According to him, while it is within EOCO’s mandate to investigate, the agency must focus on establishing the facts rather than fueling public speculation through the media.

Speaking in an interview on TV3, Mr. Adofo noted that Shatta Wale’s case is significant and deserves thorough scrutiny.

He explained that EOCO could easily determine the facts by assessing the cost of the musician’s vehicle, his income records from previous years, and his tax obligations.

He added that the tendency to try cases in the media rather than in court is not only worrying but also undermines the integrity of the justice system.

Meanwhile, Shatta Wale has been granted bail in the sum of GH₵10 million with two sureties, each to be justified.

EOCO noted that the artiste has so far been unable to identify the person from whom he allegedly purchased the luxury vehicle for $150,000, except to say he bought it “from the street” from someone probably called “ZAK.”

Dozens of his fans have gathered at EOCO headquarters demanding his release, chanting his name and displaying placards in solidarity with the dancehall star.

Mr. Adofo, however, insists that beyond the fanfare, EOCO must prioritize due diligence and ensure the matter is resolved fairly and without sensationalism.

]]> Torkornoo can win her injunction application if… – Lawyer [Listen] https://www.adomonline.com/torkornoo-can-win-her-injunction-application-if-lawyer-listen/ Thu, 22 May 2025 14:29:17 +0000 https://www.adomonline.com/?p=2537464 Private legal practitioner Kwame Adofo says suspended Chief Justice Gertrude Torkornoo stands a good chance of securing an injunction at the Supreme Court to halt proceedings by the committee hearing her possible removal.

However, he emphasized that her success largely depends on the composition of the panel at the Apex Court, which he described as “currently divided.”

Speaking in an interview on Adom FM’s Dwaso Nsem, Mr. Adofo stated that if Acting Chief Justice Baffoe-Bonnie, Justice Yonny Kulendi, and Justice Amadu Tanko are excluded from the panel, Justice Torkornoo is likely to succeed.

“In terms of looking at it objectively, she may have a case. But at the moment, the Supreme Court panel is divided. It depends on the panel she will get. If it doesn’t include any of these three people, then she will win,” he said.

Justice Torkornoo is seeking an interlocutory injunction to stop all committee proceedings until the Supreme Court determines her case.

Her application also calls for Justices Gabriel Pwamang and Samuel Adibu-Asiedu to recuse themselves from the committee’s work. She argues that Justice Pwamang previously ruled in favour of one of the petitioners, Daniel Ofori, and therefore lacks the neutrality to chair the committee.

She also contends that Justice Adibu-Asiedu is not qualified to sit on the committee because he was part of the Supreme Court panel hearing an earlier injunction application related to the impeachment process.

Commenting on these points, Mr. Adofo described her concerns as legitimate.

“According to the rules, if there’s an appeal or further action on a ruling, the same judge cannot sit on it again. So now that the ruling has become a subject of petition, how can you preside on a case seeking her removal?

“If what I’m hearing is true, then Justice Pwamang should have stepped aside. He shouldn’t have even accepted the role,” he added.

CJ’s removal: Supreme Court divided; a gang of 3 poised to dismiss all cases – Lawyer Claims [Audio] https://www.adomonline.com/cjs-removal-supreme-court-divided-a-gang-of-3-poised-to-dismiss-all-cases-lawyer-claims-audio/ Thu, 22 May 2025 10:52:07 +0000 https://www.adomonline.com/?p=2537322 Private legal practitioner Kwame Adofo has raised serious concerns about the impartiality of the Supreme Court panel presiding over cases involving the removal of suspended Chief Justice Gertrude Torkornoo.

Mr. Adofo claimed the apex court appears divided, pointing to a possible conflict of interest.

In an interview on Adom FM’s Dwaso Nsem, he asserted that some members of the Supreme Court panel seem to be pushing for Justice Torkornoo’s reinstatement.

However, another group of three justices appears determined to see Justice Torkornoo removed and wants to dismiss any cases challenging her suspension or removal.

“It appears the Supreme Court is divided based on some rulings that have come. Looking at the panel — Acting Chief Justice Baffoe-Bonnie, Amadu Tanko, and Yonny Kulendi, a fantastic lawyer — it seems they have decided to dismiss every case,” he stated.

The apex court has recently dismissed about three cases seeking to halt the suspension and removal of Justice Torkornoo.

The latest case was filed by the Centre for Citizenship, Constitutional and Electoral Systems (CenCES).

In a 4–1 majority decision on Wednesday, May 21, a five-member panel comprising Justices Paul Baffoe-Bonnie (Presiding), Issifu Omoro Tanko Amadu, Yonny Kulendi, and Henry Anthony Kwofie ruled against the case, while Justice Yaw Asare Darko dissented.

Torkornoo’s removal: It is surprising Ag. CJ Baffoe-Bonnie hasn’t recused himself – Lawyer https://www.adomonline.com/torkornoos-removal-it-is-surprising-ag-cj-baffoe-bonnie-hasnt-recused-himself-lawyer/ Thu, 22 May 2025 10:11:33 +0000 https://www.adomonline.com/?p=2537296 Private legal practitioner Kwame Adofo has criticised Acting Chief Justice Paul Baffoe-Bonnie for not recusing himself from the panel hearing cases related to the suspension of Justice Gertrude Torkornoo.

Speaking on Adom FM’s Dwaso Nsem, Mr. Adofo said there is a clear conflict of interest, and he supported the decision by Justice Torkornoo’s lawyers to raise the objection.

“He is clearly benefiting as the Acting Chief Justice. He includes himself in a panel and also rules against the woman. So that is a clear conflict of interest. I’m surprised he hasn’t recused himself and set up a new panel. He should not be part of this,” he stated.

His comments followed a 4–1 majority Supreme Court decision on Wednesday dismissing a case filed by the Centre for Citizenship, Constitutional and Electoral Systems (CenCES).

The case sought to reverse President John Mahama’s suspension of the Chief Justice and halt the committee set up to consider her possible removal from office.

The five-member panel, chaired by Justice Paul Baffoe-Bonnie and including Justices Issifu Omoro Tanko Amadu, Yonny Kulendi, and Henry Anthony Kwofie, ruled against CenCES, while Justice Yaw Asare Darko dissented.

CenCES argued that the President’s suspension violated constitutional provisions and sought to invalidate both the suspension and the ongoing inquiry.

However, the Supreme Court upheld the suspension and allowed the committee’s work to continue—an outcome Mr. Adofo described as worrying.

Post-election violence unacceptable, a criminal activity – Lawyer  https://www.adomonline.com/post-election-violence-unacceptable-a-criminal-activity-lawyer/ Thu, 12 Dec 2024 09:38:27 +0000 https://www.adomonline.com/?p=2482843 A private legal practitioner, Kwame Adofo, has called on the police to urgently take action against individuals involved in the post-election violence, describing their actions as criminal and completely unacceptable.

In a strongly worded statement, lawyer Adofo condemned the recent spate of incidents in which properties, including state buildings and valuable resources, have been destroyed or looted.

Despite the peaceful conduct of the 2024 election, several incidents of vandalism have been recorded in parts of the country.

They include the burning of the Ayensuano Electoral Commission (EC) office, attacks on the NADMO office, and the looting of state-owned goods such as fertilizer, rice from a warehouse, and Ghana Gas facilities.

There are claims that these actions are being carried out by supporters of the National Democratic Congress (NDC).

Amidst the wide condemnation, the New Patriotic Party(NPP) at a press conference on Wednesday accused the NDC leadership of organising, fuelling and bussing these supporters to perpetuate the crimes.

Speaking to Adom News, lawyer Adofo expressed his outrage at the ongoing destruction and emphasized that such behaviour cannot be tolerated.

“The police must wake up and arrest all these criminals destroying state properties. What we are witnessing is criminal activity, and it is unacceptable. I cannot understand why the police have not acted decisively to prevent and stop these actions,” he fumed.

He also raised concerns about the apparent inaction of law enforcement, saying, “It seems the police are sleeping on the job. There is no excuse for this negligence, and I wonder why this is happening. The law must be enforced, and those responsible for these crimes must face the full force of the law.”

Lawyer Adofo urged the police to take immediate action and ensure that all individuals involved in the destruction and theft of state property are arrested and prosecuted.

“This behaviour undermines the rule of law and puts the stability of our nation at risk. We must not allow such lawlessness to continue. The police have a duty to protect public assets, and those who engage in these criminal acts must face the law accordingly,” he said.

Meanwhile, President-elect, John Dramani Mahama has appealed for calm and restraint following reports of violence and lawlessness in certain parts of the country.
