His comments come amid growing public debate surrounding the legitimacy of the closed-door inquiry into three petitions seeking the Chief Justice’s removal. Justice Torkornoo has challenged the constitutionality of the process and filed an injunction at the Supreme Court.

Speaking in an exclusive interview with JoyNews’ Blessed Sogah in Abidjan, Dr. Spio-Garbrah remarked that the ongoing legal process must be respected, even by those at the very top of the judicial system.

“As Chief Justice, we are implementing the law. She says the law is the law—and so the law is the law—and the law is being applied to her,” he said.

“The incidents that are being cited, unless she proves that they are incorrect, must stand.”

While the Chief Justice has pointed to personal hardship and procedural irregularities in challenging the process, the former minister declined to speculate on her emotional state, choosing instead to reflect on the broader human condition.

“It depends on how each individual responds to adversity. We all go through it—we lose loved ones, suffer accidents—and how we deal with it varies. So I won’t comment on what kind of adversity she claims to be facing,” he said.

Responding to concerns raised about a change in the location of the disciplinary hearing, Dr. Spio-Garbrah maintained that the government has the final say in procedural arrangements.

“All I’ve heard is that the location where she expected the hearing to take place wasn’t the one the government chose. But ultimately, it is the government that decides where the hearing should be held,” the former minister said.

On the matter of resignation, Spio-Garbrah emphasized that stepping down is a personal choice, often shaped by a complex mix of professional and personal considerations.

“A resignation is an individual decision. One must weigh all the information available at any given time. But the good news, from what I know, is that the Chief Justice—and others in similar high public office—retire on their full salary.”

Dr. Spio-Garbrah questioned the rationale for continuing in office when, by law, senior public officials such as the Chief Justice retire on their full salary.

While Dr. Spio-Garbrah refrained from making direct accusations, he implied that the decision to stay may extend beyond purely professional or legal concerns.

“So if you’re going to retire on your salary, why worry about staying on? Unless, of course, you want to continue enjoying some privileges—like the ability for your husband and children to travel—which you might not have access to once you leave office. But the other standard benefits remain. It’s a personal judgment, and I’m not in a position to make that decision for her,” he noted.

The school was cited by the Auditor General for violating the Procurement Act in the purchase of some items in 2021 and 2022.

The items worth over GH₵300,000 involved some 17 entities.

This came up at the Public Accounts Committee on Wednesday, August 14, 2024.

The school’s justification for proceeding with the procurement process without adhering to the law.

But PAC Chairman, James Klutse Avedzi will have none of that.

“You have admitted that you have flouted so we will recommend you for prosecution,” he said.

Despite the School’s request for pardon, the Charman indicated that “what we can do is to refer you to the court that the court will set you free.”

“We don’t have that power here to do it. We can only recommend you, then the one that has the power will listen to your plea, go home free and don’t do it again” he added.

He says tensions have permeated the relations of politics on one hand and constitutional jurisprudence on the other due to critical decisions of the constitutional court that doesn’t favor political groups or regimes.

Justice Dr. Sibylle Kessal-Wulf speaking at the Inaugural Dean’s Lecture Series of the Gimpa Law Faculty under the topic: The Constitutional Court of Germany and the Basic Law, in Accra mentioned that, the constitutional Court is established to protect the basic law of the country and has powers to nullify any enactment that contravenes the basic laws of the land.

She says that over the years, there has been tension between the political class and the judicial organs of state on many landmark constitutional cases that don’t favor the political class.

Dr. Justice Sibylle Kessal-Wulf said some criticism from the political class on major constitutional cases doesn’t promote mutual relations.

Adding that, the fact that some of the constitutional court decisions may face criticism doesn’t merit a different assessment of the constitutional court in the public sphere. 

She added that the laws of the country must never be adopted to politics but politics to the law.

Architecture of the Federal Constitutional Court of Germany:

The Court is composed of two Senates, each with eight members. The President is currently Chairman of the First Senate, the Vice-President is the Chairman of the Second Senate. In both Senates, there are several chambers, each with three members. The 16 judges are each supported by four research assistants. They regularly have several years of professional experience at specialist courts, authorities, law firms or jurisprudence.

Half of the 16 members of the Federal Constitutional Court are elected by the Bundestag and half by the Bundesrat, which also alternately appoint the President and the Vice-President. A two-thirds majority is required for the election. This is to ensure balance in the Senates.

At least three members of each Senate must come from the highest federal courts (Federal Court of Justice, Federal Administrative Court, Federal Finance Court, Federal Labor Court and Federal Social Court) so that their special judicial experience can be incorporated into the jurisprudence of the Federal Constitutional Court. Any person who has reached the age of 40 and is qualified to hold judicial office in accordance with the German Judiciary Act is eligible. The judges are elected for twelve years; the age limit is 68 years of age. In order to secure their independence, re-election is excluded.

Function of the Federal Constitutional Court of Germany

The Federal Constitutional Court in Karlsruhe monitors compliance with the Basic Law for the Federal Republic of Germany. Since its foundation in 1951, the court has helped to give prestige and effect to the free democratic basic order. This applies above all to the enforcement of fundamental rights. All state authorities are obliged to comply with the Basic Law. If a dispute arises, the Federal Constitutional Court can be appealed. His decision is final. All other organs of the state are bound by its jurisdiction.

The work of the Federal Constitutional Court also has a political impact. This becomes particularly clear when the court declares a law unconstitutional.

However, the court is not a political body. Its yardstick is solely the Basic Law. Questions of political expediency must not play a role for the court. It only determines the constitutional framework within which politics can unfold.

The limitation of state power is a hallmark of the modern democratic constitutional state.

Dean’s Lecture Series:

Dean of the Gimpa Law Faculty Dr. Kwaku Agyemang-Budu mentioned that the  Dean’s Lecture Series aims at addressing a wide range of topics, including constitutional governance and structure, human rights,  international law, corporate governance, environmental law among other to influence legal education and practice in Ghana and beyond.

Dr. Kwaku Agyemang-Budu opined that, the Ghanaian legal system has made some significant progress, towards responding to local and international developments in legal education, the practice of law, justice delivery, among others.

He added that, the legal community has been instrumental in promoting the rule of law, protecting human rights, and fostering good governance globally. A significant amount of these strides, he said have achieved through the adoption and localization of cross-jurisdictional and international best practices and procedures.

‘As the world continues to change rapidly, so do the legal challenges we face. It is therefore vital that we, as a progressive community, remain informed, engaged, and intellectually curious about contemporary global approaches to strengthen the law and its institutions’ Dr. Agyemang-Budu

He said the GIMPA Law School Dean’s Lecture Series has been instituted to serves as an annual platform for critical conversations cross-jurisdictional perspectives, bringing together highly renowned jurists, legal experts, scholars, and practitioners to share their insights and engage in critical dialogue on contemporary legal issues.

Dr, Agyemang-Budu mentioned that, through this platform, the GIMPA Law Faculty aims to promote the exchange of ideas and knowledge, and to contribute to the development of legal practice and education in Ghana and beyond.

In an address delivered by the President of GIBA’s Executive Council, Cecil Thomas Nii Lante Sunkwa-Mills to commemorate the day, he contended that the passage of the bill will strengthen the positive use and growth of our large broadcasting community in Ghana towards further National development.

Below is the full address:

On behalf of the Executive Council, Council of Elders and Members of the Ghana Independent Broadcasters Association, I warmly welcome you to this year’s commemoration of World Radio Day.

At the risk of sounding like a broken record, I am proud to state that ever since the advent of radio in the nineteenth century, it has remained the most widely used, available and trusted means of electronic mass communication in the world.

The fact that radio uses the human voice for communication, it has the unique ability to invoke a listener to imagine what is being broadcast and relate or otherwise to it.

For years, radio has remained the most far-reaching, quick and easily accessible communication medium that informs and entertains all sectors of society, with no boundaries.

We can all attest to the fact that here in Ghana, we can listen to the radio at home, in a vehicle, at the marketplace, on the farm, and later online for those with internet access anywhere.

Years ago and even very recently during the peak of the COVID-19 pandemic, radio was used to deliver school and adult education lessons. That takes some of us back to ‘Everyday English’ lessons and the like on GBC Radio 1.

Unfortunately, there are certain places in the world where the accessibility character of radio has been used negatively to fuel fake news, hatred and division, leading to conflict.

The comfort is that while some engage in these negativities, there are other places where, due to the passing of a lot of progressive legislation and regulatory mechanisms, radio broadcasts tend to be balanced in news, programmes and the practice of independent journalism in general.

After numerous studies and deliberations by UNESCO Member States, a declaration was made to institute the 13th of February each year as World Radio Day (WRD) in 2011.

This was endorsed by the United Nations General Assembly on 14 January 2013 as an international day and since then, 13th February has been celebrated in various forms by member states all over the world.

The observance of World Radio Day is basically to raise awareness among the public and the media regarding the importance of radio, to enhance networking and international cooperation among broadcasters, as well as to encourage decision-makers to establish and provide access to information through radio. 

In Ghana, GIBA has led in the commemoration of the day for some time now by holding events such as this and considering that GIBA Members are spread all over the country, the Executive Council made it a point to commemorate the day in Tamale, this year.

The theme for this year’s celebration is “Radio and Peace”. This theme reminds us of the power of radio in nurturing and building peace.

It provides the space for fostering and enriching democratic debate as is so often witnessed on our numerous radio stations. It is therefore crucial to safeguard the independence of radio and the media in general, including its diversity in many respects.

We at GIBA believe that this is the reason why UNESCO and more importantly, the framers of the 1992 Constitution have made freedom of the press a priority, which encapsulates our 513 operational radio stations out of 707 authorizations. 

We will also wish to use this occasion to also call on the Ministry of Information, Ministry of Communication and Digitalization and its agencies, to push the finalization of the long-awaited Broadcasting Bill to be assented finally into law, to strengthen the positive use and growth of our large broadcasting community in Ghana towards further National development and capture the impact of renewed policies and new technologies into the industry to ensure sustainability and growth.

The Executive Council and I would like to encourage all GIBA member radio stations and all stakeholders to not only pay lip service to the celebration of this day, but to also celebrate radio’s huge potential, and especially, to improve cooperation between broadcasters, policymakers, local authorities, law enforcement bodies, businesses and the general public while boosting the promotion of access to information, balanced with freedom of expression, gender equality and social inclusion across our communities in both the local and international language while making greater use of radio as a unique instrument of peace.

Indonesia: Parliament creates new law banning sex before marriage https://www.adomonline.com/indonesia-parliament-creates-new-law-banning-sex-before-marriage/ Tue, 06 Dec 2022 14:05:53 +0000 https://www.adomonline.com/?p=2192188 Indonesian lawmakers unanimously passed a sweeping new criminal code on Tuesday that criminalizes sex outside marriage, as part of a tranche of changes that critics say threaten human rights and freedoms in the Southeast Asian country.

The new code, which also applies to foreign residents and tourists, bans cohabitation before marriage, apostasy, and provides punishments for insulting the president or expressing views counter to the national ideology.

“All have agreed to ratify the (draft changes) into law,” said lawmaker Bambang Wuryanto, who led the parliamentary commission in charge of revising the colonial-era code. “The old code belongs to Dutch heritage … and is no longer relevant.”

The world’s largest Muslim-majority nation, Indonesia has seen a rise in religious conservatism in recent years. Strict Islamic laws are already enforced in parts of the country, including the semi-autonomous Aceh province, where alcohol and gambling are banned. Public floggings also take place in the region for a range of offenses including homosexuality and adultery.

The changes to the criminal code have not only alarmed human rights advocates, who warned of their potential to stifle personal freedoms, but also travel industry representatives – who worried about their potential effect on tourism.

In a news conference Tuesday, Law and Human Rights Minister Yasonna Laoly said it wasn’t easy for a multicultural and multi-ethnic country to make a criminal code that “accommodates all interests.”

What’s in the criminal code?

The new criminal code runs to 200 pages and has been years in the making.

A previous draft was set to be passed in 2019 but the vote was postponed after thousands of protesters, mostly studentstook to the streets demanding the government withdraw it.

In a televised address at the time, President Joko Widodo said he would delay the vote after “seriously considering feedback from different parties who feel objections on some substantial content of the criminal code.”

Hamid from Amnesty noted there had been “no meaningful changes” enacted since 2019.

Under the version passed Tuesday, sex outside marriage carries a potential one-year prison term though there a restrictions on who can lodge a formal complaint. For example, the parents of children who are cohabitating before marriage have the authority to report them.

As well as introducing new offenses, the code also expands on existing laws and punishments. Blasphemy laws have increased from “one to six provisions” and can now lead to a maximum five-year prison sentence, according to a draft document.

Hamid said laws on insulting the country’s leaders and unsanctioned protests will have a “chilling effect” on free speech.

“The reinstatement of provisions banning insults to the president and vice president, the sitting government as well as state institutions would further create a palpable chilling effect on freedom of speech and criminalize legitimate criticisms,” he said.

Human Rights Watch Indonesia Researcher Andreas Harsono said the laws are “a setback for already declining religious freedom in Indonesia,” warning they could be misused to target certain individuals.

“The danger of oppressive laws is not that they’ll be broadly applied, it’s that they provide avenue for selective enforcement,” he said.

Hadi Rahmat Purnama, from the University of Indonesia’s law faculty, said the laws would be implemented after a transitional period of three years.

Foreigners and tourists

The laws are expected to trouble the business community, especially those who regularly host and cater for foreign nationals and tourists.

The island of Bali, for example, relies heavily on tourist revenue and is still recovering from the pandemic slowdown that kept travelers away.

Putu Winastra, chairman of the Association of the Indonesian Tour and Travel Agencies (ASITA) in Bali, told CNN the laws would “make foreigners think twice” about visiting Indonesia.

“From our point of view as tourism industry players, this law will be very troublesome,” said Putu, who questioned how the laws would be policed.

“Should we ask (overseas unmarried couples) if they are married or not? Do tourist couples have to prove that they are married?” he asked.

Putu said the laws could be “counterproductive” to any efforts to entice tourists back to the island.

“If these laws are really implemented later, tourists might be (subjected) to jail and this will harm tourism,” he said.

According to him, stakeholder consultations are also ongoing and the results will feed into a Bill that will eventually be passed into law by the 8th Parliament.

These were contained in a statement signed by Mr Bagbin in response to a petition by one Emmanuel Abankwah Kesse, a political activist in the Eastern Region.

Mr Kesse had appealed to Parliament to amend the country’s human rights law to fight activities of LGBTQI+ and their presence in Ghana.

Mr Bagbin, in his letter, appreciated the concerns raised by the petitioner about activities of the LGBTQI+ groups.

The ‘Marry Your Rapist’ bill, which has not been passed yet, is being introduced into the Turkish parliament in preparation for Members of Parliament to debate at the end of January. The proposal has drawn widespread and international criticism, with opponents accusing it of legitimising rape, the marriage of minors and normalising child abuse and sexual exploitation.

The United Nations has spoken out against the bill, warning that it could lead to the increased confidence of rapists without fear of punishment and consequences to their crimes. It has also been denounced by opposition MPs from parties such as the People’s Democratic Party (HDP) which has urged the government to block it from being debated, primarily over fears that it could be used by some to force girls and minors into unwanted marriages.

A similar bill was presented to the Turkish parliament back in 2016, it had proposed the same for rape cases in which “force, threat, or any other restriction on consent” was not used. It was dropped by the ruling AKP government following global outrage.

Turkey has long been subject to scrutiny over the presence of alleged child marriage within the country and its proposed marriage laws. Although the legal age of consent in the Republic is 18, an estimated 482,908 child marriages took place over the past ten years, according to a government report published in 2018.

In 2017, another law was introduced – which was passed – allowing Islamic muftis and scholars to conduct civil marriage ceremonies, resulting in a barrage of criticism due to the perception that it undermines the country’s secular constitution and would allegedly open the way for more child marriages.

To Mr Baako, President Nana Akufo-Addo must review his stand and allow the concerns to be addressed by the Chief Justice and the General Legal Council.

“The students called for a Commission of Inquiry which the president already declined in his letter to the Chief Justice but I think he must review his stands because the Chief Justice and the General Legal Council are not going to work and won’t listen,” he said.

Speaking on Accra-based Metro TV, monitored by Adomonline.com, Mr Baako urged President Akufo-Addo to listen to the students’ appeal for a Commission of Inquiry.

“Even if they are going to do something, it will be in tit-bits, the structure itself must be broken down and I will go for a properly established Commission of Inquiry that will be given clear terms of reference to deal with this issue,” he said.

He said there are long standing barriers which need to be broken and the legal education reforms handled in a comprehensive and holistic manner.

“This issue has been here for too long and it is destroying the whole generation but our economy and society are expanding and we need a legal regime to deal with the expansion,” he added.

The police brutalized the demonstrating students and arrested a number of them when the students insisted on presenting their petition for a review of admission requirements and examinations management of the Law School to President Akufo-Addo at the Jubilee House.

Several of the students and media workers sustained rubber bullet injuries in the process.

Rawlings in tweets on Tuesday said the police action was uncalled for and that the conduct of the demonstration did not warrant the use of hot water cannons and rubber bullets.

He reminded the police that their actions ought to win the confidence of the people and not the reverse, saying “Monday’s actions rather sow seeds of discontent and encourage negative defiance.”

The government has through the Information Minister Kojo Oppong Nkrumah condemned the police management of the demonstration, calling it “embarrassing” and “unacceptable”.

The students had marched from the Ghana School of Law at Makola on their way to the Jubilee House to present their petition when they were stopped at the Ako-Adjei Interchange with water cannons and rubber bullets. Thirteen of them were arrested.

The police had argued that the seat of government remains a security zone and would not allow the demonstrators access.

“The government also believes that the police must always abide by their clarion call which is to protect and serve… We are of the view that the handling of such a situation must always be done in a manner that allows a balanced achievement of the objectives,” said the Information Minister on Citi FM, adding that restraint should have been exercised.

The Igbo King of the Nigerian Community in Ghana, His Royal Majesty Chukwudi Jude Ihenetu has revealed that millions of Ghanaians living in Nigeria are also breaking laws in Nigeria.

Speaking on Asempa FM’s Ekosi Sen show, Chief Ihenetu pointed out that these Ghanaians do not have passports and are trading in retail markets in Nigeria but are not being hounded because they believe in brotherliness.

“We have laws on retail business in Nigeria but we are not implementing these against Ghanaians and I can tell you over millions of Ghanaians breaking laws. I have a lot of my wife’s family members living in my house in Nigeria and they don’t have passports,” he said.

Asked if there are Ghanaians trading in retail market, Mr Ihenetu said “yes, millions of them are selling in retail markets, an activity reserved only for Nigerians. They are selling without passports and nobody has asked them to quit because we believe that we are all brothers. Ghanaians must treat us same here.”

The Igbo King’s comment was in reaction to recent Nigerian involvement in high profile criminal activities such as rape, robbery and the kidnapping of two Canadians in Kumasi.

These criminal activities of some Nigerian nationals in the country triggered anger in the Ashanti region where angry traders closed down shops belonging to Nigerians and asked them to go back to their country because they were engaging in retailing which violates laws in the country.

The musician and a man known as Frank Agyemang, aka, Killer Boss, are standing trial at the Accra Circuit Court for allegedly defrauding the businessman of ₵105,000 in the land deal.

The two have pleaded not guilty to charges of conspiracy to commit crime and fraudulent transaction land.

It is the case of the prosecution the two accused sold the land, which apparently did not belong to them, to the businessman.

At Tuesday’s court hearing, the prosecutor, Assistant Superintendent of Police (ASP) Ms Agnes Boafo, informed the court that the accused have refunded ₵55,000 out of the ₵105,000 to the businessman.

The hearing continues on December 18, 2018.

Prosecution’s facts

Per the facts of the case as presented by ASP Boafo, the complainant in the case is a car merchant while Agyemang claimed to be a building contractor.

She explained that in February 2017, the businessman wanted a parcel of land by the roadside to display his cars for sale. As a result, he contacted Akosua Adjepong for assistance.

The musician, the prosecutor said, told the businessman that she had a plot of land for rent, but the businessman wanted an outright sale.

“Later Akosua introduced Agyemang to the businessman as her brother who had one plot of land opposite the West Hills Mall for sale. The businessman after inspecting the land showed interest,’’ she said.

ASP Boafo added that the highlife maestro assured the businessman that the land was genuine and Agyemang was the rightful owner.

“They then took the businessman to the Lands Commission, went into one of the offices and came out with someone who confirmed that the land indeed belonged to Agyemang, and upon this, the businessman became convinced,’’ she said.

Afterwards, the prosecutor said, the businessman paid ₵105,000 for the land and later gave a Toyota RAV 4 vehicle valued at ₵100,000 to Agyemang for another plot of land.

“When the businessman went to work on the land, another person came to claim ownership of the land with original documents. He reported the matter to the police leading to Akosua and Agyemang’s arrest. Agyemang, however, released the vehicle to the police,’’ the prosecutor added.

The Court presided over by Her Ladyship Justice Gifty Agyei-Addo also set-aside the one-year mentorship handed to the Human Rights lawyer.

Mr Sosu was suspended after being found guilty of professional misconduct.

It followed a complaint filed at the Council by one of his clients, Francis Agyare, who accused Mr Sosu and his law firm F-X Law & Associates of attempting to swindle him.

The General Legal Council in a letter informing Lawyer Sosu of his ban stated that he was investigated and found guilty of professional misconduct.

“The disciplinary committee of the General legal Council formally charged Lawyer Sosu under Rule 2(4) of the legal profession (professional conduct and etiquette) Rules, 1969 L.I. 613 and that he; while acting as Council for Torgbui Afede XIV, in a matter between Torgbui Afede and the Chief of Defense Staff, minister of interior, Attorney General and another took to Facebook with pictures of the parties and comments on the case to the public with his firm’s name, address and telephone numbers attached, with the primary motive of personal advertisement and touting,” portions of the statement said.

It added: “He was further charged under Rule 2 (4) of the legal profession (Professional conduct and etiquette) Rule, 1996 L.I 613 that he; while acting as Counsel for Reynolds Yeboah, in the matter between Patrick Reynolds Yeboah and M.DEX company Limited in Accra, Ledzokuku-Krowor Municipal Assembly, Accra,Ghana, took to Facebook posting the writ of summons in the said case and made comments to the public with the firm’s name, address and telephone numbers attached, with the primary motive of personal advertisement.”

But delivering her judgment Wednesday, July 11, 2018, Her Ladyship Justice Gifty Agyei-Addo found that the charges of touting and personal advertisement as grave misconduct were not in accordance with law.

The victims are in JHS ‘2’ and ‘3’ respectively of the same school at Senya Beraku in the Awutu Senya West District of the Central Region.

Speaking in an interview with the Ghana News Agency at Senya Beraku, the uncle of the victims, Mr Barnabas Abban said the teacher defiled the final year student and impregnated her and in a month later he again defiled and impregnated the JHS ‘2’ student.

He said he reported the matter to the Domestic Violence and Victim Support Unit (DOVVSU) Department of the Kasoa Divisional Police Command and the teacher was arrested.

Mr Abban said the teacher lured the girls with the promise of helping them to pass their final year examination.

ASP Florence Annaman, the Kasoa Divisional Commander of DOVVSU confirmed the case to the Ghana News Agency and said the accused was yet to be processed for court.

The court fixed the date for judgement after both prosecution and the defence closed their case.
Pastor Adjei pleaded not guilty to the charge of indecent assault.
The facts as narrated by Chief Inspector Kofi Atimbire was that the complainant is a student residing with her family at Chantan a suburb of Accra.
Adjei is the head pastor of Faith Words Ministry located at Nii-Boi Town. The victim and her mother are members of the accused’s church.
Prosecution said on July 26, 2016, after a prayer session Adjei told the victim’s mother that he had a revelation about the victim and so he wanted to meet the victim.
According to prosecution on August 30, 2016, Adjei called the victim and her mother and reminded them about the issue.
At about 1600 hours same day, the victim went to see Adjei in his house as directed by her mother.
During a conversation with the pastor in his room, prosecution said Adjei told the victim that he has another revelation about her having abdominal pains.
Adjei then brought out anointing oil, and ordered the victim to sit by him in a three sofa chair and the victim obliged.
Prosecution said Adjei folded the sweater of the victim upwards and pulled down her the pair of trousers she was wearing.
Adjei then applied anointing oil on the victim’s navel and abdomen and held her tightly, fondled and kissed her.
The victim reported the matter to the Police and Adjei was arrested and during interrogation Adjei admitted the offence in his caution statement.

Another 177 students have been referred in one or two papers, Myjoyonline.com has learnt. This represents 81% failure for 2017.
Out of 474 students who sat for the 2017-2018 final exams, only 91 students representing 19% were deemed to have passed and will be called to the Bar.

The General Legal Council, the body that oversees legal education and profession in Ghana has mounted a vehement defence for the maintenance of entrance exams.
It argues the exams and interviews are to ensure higher standards in legal education.
But Chief crusader against the entrance exams Prof Kwaku Asare insists the entrance exams and interviews at the Ghana School of Law are illegal.
At the moment, there is an LI in Parliament currently going through a mandatory 21-day period before it will mature into law.
If members of the House are unable to raise two-thirds majority to kick against the LI it will automatically mature into law.
Meanwhile, critics of the entrance exams say the mass failure at the Bar exams is just one example of why the status quo must be abolished.
“The madness of the unruly GLC continues unabated as only 91 out of 474 LLB graduates are deemed qualified to be called to the Bar.
“One more proof that the entrance examinations and interviews are not just illegal and unethical but they are also entirely non-diagnostic. That is, the argument that they are designed to select quality graduates must fail on this performance report.
“Further, this is proof that the Bar exam is a poor assessment tool or that the Ghana School of Law is incapable of training LLB graduates or both.

“Think about it —— only 91 out of the 1,200 law graduates in this cohort are being called to the Bar!!!!” Prof Asare said on his facebook wall.

According to the victim the incident occurred at the time she was sent by her mother to pound fufu at a fufu pounding store.

The victim who was running an errand for her mum was accosted by the suspect who lives close to her home.

The suspect forcibly pinned her to the ground and had carnal knowledge of the victim.

“I’ve gone through a lot in that man’s hands. My mum sent me to the fufu shop and he asked me to give something to my mother only to get to his place for him to force me and defiled me” she narrated.

According to the victim, the suspect threatened to kill her if she disclosed her ordeal.

Meanwhile, the Assin Fosu Divisional Police Commander, Chief Supt. Henry B.M. Bacho, expressed worry about how some unscrupulous persons in the area use coins, toffee and other petty items to lure the children and defile them as a result.

He therefore, cautioned chiefs and opinion leaders not to settle defilement cases at homes but rather report to the police.

The students were supposed to write their second paper for the first semester Thursday morning but, led by their Students’ Representative Council (SRC), they boycotted the paper.

According to the students, even though they were writing a Criminal Procedure paper, two of the questions had absolutely nothing to do with the Subject – they were Law of Evidence questions.

The situation was compounded by the fact that one question had been cancelled, reducing the number of options available to them.

By the structure of the exam, students were supposed to choose four questions out of six. But with one question cancelled, they now had five questions from which to choose four.

Students of the Makola and GIMPA campuses of the School said they felt imperilled by the fact even the five questions left, two of them were Law of Evidence and not Criminal Procedure questions.

There have been simmering tensions over the conduct of examinations at the Ghana School of Law for some time now.

Previously, the School examined students internally; lecturers taught and set exams.

About three years ago, however, the General Legal Council, which has supervisory jurisdiction over the legal education in Ghana, led by Chief Justice Georgina Wood, decided to take the conduct of examinations away from the School.

The Council set up a body called the Independent Examinations Board (IEB) charged with the responsibility of conducting examinations.

Since then, there have muted anger by both students and lecturers who contend that this body is an anonymous body whose members are neither known nor are they governed by any statute.

Last year, more than a 100 students failed in at least one subject, a development the students say was tragic.

Before the advent of IEB, students were given eight questions from which to choose four.

But that has now reduced to six and even then, there are mix-ups as questions from different subjects are mixed and presented to students.

Speaking on condition of anonymity, some of the students said they are very frustrated by the repeated tardy nature of the examinations.

Fuseini was said to have conspired with another person now at large and robbed a driver of his Nissan taxi, worth GH¢17,500.00, a mobile phone worth GH¢200.00 and an amount of GH¢100.00. He pleaded not guilty to the charges but the court found him guilty.

He is to serve 15 years on the charge of robbery, but was acquitted and discharged on the count of conspiracy.

In sentencing, the court said it took into consideration the number of months spent in custody, the fact that the accused is a first time offender and his plea for mitigation. Earlier the prosecutor, Superintendent Kweku Bempah told the Court that the complainant Kingsford Agyari is a driver residing at Gbawe, while the convict is a trader residing at Ablekuma.

He said on December 12, 2014 at about 0230 hours, the complainant was driving his Nissan taxi on night business when the convict and one other at large stopped him at Kaneshie First Light and asked him to take them to Sakaman.

He said upon reaching Sakaman Estate, his accomplice pretended to be paying the transport fare, but in the process, removed a knife from his pocket and asked the complainant to surrender all his sales and the car key.

The prosecution told the Court that when the complainant resisted, they assaulted and dragged him out of the car, and sped off with it, together with his mobile phone and an amount of GH¢100.00 Superintendent Bempah said on October 30, 2015, the police had information that the said taxi had been changed into a private car with a new registration number parked at Bubuashie, so the police towed it to the Odorkor Police Station.

He said later investigations disclosed that Fuseini was hiding at Bortianor near Weija. He was subsequently arrested and he mentioned one Ibrahim as his accomplice.

David Sika, a driver, is alleged to have repeatedly had sex with his daughter at his Mempeasem residence, near Legon, as a result of which the girl became pregnant.

According to Accra News’ court correspondent Ama Brako Ampofo, Sika was picked up by the Domestic Violence and Victims’ Support Unit (DOVVSU) in 2014 after his divorced wife, Akosua, lodged a complaint against him.

Akosua had three years ago detected that her daughter, then 14, was pregnant. Her interrogation of the teenager brought to light that her father, Sika, had put her in the family way.

Akosua told police that that her daughter had revealed to her that Sika had been having sex with her anytime she and her two siblings visited him at Mempeasem to spend the weekend. She added that her ex-husband, detecting that his daughter was pregnant, took her to a health facility where it was subsequently aborted.

However, the accused pleaded not guilty to the charge of incest, compelling Justice Abena Oppong Adjin-Doku to adjourn sitting. Meanwhile, Sika has been granted a GHS40,000 bail with three sureties.
