoroughly review the messages.

Justice Afia Serwah Asare-Botwe then sought Dr Bamba (counsel for the first accused)’s input, regarding objections to the submission.

Dr Bamba objected, citing the lack of colour printing in the document, surprising the judge as the printout provided by Mr Jakpa also lacked colour.

Following these objections, the court instructed the DPP to defer the submission of the messages until the defence had adequate time to examine them, scheduling this review for today’s session.

According to him, the creation of the office was not just to fulfil a campaign promise.

Speaking on JoyNews’ AM Show on Friday, he warned against actions that could undermine the purpose for creating the OSP .

“If we are treating this office, for lack of a better word, like “chaskele”, then everybody can throw shades by virtue of the personality occupying it. We will then be undermining the institution that we created to fight our biggest problem as a country,” he explained.

This comment comes after a petition seeking the removal of Kissi Agyabeng as Special Prosecutor was forwarded by President Akufo-Addo to the Chief Justice.

Mr. Amidu alleged procurement breaches in the purchase of vehicles for the Office of the Special Prosecutor (OSP) and abuses involving judges and the administration of justice.

Other allegations include violations of citizens’ rights through arrests and detentions, violations of the right to information, and improper appointments of personnel to the office.

But according to the lawyer, the biggest problem plaguing the country is corruption; a menace the OSP seeks to fight.

Mr. Banson stated that, if corruption is curbed, it will improve the country’s financial situation and eliminate the need for loans from the International Monetary Fund (IMF).

“If one of the most independent institutions that we have established in line with the international obligations and by virtue of our own statutory prohibitions, we keep addressing the personality of those institutions and not the institution itself, then [that means], whoever takes that office, we will look at that person in a certain way.

“Because it is as if, if somebody is there, and we don’t like what the person is doing, then we want to remove the person,“ he said.

Mr. Banson said all efforts to clamp down on corruption will be futile should the incumbent Special Prosecutor be kicked out of office due to his modus operandi.

“We should be very mindful of some of our actions and I am very confident in the capacity and the ability of the Chief Justice.

“I have not seen the evidence. I hope there is a prima facie case, but if it is the mere epistles, then I do not see how a prima facie case would be established from there,” he said.

No stolen booty found in Opuni’s house after ‘excavation’ – Lawyer https://www.adomonline.com/no-stolen-booty-found-in-opunis-house-after-excavation-lawyer/ Sat, 24 Feb 2024 10:15:17 +0000 https://www.adomonline.com/?p=2360885 The extensive searches including a reported excavation for alleged stolen booty conducted in the house of the former boss of the Ghana Cocoa Board (COCOBOD), Stephen Kwabena Opuni, became a topical issue in his trial at the Accra High Court last Wednesday.

During cross-examination, counsel for Dr Opuni, Samuel Codjoe, inquired from a witness whether the numerous searches of his client’s official residence in Accra and family house in Dorma Ahemkro led to the discovery of any stolen item.

The witness, Paul Agyei Gyang, a Senior Operational staff at the Economic and Organised Crime Office (EOCO), admitted that nothing was found after the searches, but refuted counsel’s claims that investigators excavated Mr Opuni’s house in search of stolen booty.

Not guilty

Dr Opuni and Seidu Agongo, the CEO of Agricult Ghana Limited, an agrochemical company, were dragged to court in March 2018.

State prosecutors have accused the two of causing financial loss of more than GH¢271 million to the state in a series of Lithovit Foliar fertiliser transactions.

It is the case of the prosecution that the fertiliser was substandard and has accused Agongo of allegedly using fraudulent means to sell the fertiliser to COCOBOD for onward distribution to cocoa farmers.

It has further accused Dr Opuni of using his position as the CEO of COCOBOD (November 2013 to January 2017) to facilitate the alleged acts of Agongo by allowing the Lithovit fertiliser not to be tested and certified as required by law.

Dr Opuni and Agongo have pleaded not guilty to 24 counts ranging from wilfully causing financial loss to the state, defrauding by false pretence, contravention of procurement laws, corruption of a public officer and manufacturing fertiliser without registration.

The two are on self-recognisance bail in the sum of GH¢300,000 each.

Searches

Mr Gyang is testifying as a defence witness for Agongo after being subpoenaed by the court following a request by lawyers for the businessman.

During the cross-examination, Mr Codjoe sought to establish that the searches conducted at his client’s premises during the investigations in 2017 were so extensive to the extent that the room of Dr Opuni’s deceased mother was searched without any regard to tradition.

According to counsel, during the searches, his client was not given access to his phone, neither was he given prior notice of the searches or were his lawyers allowed to accompany him on the searches.

However, the witness countered that the investigative team sought the consent of Dr Opuni before conducting the said searches, and that the former cocoa boss was with his lawyer all the time.

Mr Gyang also informed the court that it would have been against best practices in investigations to give Dr Opuni prior notice before conducting a search in his residence and family house.

Below are excerpts of what ensued between the witness and counsel.

Mr Codjoe: When the investigative team conducted these searches, nothing was found which were connected to the allegations under investigations. Is that not so?

Mr Gyang: Yes, nothing was found on the premises connected to the allegations under investigations.

Mr Codjoe: Before the search, you did not give him prior notice of this search but he was informed on the day of the searches when he was in the company of his lawyers at EOCO.

Mr Gyang: I would not be surprised. Because as part of the best practices in investigations, it was only proper that he was told on the very day in the presence of his lawyer.

Hearing continues at the court, presided over by Justice Aboagye Tandoh.

At the peak of his performance, when the euphoria was high in the auditorium, Sarkodie paused and narrated the story of his relationship with the deceased and her impact on his successful career.

In a very emotional state and not able to hold back tears, Sarkodie shed tears recounting the good moments with Cynthia Quarcoo.

“I am sad today because I know how this woman has helped my career. When no one believed in me, she did and she approved almost all the songs before it goes out there. She is more than a family, I am really going to miss her.

“This year has not been too good for me but life goes on. Once you are here to have fun, I just have to entertain you because you have also been a great impact in my career,” he said with patrons cheering him up.                          

The 11th edition of Rapperholic concert dubbed Rapperholic Rebirth was a blend of hard core rap, singing, choreography, acrobatics and that made this edition awesome.

 Sarkodie performed almost all his hit songs that his fans called for. Talk of Original, Baby, Pizza and Burga, Oran, Borga Borga, Megye wo Girl, Rollies and Cigars, among others put revelers in the right mood. 

The crowd energy was high and that was a good booster for the two time VGMA Artiste of the Year to engage them regularly, creating a beautiful bond when he performed back to back for more than two hours on stage.

Apart from Sarkodie, a number of artistes such as Efya, Tulenkey, Mr Drew, Quamina MP, Olivetheboy, Kofi Moley, Maya Blue, Prince Bright of Buk Bak, Bongo Blay, Oseikrom Sikani, Papi Kojo equally dished out pleasurable fun with their performances.

Just like it happened at previous Rapperholic concerts, the auditorium was over packed this year too, creating lots of discomfort for patrons.

Nhyiraba Kojo, a popular Hip Life musician and owner of the NK City Nightclub at Fijai in Takoradi, has been sentenced to 30 days imprisonment by a Sekondi Commercial High Court.

He was jailed on the grounds of a contempt in a case filed by four residents of Fijai over noise from his nightclub, situated in the same area.

Speaking in an interview with Nhyiraba Paa Kwesi Simpson, the host of Connect FM’s Omanbapa morning show, lawyer Philip Fiifi Buckman indicated that Nhyiraba Kojo complied with the initial directive of the court, asking him to reduce the noise levels of his nightclub but attempts to retrieve the needed document to serve as evidence was not successful.

“As the case was being heard, the residents brought an injunction asking the court to stop Nhyiraba Kojo from operating his nightclub, but we opposed it,” he said.

“They later agreed that the noise should be reduced within 30 days. The court also informed us to present a report indicating the noise has been reduced.

“We have worked on reducing the noise level and people can even see that most of his speakers have been removed. We were working on the official report to be presented to the court, but there were challenges in obtaining it from the Assembly. So we could not send it to the court within the 30 days given. That is why the court decided to punish him,” Mr Buckman indicated.

According to him, the court has promised to release Nhyiraba Kojo anytime the report is presented.

He adds that they are working to retrieve the report from the assembly by Tuesday.

“But the good news is that, the court is ready to release him anytime we present the report. We are busily working on it and believe it will be ready by Tuesday, and he will be released from jail. But I must tell you that Nhyiraba Kojo is not bothered because he is not in jail due to robbery or anything bad. We believe he will soon return,” he indicated.

According to the Police situational report, Richard was traveling from Accra to Jirapa with three relations in a Hyundai Accent saloon car with registration number GN 9890-17 when they were attacked.

Upon reaching a section of the road between the Banda Nkwanta and Nuoyiri communities on the Bole-Bamboi highway, three armed men emerged from a nearby bush and signaled them to stop.

Whiles slowing the vehicle down, one of the armed men immediately shot at Richard who was driving.

The vehicle as a result veered off the main road into the offside of the bush, hit a tree and came to a halt.

The armed men followed suit and tried to open the doors of the vehicle to have entry into the same but the family’s bulldog barked at them and they bolted.

The surviving men and women went to the Police Station to report the robbery attack. Police moved to the scene, and combed the area but are yet to arrest the suspected armed men.

The deceased, Richard Badombia was behind the steering wheel with pellet wounds spread over his left cheek.

The body was removed and has been deposited at the Wenchi Methodist Hospital for preservation awaiting autopsy.

In an interview on Hitz 1039 FM’s Daybreak Hitz show, Mr George said he was a co-pundit on a show with the leading member of the ruling New Patriotic Party in 2010.

He explained that, during the show, he quoted the constitution to buttress his point but Gabby attacked his intelligence, saying Mr George had no degree in law.

According to Mr George he was pained by the statement to the extent that he picked up forms to enroll into a law school the following month.

Mr George said he loved competition and Gabby’s painful words about him motivated him to get his law degree among others he is yet to work on.

In 2010 I was on Good Morning Ghana with Gabby. He said something that really pained me and I am grateful he did. I was quoting the law on the show and I knew what I said was right and sensible but Gabby waited until the last hour to say I am not a lawyer and I do not have a degree so I don’t know the law.

The next month I enrolled in law school and had an LLB from the University of London and as we speak I am almost done with my LLM, I’ve completed my LBC… I like challenges and that is the kind of person I am. It’s the story of grace, he said.

Shatta required the services of his lawyer, Jerry Amenyokpo, after he was arrested and arraigned for causing fear and panic over a shooting hoax.

Throughout his appearance in court from the 21st of October, 2021, Mr Amenyokpo has defended Shatta and was able to facilitate bail for him on his second appearance on October 26.

In a latest development, Mr Amenyokpo made a statement in court on Thursday, demanding the release of Shatta as well as his accomplices’ phones.

He argued that their livelihood depends on the engagements on their phones. Based on this, an Accra Circuit court ordered the police to release their personal belongings to them.

Impressed by the good works of his lawyer, Shatta has asked Ghanaians to join him in thanking his lawyer.

Speaking after the court session, he demanded his fans and sympathisers present to clap for his lawyer, which they did.

Iyoha, a 41-year-old father of four, was kidnapped on May 9, 2020, beaten to death, and buried in a shallow grave around Aduwawa in Benin City.

His decomposing body was exhumed by the police on Tuesday, June 2020. 

The suspects, identified as Solomon Esuike, Onobun Solomon, Enoma Okuonghae, Ambrose Amaohin, fondly called ‘Onyeka’ and  Valentine Dibie, were paraded at the command headquarters on Thursday, September 23.

One of the suspects, Valentine Dibie, alongside four others, Osasu Osadolor Afro, Emmanuel David, Uwadia Taiwo Uhumwagho and Saturday Imagbe were previously arrested in October 2020 for the murder of the lawyer. 

The accused persons were remanded in prison custody awaiting court trial but they escaped during Benin’s October 2020 prison break.

Valentine Dibie was rearrested a few days ago after officers on patrol spotted him at the Benin Bypass while the four others were arrested later.

It was gathered that the late lawyer was drinking at his usual spot, celebrating one of his friends’ birthday in Evbuomodu in Benin when he attempted to settle a dispute peace between Osasu Osadolor, the son of a high Chief Nosakhare Osadolor, and another fellow. 

Angered, Osasu mobilised his friends, numbering over 10 to the scene where they met Iyoha, beat him to stupor before they forcefully took him away in a Lexus Jeep and was not seen for two weeks.

An eyewitness said that after the lawyer was beaten to a pulp with cutlass and wood, he was taken into their vehicle, and carried away in the full glare of everyone still at the Bar.

His friends, who were on the ground, chased after the car with their car, hoping to find out where they were taking him.

However, on their way, the boys brandished their guns at them, scaring them off the road… Unable to trail them any further, they decided to report the matter immediately to the Aduwawa police division.

“After explaining everything to the DPO. He put a call to Osazuwa’s father, who showed up at the station after a while. He confirmed to the DPO that his children, led by one Osazuwa, indeed abducted our friend, but he also told the DPO after placing a call to his son, that Iyoha had been let go since 7:00pm. This was at about 7:30 pm that same day,” the witness narrated.

“On the strength of that, the DPO allowed the father go, and he sent one of his officers to accompany the lawyer’s friends to his house to ascertain if he has come home. When they got to his place, they only met his wife and children at home. They asked his wife about his whereabouts, she was shocked, stating that she thought her husband was still with them (his friends).

“That was the first time that she realised that something was wrong. They waited until the next morning. Still, Iyoha had not shown up at home. Then they went back to the Aduwawa station in the company of his wife.”

Nine days after the incident, the police arrested Osasu Osadolor and other members of his gang including one Valentine Ditaken. 

The gang took the police investigative team and journalists to the shallow grave where they buried the body of the lawyer. His remains were exhumed by pathologists from the Central Hospital Benin City and taken to the same hospital mortuary for autopsy.

In his first open confession to the incident, Valentine narrated to Standard Gazette how the late lawyer was killed. 

“I was at Aduwawa when Osasu Osadolor called me to meet him at Evbomodu that someone is embarrassing him. He then asked us to move the guy away where he ordered everyone to beat him. We used wood and other hard iron to beat him until he fainted,” he narrated. 

“I left and went home. I later saw on television that the man has died. I was among those arrested and was taken to prison. But when I suddenly saw the prison gate opened on 19 October 2020 and I just had to escape. I went to Ghana, and I came back a few months ago. I was the one that took the police to arrest other persons here with me now.”

Another suspect, Solomon Onobun, said: “I was passing by when l saw Osasu beating a man who was already on the floor. I heard him say we should enter him, but l felt so sorry for the late man. I never knew he will die”

Spokesperson of the command, SP Bello Kontongs,who confirmed the latest arrest, assured that those who escaped prison custody will be arrested soon. 

”Our policemen have been looking for those who killed the lawyer. We are happy that some of them have now been arrested. I can assure you that those who escaped from prison custody and are still at large would be arrested soon,” he stated.

Miss Chukwuemeka completed Secondary School at age 13, got admission to the Abia State University but was denied admission on the basis of being underage.


Her father, who felt the decision of the school could quench her quest to seek higher education, sent her to India to continue.

This follows the singer, born Nana Ekua Amoah, allegedly stating that Mrs Amoateng is HIV positive per information she got from popular prophet Nigel Gaisie.

“Mzbel came to the CID headquarters on her own but she was officially arrested,” she said.

That’s a total falsehood, she has not been arrested. She was invited by the police and we went there yesterday. Three lawyers went with her to the police station; nobody arrested her so I don’t know what she means by arrest.

Explaining further, he said: They said they were investigating the matter, so they made her write her statement and after that she was granted bail.

“I felt litigation in Ghana was not attractive and our processes were long,” she said in an interview.

Victor Adawudu, who represents seven of the accused persons, however maintains these guns were to be used to protect members of the group, Take Action Ghana and not meant to overthrow the government.

He told the court, presided over by Justice George Buadi, that members of the group were attacked during an outreach programme in the northern part of Ghana.

A serving soldier, Mr Adawudu, identified only as ‘Sulley’ (not standing trial) advised that guns are procured and registered to protect the group.

Lawyer Adawudu on Monday urged the High Court to grant his clients bail. He insisted they were not engaged in any plot to overthrow the government but have simply been arrested because some of them are classmates from school days and others are childhood friends.

He insisted nothing had been put forward by the State to show that they were engaged in any such plot.

While pledging to ensure his clients show up in court to stand trial he insisted a grant of bail is only fair since the State is not ready to commence the committal process.

Senior State Attorney Hilda Craig opposed the application.

She said the State does not suspect them of plotting but the State knows as a matter of fact that they agreed and plotted to overthrow government.

She maintained that some are serving officers of the armed forces and could interfere with investigations since the State’s witnesses include soldiers. She told the court that the State does not trust that they will show up in court to stand trial if granted bail.

“The activities of these persons do not show that they belong to a non-governmental organisation that needed weapons. Why not contact the police if they had concerns. As far as we are concerned, they had one intention, to overthrow the State. The State has overwhelming evidence and will provide it at the right time,” she said.

The lawyer for a 33-year-old driver, Kofi Ampoma, who was allegedly beaten to death by police at Adomfe in the Ashanti region has expressed disappointment in the way police are handling investigations into his client’s murder.

Lawyer Asamoah Amoako says in spite of the interdiction handed the police officers involved in the alleged murder, he does not see any sense of urgency on the part of the police to unravel the circumstances surrounding the murder.

Speaking in an interview on Adom FM’s morning show Dwaso Nsem, Friday the worried lawyer said he did not understand why the suspected police officers have been allowed to walk free.

“The police who committed the crime have been interdicted but that is not enough. I went to the Regional Command last week to speak to the Commander and the investigator, and can you imagine that they were angry upon seeing me? That is why I suspect they are covering these police officers up,” he said.

Mr Ampoma is alleged to have died from brutalities meted out to him by General Sergeant Suleman Seidu, General Corporal Seth Agbango and General Lance Corporal Sailfu Yakubu during an operation to arrest a woman suspected to be selling ‘weed-laden’ alcohol.

The Ashanti Regional Police Command has since interdicted three of its men from the Konongo Division for their suspected roles in Mr Ampoma’s death.

I was abandoned by my mother at the age of seven months (7months) with my father and stepmother. My stepmother was mean. I endured all manner of maltreatments she meted at me. Sometimes I went hungry for days. She would so starve me that I would be seeing death. On one occasion, I was very hungry that I had to eat our dog’s leftovers food.

Our neighbour’s son caught me eating the dog’s leftover food (eba and egusi) and he told his mother who later that evening invited me to her house and asked me if what her son said was true.

I was so terrified that I begged her not to tell my step mother, because she will kill me if she knew that I ate the dog’s leftover instead of throwing it away. The woman wept and promised to give me food every day without my stepmother’s knowledge, a promise she kept till we left the compound.

As if starving me was not enough punishment, my Stepmother flogged me mercilessly until I would faint at times. She would also apply pepper in my vagina, eyes, armpit and neck, tie me up and abandon me in one of the toilets for days without food. Despite all these experiences.

I was very bright academically and was loved and favored by God and people. I knew that the only way to escape was to achieve educational success, so I never joked with schooling. So you see, I have every right to be hateful, bitter, jealous, arrogant, sad, negative and toxic but I chose not to.

Professor Stephen Kwaku Asare, a United States-based legal practitioner and accounting professor, popularly known on Facebook as Kwaku Azar, has urged Ghanaians, especially security analysts to stop ridiculing weapons used by suspects who attempted coup plot on Ghana’s presidency.

To Professor Asare, the matter is a serious one which needs thorough probe devoid of any politics.

“You don’t need stock of arms to stage a coup. The discussion must go beyond ridiculing weapons to be used by persons arrested,” he said in an interview on Asempa FM’s Ekosi Sen show, Tuesday.

A security analyst, Adam Bonaa, has criticised the government for linking suspects arrested over the weekend to an elaborate plan to overthrow the government.

But, Prof. Asare said it was important that security analysts stop misleading the public about pointers to stage a coup.

“If left for me alone, I would say the government security even makes sense more than these security analysts. They are just misleading us,” he said.

Government, he noted, must work very hard to ensure people have a better life, adding that the worst civilian government is better than the best military government so it is better Ghanaians are careful over this coup attempt.

Speaking on Eyewitness News on Friday he said since it is the state claiming that NAM1 defrauded these people, it is the state that has to demonstrate beyond any reasonable doubt that he took money from these people illegally.

“In criminal practice, Mr. Appiah Mensah doesn’t have to prove anything, it is the state that is making the allegation, so the verdict is on the state to prove its allegation. The allegation is that NAM1 has defrauded 16,000 people, so it is the state’s responsibility to bring the proof.”

“Mr, Appiah Mensah doesn’t have to say anything, he can sit in court the whole time and not say anything. If at the end of the prosecution case, they are not able to prove that he has indeed defrauded 16,000 he will walk free, ” he said.

NAM1 accused of bagging GH¢1.68bn from customers

Nana Appiah Mensah has been accused of defrauding his customers of about GH¢1.68 billion.

NAM1 is on trial for 13 counts of abetment to defraud by false pretence and two counts of abetment to carry out banking business without licence, contrary to Section 6 (1) of the Banks and Specialised Deposit-taking Institutions Act, 2016 (Act 930).

Nana Appiah Mensah arrived in Ghana on July 11, 2019 where he was picked up by security operatives at the Kotoka International Airport and sent to the Criminal Investigations Department (CID) of the Ghana Police Service for interrogation after spending several months in Dubai in another legal battle.

A member of the legal team of Gregory Afoko, one of the two suspects standing trial for the murder of New Patriotic Party (NPP) Upper East Regional Party chairman, Adams Mahama in 2015, has expressed sadness about his client’s continuous incarceration.

According to Nana Yaw Osei, the suspect, after being granted bail in March 2019 and having met all the bail conditions, needs not be in jail.

To him, it is a matter of worry for a court to see nothing wrong with the abuse of his fundamental human right.

“How can a High Court grant bail and another one goes against it? I seriously do not know why he should be kept for four years when he is supposed to be free,” he told Accra based Okay FM, monitored by Adomonline.com.

Lawyer Osei believes the ongoing trial against the suspect is riddled with unconstitutionality that has violated the rights and freedom of Mr Afoko.

Even before embattled Chief Executive Officer (CEO) of Menzgold Ghana Limited, Nana Appiah Mensah was processed for court on Friday, legal practitioner and political critic, Dr Maurice Ampaw pleaded with the police to drop charges against him.

According to Dr Ampaw, for NAM 1, as he is popularly called, to cough out about GH¢200m to settle his customers, the court must allow out of court settlement.

“How many customers does Menzgold have? We are in a week of out of court settlements and you have our police taking NAM 1 to court. How do you expect him to pay us when you keep dragging this issue? I’m pleading with the court to drop the charges and allow out of court settlement,” he told Accra based Okay FM, monitored by Adomonline.com.

Mr Mensah spent Thursday night in police cell after he was declared wanted in January this year.

This was after the embattled CEO was picked up by the Criminal Investigations Department (CID) on the tarmac of the Kotoka International Airport when he disembarked from an Emirate flight.

He was driven straight to the CID headquarters to be charged.

He had been in custody in Dubai since last year but he recently won his court case against Dubai-based gold dealership firm, Horizon in the $39 million gold trial.

Addressing journalists on Thursday, Head of Public Affairs of the Police CID, DSP Juliana Obeng confirmed that NAM 1 was in the custody of the CID following an Interpol alert issued for him.

But, the legal practitioner, who has been a Menzgold customer for the past four years, could not fathom why the government was playing politics with the issue when it had said it won’t interfere in the matter.

“Even if Menzgold customers didn’t listen to advice and now our monies have been locked. Why can’t you understand as government and protect our interest? I blame government for NAM 1’s arrest in Dubai. If they had not taken that posture, he wouldn’t have been arrested in Dubai. Now that he is in Ghana, why should you process him for court?

“It is about time we lobby the government and convince him so we get our monies back,” he stated.

This revelation by the lawyer follows media that medical reports have proved the journalist was not tortured after the National Security earlier denied allegations by Ajarfor and a U-turn by Mr Britwum a reporter at ModernGhana, quashing his earlier claims of torture.

In Facebook post on renowned journalist Mabel Aku Banaseh’s timeline, the lawyer Nii Kpakpo Samoa Addo wrote:

“Disregard any story circulating that there is a medical report which exonerates the national security from the allegation of torture. The journalist was given heavy doses of pain killers when he first reported to the Police hospital and we have evidence of same. Those who are panicky should relax. “And yes we will seek justice for the journalist by both criminal and civil means. Luckily he lodged a complaint at the Legon police station. He is able to identify those who assaulted him. He knows where they work. We will follow up the report. There will be an identification parade,” the post disclosed.

“I have become aware via the media that Britwum has procured the services of another lawyer and I wish him well.”

The two journalists are reportedly being investigated for their alleged roles in some cybercrimes. They were picked up by the National Security officers on Thursday. Mr Britwum was released on Friday while his colleague Mr Ajarfo was released on Saturday.

Mr Ajarfor in various interviews has said their arrest was tied to the publication of an article that criticised the National Security Minister, Albert Kan Dapaah.

Presenting the case in court, Police Prosecutor, Chief Inspector Stephen Tamakloe said on Monday, a group of people came to lodge a complaint at the Awutu Breku Police station about the suspect who they said defrauded them of GH¢5, 000.00 about four months ago.

However, the suspect, according to the prosecutor, failed to deliver the task he took the money for and upon interrogation, the suspect admitted the charges against him and disclosed he was not a lawyer but used those means to get money for his personal use.

He said land litigations are on the rise because many Ghanaians do not know exactly where their lands are, and it will be important for people to demand the site plan of their lands so they know the demarcations through the intervention of the Lands Commission.

This because according to Mr Anyidoho it is only the Lands Commission that has what it takes to detect anything fake about any piece of land one may intend to buy.

He gave the example of how lands bought in the Kasoa area were previously registered in Accra but have since changed to the Central Region.

He decried the situation where people believe in landowner to the extent that they refuse to do a proper search, especially when it’s coming from a chief or an estate company.

On why the Lands Commission is not arresting estate companies for deceiving people, he said the estate companies have their association so it is their association that deals with them and not the Commission.

He pleaded with chiefs to be truthful in their dealings, especially when it comes to the selling of lands.

As a tip to potential land buyers, Mr Anyidoho asked buyers to beware of landlords who apply pressure on buyers to put up structures on lands they acquire from them because it is an indication of something not being right.

The witness, Dr Alfred Arthur, in his evidence-in-chief on October 29, 2018, told the Accra High Court that he was the acting Head of the Soil Science Division of Cocoa Research Institute of Ghana (CRIG).

The witness continued with his evidence-in-chief on November 2, 2018.

Dr Arthur, in his evidence-in-chief, testified that he tested the Lithovit Foliar Fertiliser (LFF), the said fertiliser which is the subject matter of the trial.

But during cross-examination on Monday November 12, lawyer Samuel Cudjoe sought to make a case that the witness was not the acting Head of the Soil Science Division of CRIG as he had presented himself.

Counsel was particular that as of November 2, 2018 when the witness appeared before the court to continue with his evidence-in-chief, he was no longer the acting head of the Soil Science Division of CRIG, but the witness failed to inform the court.

In his response, Dr Arthur refuted counsel’s assertion and stated that he was not aware that as of November 2, 2018, he was no longer the acting Head.

Below are excerpts of the cross-examination

Mr Cudjoe: At the last adjourned date (November 2, 2018) when you gave your evidence-in-chief, you knew you were no more the acting Head?

Dr Arthur: No my Lord, I never knew at the last adjourned date.

Mr Cudjoe: I am putting it to you that you knew you were not the acting Head and you are being economical with the truth.

Dr Arthur: My Lord, I did not know that.

Appointment letter

Mr Cudjoe then asked the witness if he was given an appointment letter when he was appointed as the acting Head, to which Dr Arthur replied in the negative.

Counsel submitted that in CRIG, all appointments, including those in acting capacities, were communicated to the appointees in writing.

But Dr Arthur replied that was not so in all cases and that in his case, he was asked to act as the Head when the substantive Head, Mr A.A Afrifa, went on retirement.

Mr Cudjoe then accused the witness of testifying against his client with the sole aim of getting his appointment as the acting Head confirmed.

“That is not correct,’’ Dr Arthur responded.

The cross-examination will continue on Wednesday, November 14, 2018 at the court, presided over by Justice Clemence Honyenuga, a justice of the Court of Appeal with additional responsibility as a High Court judge.

Case against Opuni & Agongo

In March, 2018, the Attorney-General (A-G) charged Dr Opuni and a businessman, Seidu Agongo, the CEO of Agricult Ghana Limited, with 27 counts.

It is the contention of the A-G that Dr Opuni, during his tenure as COCOBOD CEO (November 2013 to January 2017), breached laid down procedures in procurement and other laws that led the state to lose GH¢271.3 million in the alleged fertiliser scandal and the distribution of substandard fertiliser to cocoa farmers

Agongo is also alleged to have used fraudulent means to sell substandard fertiliser to COCOBOD for onward distribution to cocoa farmers.

The two accused persons have denied any wrongdoing and have pleaded not guilty to all the 27 charges.

They are currently on bail in the sum of GH¢300,000 each.

Ralph Agyapong, counsel for Assin Central Member of Parliament, Kennedy Agyapong says his client is ready to file his defence if Anas Aremeyaw Anas and his lawyers present their detailed address to the court.

Lawyer Agyapong’s comments follow a decision by a High Court in Accra to decline an application by Kennedy Agyapong seeking to dismiss the ȼ25 million defamation suit against him by Anas Aremeyaw Anas.

The court held that the writ filed by the ace investigative journalist does not in any way violate the constitutional right of Mr Agyapong as no relevant legal points have been raised to substantiate that claim.

Mr Agyapong claimed in his writ that the wearing of a mask and the concealment of his identity breached his constitutional rights under article 33 of the Constitution.

But the Court directed Anas to furnish Mr Agyapong with a more detailed address in 10 days as the current address provided is not sufficient.

But Lawyer Ralph Agyapong on Asempa FM’s Ekosii Sen Thursday debunked media reports that the court has thrown out Ken Agyapong’s application to dismiss Anas’ ȼ25m suit.

According to him, there was a wrong documentation about the residential address provided by the ace investigative journalist which to him was the main reason their case was dismissed.

“Some of the news portals are reporting inaccurate news because our case was not thrown away; the fault was not from our end but Anas’ so why should the media paint the picture as if it was our fault. If you don’t like the person at the centre of the issue, doesn’t mean you should report falsely,” he said.

He said since the court has asked Anas and his team to provide the right details, within 10 days, they will also proceed and file their statements of defence when Anas and his lawyers are ready for proceedings to begin.

“My client has already said he is ready to fight this matter to the end so we are ever ready. We will file our statements when they are also ready in 10 days,” he stated.

A 23-year-old man, Emmanuel Marfo, is in the grips of Koforidua Police for posing as a lawyer in a Koforidua circuit court.

Emmanuel Marfo dressed in a suite with bib and went to the Koforidua Circuit Court “A” as counsel for one Hanson Annoh in a civil case between Annoh and Peter Amanor.

Mr Marfo rose and introduced himself as counsel for Hanson only to start throwing wrong legal jargons in the courtroom.

Emmanuel’s language and conduct pricked the ears of the judge, H/W Evelyn Asamoah and other lawyers in court.

He was asked when he completed law school, his license, and other documents to prove he was a lawyer but he failed to provide any.

Eastern regional police PRO DSP Ebenezer Tetteh who confirmed the issue said investigations reveal that Emmanuel is neither a lawyer nor has he been called to the bar.

Counsel for former COCOBOD CEO, Edudzi Kudzo Tameklo, is asking the Chief Executive Officer of Ghana Cocoa Board (COCOBOD), Joseph Boahen Aidoo, to take a cue from Dr Opuni’s prosecution.
Mr Tameklo believes the current CEO is leading a crusade to demonize his predecessor but has advised him to tread cautiously on the path he has taken.

An Accra High Court ordered the accounts of Dr. Stephen Opuni who is standing trial for causing financial loss to the state unfrozen.
Two separate accounts of the ex-COCOBOD CEO who is being tried for causing financial loss to the state have been frozen for almost a year by the Economic and Organised Crimes Office (EOCO).
The state avers that Dr. Opuni’s  3-year administration caused the state  217million cedis, through alleged dubious contracts.

Mr. Tameklo who is confident his client will be exonerated, however believes, some elements within the current government, whose names he has refused to mention, are scheming hard to tarnish Dr. Opuni’s image.
“I know Dr Opuni will be exonerated very soon. Sometimes I wonder why people will be so mean to work against this honest man. But this should serve as a great lesson to the current CEO, Joseph Boahen Aidoo,” he said.
Speaking on Okay FM as monitored by adomonline.com, Mr. Tamaklo cautioned Mr. Aidoo to be careful with his role in the prosecution of his predecessor.

According to him, the laws of Ghana do not allow for any of the three types of marriages, be it customary, ordinance or Muslim, to be dissolved by a pastor.

The lawyer who made the comments on Adom TV’s legal show, Me wo case anaa, with host Afia Pokuwaa said even in the case of customary marriages, only the families from the two sides can come together to dissolve a marriage.
He added that marriage under ordinance can only be dissolved in the courts and not by a pastor, further warning that pastors must stay away from the dissolution of marriages because it breaks the law.

Meanwhile, a Principal State Attorney at the Registrar General’s Department, Mr. Oladele Kwaku Aribike, says that when you marry under customary law and you want to marry another wife under ordinance, the court will not recognize the marriage under ordinance unless you dissolve the customary marriage.
He advised both men and women to go to court whenever they are facing any challenges in their marriages for better dissolution.

According to Nii Kpako Addo the petition may suffer a capacity deficit and may be rejected by the Chief Justice whose responsibility it is to first determine if there is a prima facie case to be investigated before proceeding to conduct full scale investigation.
A 29-point petition has flooded the media landscape with damning allegations of misconduct against the EC chairperson, Charlotte Osei.
The allegations made by faceless “concerned workers of the EC” range from breach of procedures at the EC, breach of financial laws, and contempt towards deputy commissioners and bad human relations.
The petition came with a counsel, Maxwell Opoku Agyemang who signed it but without the identities of the petitioners who made the allegations.
The petition has already triggered mixed reactions clothed with partisan coloration.
The opposition National Democratic Congress has sworn to challenge the decision or attempt to impeach the EC Chair and is singing the chorus of witch-hunting.
Minority Leader Haruna Iddrisu in an interview with Joy News’ Evans Mensah said the EC Chair is not above the law, but she cannot be investigated, let alone impeached by the president.
Discussing the matter on Newsnite, Lawyer Nii Kpakpo hinted the substance of the petition may not even delved into because there are no faces to the petition.
The issue of capacity, he noted is fundamental to the legal process.
Citing the famous Judicial Bribery scandal in which Tiger Eye PI petitioned the Chief Justice for the removal of some corrupt judges captured on camera trading justice for money, Nii Kpakpo said the issue of capacity was key.
The defendants challenged the capacity of Tiger Eye PI to petition the CJ, a petition that will trigger their removal from office.
Nii Kpakpo Addo said the only thing that saved the Anas petition was his preceding statement that he Anas, in his capacity as a citizen of Ghana has filed this petition.
But for that statement the petition would have been dismissed because of lack of capacity, he said.
“If there is no identifiable petitioner as the time of the filing of the petition, then the entire petition is null and void for lack of capacity,” he said.
Asked if it would apply in the EC case, he affirmed, it would.
With a petition pregnant with allegations but no faces, Kpakpo Addo does not see it passing the capacity test.
He however deferred to the Chief Justice who he said would make the final decision on that.
However in a contrasting argument, the Dean of the Central University Law School, Yaw Oppong says the law which spells out the impeachment process of the Electoral Commissioner, Article 146, does not demand capacity from the petitioner.

According to him, the move will bring burden on the Ghana Law School hence must find a way to expand facility.

‘I don’t agree with the SC ruling in that already some of the students who come there have little or no idea some of the subjects and so allowing them to write entrance exams will be the best but scarping interview and exams process before admission will worsen the case.

“When it happens, trust me, the overcrowding alone will force teachers to even teach law courses in the kiosk because it will bring burden on the school” he said on Accra based Neat FM.

Lawyer Maurice Ampaw’s comment is in reaction to a ruling by the Supreme Court (SC) to scrap the examination and interview process before admission of students to the Ghana Law School.

The SC ruled on Thursday June 22 that it was unconstitutional for the General Legal Council to ask applicants to the Ghana Law School to write an entrance examination and subsequently be interviewed prior to admission.

The court said the current mode of admission is in violation of Legislative Instrument 1296.

A United States-based Ghanaian lawyer, Professor Kwaku Asare, initiated the suit in 2015, challenging the mode of admission used by the Ghana School of Law.

But lawyer Ampaw believes that scrapping of the entrance examination and the interview affect the quality of the school.

He advised the Court to take a second look at the ruling in order not to churn out half baked lawyers in the country.

“The media should stop insulting me. Some of them even address me as “that devil of a lawyer” and use all sort of abusive words on my personality. I am on the brink of withdrawal” he lamented.

Mr Shaw who was speaking in an interview with the Ghana News Agency (GNA) in Cape Coast was emphatic that he does not support mob justice but was only in to ensure that the rights of the accused persons were not abused.

This was after the seven accused persons who were initially arrested after the mob-action last May, were discharged by the Cape Coast Magistrate Court on Monday and the case transferred to Accra for continuation.

All the accused persons except William Baah, the assembly member were bare footed when they appeared in court.

“I am not doing this for money, I am just a human rights lawyer. I am totally against mod justice” he stated.

Mr Shaw said the country was governed by rule of law and was not a jungle, adding “Stop trying the case in the media. The media should know better and educate the public”.

He expressed dissatisfaction about the way Ghanaians were handling the matter with some pronouncing judgment on the accused persons, saying it was wrong for people to comment while the matter was pending at the court.

He called for regular public education to educate the Ghanaian populace to understand the processes of the court citing for instance the law that states that ‘a person is not guilty until proven guilty by a court of a competent jurisdiction’.

Mr Shaw also expressed dissatisfaction with the manner in which the case was being handled by the prosecution.

He told the court on Monday June 19, that he had been denied access to his client after several efforts while prosecution had also denied some of the accused persons who sustained wounds access to health care.

“I have not been granted access to my clients to know their side of the story and that of their health and indicated that such practices were against the natural laws of justice and should not be entertained.

Mr Shaw advised the Government to be cautious with the way it handled the case as the international community as well as human rights activists were monitoring how the suspects in the case would be tried.

Mr Agyare’s complaint to the General Legal Council led to the suspension of the popular human rights lawyer.

According to Francis Agyare, his lawyer set out to dupe him of a GHC200, 000 compensation granted by a court after his release from a 14-year unlawful detention.

The renowned human rights lawyer was last week handed a four-year ban from practicing as a lawyer after pleading guilty to two charges.

One of the charges, on the basis of which he suffered a one-year ban, was founded on a complaint brought by Mr. Agyare accusing the lawyer of attempting to swindle him.

Giving an account of what transpired between the two in an interview on Joy FM’s Super Morning Show Thursday, the 49-year-old man said his lawyer deserves the treatment he is getting and pleaded with Ghanaians not to fault him (Agyare).

However, in a September 30, 2014, recording, Mr Agyare is heard pleading for forgiveness for going public with the allegations even as Mr Sosu was fighting for his case in court.

Lawyer Sosu has confirmed to Joy News that the recording was made in his final meeting with Mr Agyare following a previous allegation Mr. Agyare leveled against him.

According to the council, Mr Sosu was convicted on two different charges with four counts, to which he pleaded guilty to all of them.

They are the charging of GH¢50,000.00 which was deemed excessive and an over- estimation of the services rendered to a client, Francis Agyare, when he represented to him that he was offering pro bono legal services, and also failing to appear before the Disciplinary Committee of the General Legal Council on June 9, 2016.

The other charge is taking to Facebook with pictures of the parties in a case and making comments on the case to the public with the primary motive of personal advertisement and touting.

He was subsequently sentenced to a period of three (3) years suspension on each of the charges, commencing June 2, 2017 and ending on June 1, 2020.

A statement issued by the GLC announcing the suspension said after the suspension, Mr Sosu is to be mentored by a senior lawyer for a period of one year commencing June 2, 2020 and ending on June 1, 2021.

The senior to mentor him shall lodge periodic reports on him to the General Legal Council’s Disciplinary Committee at the end of every month during the mentorship period.

The statement said both sentences run concurrently and that during the period of suspension, he shall not hold himself out as a Legal Practitioner or attend Chambers, or render, or purport to render any professional legal service to any person whomsoever, wheresoever.

Meanwhile, Mr Sosu has reportedly told Accra based radio station, Citi FM that he will appeal the suspension.

ANNOUNCEMENT FROM THE GENERAL LEGAL COUNCIL SUSPENSION OF LAWYER FRANCIS XAVIER SOSU LEGAL PRACTICE

NOTICE IS HEREBY GIVEN that Lawyer Francis Xavier Sosu is hereby suspended from legal practice for a period of period of three (3) years commencing 2nd day of June, 2017 and ending on 1st day of June, 2020.

There were two cases against him, to wit:

Complaint of Francis Agyare against Francis Xavier Sosu

Lawyer Sosu was formally charged under Rule 9 (9) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 L.I. 613 that he; having assisted Mr. Francis Agyare, in Human Rights litigation in Accra, charged him GH¢50,000.00 which was excessive and an over- estimation of the services rendered to him, when he represented to him that he was offering pro bono legal services.

He was also charged under Section 19(5) of the Legal Profession Act that he, having been duly notified, failed to appear before the Disciplinary Committee of the General Legal Council on 9th June, 2016.

Lawyer Sosu was convicted on his own plea of guilty on both counts.

2. Conduct of Lawyer Francis Xavier Sosu

The Disciplinary Committee of the General Legal Council formally charged Lawyer Sosu under Rule 2(4) of the Legal Profession (Professional Conduct and Etiquette) Rules. 1969 L.I. 613 that he; while acting as Counsel for Torgbui Afede XIV, in a matter between Torgbui Afede XIV and the Chief of Defence Staff, Minister of Interior, Attorney General and another took to Facebook with pictures of the parties and made comments on the case to the public with his firm’s name, address and telephone numbers attached, with the primary motive of personal advertisement and touting.

He was further charged under Rule 2 (4) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 L.I. 613 that he; while acting as Counsel for Patrick Reynolds Yeboah, in a matter between Patrick Reynolds Yeboah and M.DEX Company Limited Accra, Ledzokuku-Krowor Municipal Assembly (LEKMA) Accra, Ghana Standard Authority Accra, National Road Safety Commission, Accra, took to Facebook posting the Writ of Summons in the said case and made comments to the public with his firm’s name, address and telephone numbers attached, with the primary motive of personal advertisement and touting. Lawyer Sosu was convicted on his own plea of guilty on both counts and was sentenced to a period of three (3) years suspension commencing 2 day of June 2017 and ending on 1st day of June 2020.

He is to be mentored by a senior for a period of one year commencing 2nd June 2020 and ending on 1st June 2021.

Yaw Oppong said the action carried out by the youth does not constitute a mob justice as has been ascribed by Ghanaians.

Speaking on Joy FM/MultiTV’s Saturday news analysis programme Newsfile, the law lecturer said what the youth did was “mob injustice.”

“You cannot apply an illegal means in your bid to seek justice,” he told Newsfile host, Samson Lardy Anyenini.

The conscience of Ghanaians was stirred following the brutish murder of a senior military officer, Captain Mahama at Denkyira-Obuasi in the Central Region.

The Captain was killed on Monday after some residents claimed they mistook him for an armed robber. He had a weapon on him, which alarmed the residents, it was reported.

He fell unconscious after he was severely beaten and stoned. He was later set ablaze.

The incident has been roundly condemned by Ghanaians and a heavy flow of tributes from leading Ghanaian personalities and soldiers have been  pouring in.

President Nana Addo Dankwa Akufo-Addo has said his government will ensure the prosecution of all those involved in the murder.

The father of the slain soldier, Captain Retired Adam Mahama said his son’s death should serve us a wake-up call to all Ghanaians to discard the dastard cases of instant justice.

“My son’s lynching should be the last that we, human beings will do against a person we suspect to have committed a crime,” he told Joy News Thursday.

At least seven people are in the custody of the police in the Central Region in connection with the murder.

They are, William Baah (the Assemblyman of Denkyira Obuasi), Bismark Donkor, Phillip Badu, Kofi Nyame, Anthony Amoah and Kofi Badu.

Many people have described the incident as a clear case of mob justice, but Mr Oppong said that description is not appropriate since it sought to give the action some semblance of justice.

“If it is illegal justice then you can ascribe some just cause [but[ this is a pure case of evil,” he said, urging the police to widen their scope of investigation.

On his part, senior journalist Kweku Baako Junior has appealed to government to set up a committee to probe issues of illegal mining in the community.

“A lot has been happening…it is well documented,” he said, adding it is likely “somebody is not telling the truth” so far as the issues of illegal mining are concerned.
