On January 27, 2026, the police intercepted some bags, which were containing guns and ammunition, even before it left Accra for its final destination in Kpandai.

With this latest operation, the Oti Regional Police Intelligence Directorate (PID) intercepted a Kia Rhino with registration number GS- 4677-17, which were loaded with boxes of ammunition and were on its way from Accra to Kpandai in the Northern Region.

Upon receipt of the information, the PID Director ASP Maxwell Osafo-Adamu was accordingly informed, and he deployed a team who laid ambush for the vehicle.

On Sunday, Februry 8, 2026, at about 3:30pm, the said Kia Rhino was intercepted by the team and after a thorough search, one locally manufactured single-barrel shot gun and 21 boxes made up of 525 pieces of Lion AAA and BB ammunitions concealed under building materials were retrieved.

Two suspects, Abubakari Salam Atta, the driver of the vehicle and his assistant Kabuja Kwadwo Tademe have since been arrested.

During interrogation, they claimed ownership of the said exhibit and have since been detained to assist in further investigations.

In the petition, Mr Tajudeen is calling for urgent investigations, stricter regulation and possible restrictions on the distribution and use of substances such as Pethidine, Morphine, Tramadol and other opioid drugs within the Kpandai District.

He warned that the increasing availability and abuse of these controlled medicines pose a serious public health threat, particularly to young people. According to him, failure to act promptly could lead to higher levels of addiction, crime and long-term health complications within the community.

Mr Tajudeen urged the District Assembly, health authorities, the Pharmacy Council, the Food and Drugs Authority (FDA) and security agencies to collaborate in monitoring how opioids are sold, prescribed and distributed in the district.

He stressed the need for regular inspections of pharmacies, chemical shops and health facilities to ensure such drugs are dispensed strictly under proper medical supervision and in accordance with the law.

The petitioner also appealed to traditional authorities, led by the Kpandaiwura, to use their influence to support community education efforts and clamp down on the informal sale of opioid substances.

He further proposed public awareness campaigns, school sensitisation programmes and community engagements to educate residents on the dangers associated with drug abuse.

While acknowledging the legitimate medical use of opioids, Mr Tajudeen cautioned that their uncontrolled circulation could have devastating social and health consequences for the district.

Some residents have also expressed concern about the growing misuse of drugs in Kpandai, making the call for swift action both timely and necessary.

The bloody skirmish, which erupted on Saturday, 7th February 2026, was triggered by a bitter territorial dispute over a gravel pit currently being utilised for the rehabilitation of the Dobong community road.

The conflict reached a breaking point when an attempt to extract materials for the infrastructure project turned into a pitched battle.

According to eyewitness accounts, the violence escalated rapidly as supporters from the Nkanchina and Nana Ntosah factions faced off with lethal weapons.

The roots of the violence lie in conflicting claims of land ownership.

The witness explained that the Nkanchina chief had formally granted permission for the extraction of gravel to facilitate the Dobong road works. However, this authority was challenged by another local leader, Nana Ntosah, who allegedly moved to forcibly halt the operations.

The situation spiralled out of control when Nana Ntosah reportedly dispatched heavy machinery to the site to seize control.

“Nana Ntosah reportedly sent payloaders to the site, but supporters of the Nkanchina chief resisted the move and prevented the equipment from operating,” the witness reported, describing the moments before the violence began.

The ensuing chaos saw the use of cutlasses and fire, leading to injuries and property damage:

Human Toll: Two individuals sustained severe cutlass wounds and were rushed to the Kpandai District Hospital, where they remain under medical supervision.
Arson: Six motorbikes belonging to workers and supporters were doused in petrol and set ablaze during the height of the riot.
Property Damage: Operations at the gravel pit have been completely suspended following the destruction of equipment and the onset of hostilities.
A swift deployment by the Kpandai District Police Command was necessary to restore a fragile peace and prevent the violence from spreading to the main township.

Armed officers have since cordoned off the gravel pit and the Dobong road project site to deter further incursions.

The Northern Regional Security Council (REGSEC) is expected to convene an emergency meeting to address the underlying chieftaincy tensions that have long simmered in the area.

Speaking on JoyNews’ AM Show, Mr. Nyindam said he has maintained distance from the NDC parliamentary candidate throughout several election cycles and the recent legal battle over his seat.

“The NDC parliamentary candidate, have you had a conversation with him? No. For five years now, I’ve never spoken to him,” he said. “Throughout the campaign and throughout this battle, I’ve not said a word to him.”

Despite the lack of direct engagement, the MP said he still considers his opponent a brother, given their shared roots in Kpandai in the Northern Region.

“We are all coming from Kpandai. We are brothers. That’s how I see him,” he noted. “But we don’t have that kind of friendship.”

Mr Nyindam, however, stressed that his relationship with other officials of the NDC remains cordial.

“His chairman, his secretary, and other party executives, we are good,” he said, adding that the strained relationship is limited to his main rival.

He accused the NDC candidate of promoting a divisive brand of politics that has negatively affected the constituency.

“The kind of politics he does and has brought to Kpandai is different,” Mr Nyindam stated. “He’s given everybody a hell in Kpandai. Not me alone. Even within the NDC, he has caused a lot of problems.”

The comments come in the wake of a January 28, 2026, ruling by the Supreme Court, which overturned a previous decision by the Tamale High Court that had annulled Mr Nyindam’s election and ordered a rerun.

The apex court’s judgment halted plans by the Electoral Commission to organise a fresh poll and cleared the way for him to resume his duties in Parliament.

The legal dispute began on November 24, 2025, when the Tamale High Court nullified his election victory and directed that a new election be held within 30 days.

Following that ruling, Parliament officially notified the Electoral Commission of a vacancy in the Kpandai seat.

Mr Nyindam, who represents the NPP in Parliament, said he remains committed to peaceful politics and development-focused leadership, despite the challenges.

“I’m not that type,” he said, referring to confrontational politics. “My focus is on serving the people.”

“For me, it is the injustice done to Nsala Wakpal,” the South Dayi MP, said on Joy News’ PM Express on Tuesday.

Mr Dafeamekpor insisted the NDC has not truly lost the case. He argued the Supreme Court’s decision was influenced by facts that were deliberately concealed.

“In fact, we haven’t lost well in the Kpandai case as the Supreme Court has been misled, because these material facts were all hidden from the Court,” he said.

He accused the NPP’s legal team of intentionally creating inconsistencies around key dates in the Electoral Commission’s gazette notification to strengthen their argument that the NDC went to court too early.

“The NPP lawyer stood in court, and when Justice Pwamang queried about the date inconsistency, they said it was a genuine mistake,” he said.

“But I have established over time that there was nothing genuine about this. It was deliberate.”

He explained that the alleged manipulation was intended to align the record with the NPP’s argument that the gazette notification was dated December 24, and that the NDC’s legal action was therefore premature.

“They had to do it to align with the NPP case, that the gazette notification was 24th December and, therefore, we went to court prematurely,” he said.

Dafeamekpor said the NDC filed the case based on an earlier official communication.

“Meanwhile, we went to court on the date Jean Mensa wrote to Parliament, 23rd December,” he said.

He argued the gazette situation at the time was already confused because of inconsistencies in the numbering of parliamentary seats.

“The gazette notifications were in a confused state, because the seat numbers had exceeded those constitutionally mandated,” he said.

“If you are gazetted 274 and you are gazetted another additional four, you have 278 seats. Where is the overlapping team coming from?” he asked.

He claimed steps were later taken to correct the gazette. “So they took steps to clean it up on the sixth of January,” he said.

But he accused the Electoral Commission’s representatives of later denying that January 6 publication and describing it as an error.

“Now he comes to court and denies the 6th January Gazette publication as an error and calls it a genuine mistake,” he said.

Mr Dafeamekpor rejected the suggestion that the inconsistencies were innocent.

“How can that be a genuine error?” he asked. He argued that the number of parliamentary seats is fixed and cannot be casually misstated.

“You can’t get numbers wrong, because the number of parliamentary seats is fixed,” he said. “There’s no fraction of seats in Parliament. It is either 276 or not.”

He said the EC had already communicated specific figures to Parliament, making the later contradictions harder to justify.

“When were you not allowing your head of institution to continue to communicate with Parliament?” he asked.

He insisted the conduct in the case raises serious concerns that must be investigated.

“There’s an original letter before Parliament that the gazette notifications were on the 23rd,” he said. “So you want the EC investigated. The EC has to be investigated.”

He said Parliament, the courts, and other investigative bodies can take up the matter. “Parliament can do that. CID can do that. Any investigating body can do that,” he said.

He revealed he intends to raise the issue formally in Parliament, but said the review process comes first.

“Because we are going for a review, I want us to settle the matter on review,” he said.

Mr Dafeamekpor also argued that the confusion over gazette dates extends beyond politics, as it affects a candidate’s legal right to challenge election outcomes.

“If they toy with the dates, they dance with it. If they collude with somebody to confuse you with the dates, your right to go to court will be affected,” he said.

“That’s exactly what is at play in this matter,” he added. He said this forms the basis of the review application.

“So, this is the basis for your review. This is the basis for our review,” he said.

The motor rider is alleged to have dropped the arms and ammunition when he saw he was being trailed by the police.

When the abandoned packages were opened, one A-Tac semi-automatic shotgun, two Jojef semi-automatic shotguns, and two boxes of cartridges containing a total of 500 BB cartridges were found, a police brief said on Friday.

It said on January 27, at approximately 1530 hours, the Ghana Police Service received intelligence about an unknown person on a blue Royal motorcycle allegedly transporting arms and ammunition to Kpandai.

It said a surveillance team was immediately deployed to monitor the motorcycle’s movement from the Obetsebi Lamptey Interchange toward the Agbogbloshie Bus Terminal.

On realising he was being trailed by police, the suspect reportedly dropped several parcels wrapped in black nylon bags and fled the scene.

Despite a coordinated search, police were unable to apprehend the motorcycle rider.

However, investigations are ongoing to identify and arrest the suspect.

Mr Nyindam noted that without the timely intervention of the Supreme Court, his seat could have been lost ahead of the proposed by-election. He also stressed that the declaration of the seat as vacant and the political activities in his constituency during that period were deeply troubling.

The Supreme Court recently overturned a Tamale High Court ruling that had annulled Mr Nyindam’s election as MP for the Kpandai Constituency, thereby restoring his position and confirming the validity of his victory in the December 7, 2024, general election.

Speaking on Joy FM’s Midday News on Wednesday, January 28, 2026, Mr Kpebu explained the Supreme Court review process.

“They [the NDC] can apply for a review. In the Supreme Court, you effectively have two chances: first, at the ordinary bench, and if your case is dismissed, you can file for a review.

However, most reviews do not succeed. Often, as lawyers, we may spot an obvious or glaring error, but it still fails to find favour in the court,” he said.

The comments follow the Supreme Court’s 4–1 majority decision quashing the Tamale High Court judgment that annulled the election of New Patriotic Party (NPP) candidate Matthew Nyindam. The apex court cited jurisdictional errors and upheld Mr Nyindam’s application, invoking its supervisory jurisdiction, effectively restoring him as Member of Parliament for Kpandai.

Despite the ruling, the NDC insists the matter is not closed. Majority Chief Whip in Parliament, Rockson-Nelson Deafeamekpor, said the party was “grieved” but emphasised that constitutional and legal avenues remain open.

“This is not the end. This matter is not the end. The ruling of the court will be filed according to the court’s own decision by February 6. Speaking in an interview on Joy FM’s Midday News, Mr Kpebu said the decision serves as a “serious warning” to legal practitioners.

“Lawyers have to look to be sure that they are calculating exactly from the date of the gazette notification. In this case, at one point, the NDC candidate argued that the Kpandai results were not gazetted in the original EC gazette notification. A fuller copy was done later, but with this decision, it appears that the argument did not find favour in the court, just like in the Ernest Kumi case,” he said on Wednesday, January 28, 2026.

He added: “Once the EC comes out with a gazette notification, whether your constituency is in it or not, that is the date that must be used for calculating the filing of an election petition.”

Mr Kpebu’s comments come after the Supreme Court, in a 4–1 majority decision, overturned the High Court ruling that annulled the Kpandai parliamentary election won by the New Patriotic Party’s (NPP) Matthew Nyindam.

The decision followed an application filed by Mr Nyindam, invoking the Supreme Court’s supervisory jurisdiction to set aside the High Court ruling on the grounds of jurisdictional error. The apex court upheld his application, effectively restoring him as Member of Parliament for Kpandai.

The central issue before the Supreme Court was the date on which the EC gazetted the results of the 2024 parliamentary election for the constituency. Under Ghana’s electoral laws, an election petition must be filed within 21 days of the gazette notification of results. A petition filed outside this 21-day window is deemed incompetent.

Mr Nyindam argued that the EC gazetted the results on December 24, 2024, and any petition filed outside the 21-day period from this date would lack jurisdiction. He further contended that the NDC candidate filed his petition before the Tamale High Court outside the deadline, rendering the High Court without jurisdiction.

The National Democratic Congress (NDC), however, argued that the election presented a special situation as the EC issued two gazette notices — one on December 24, 2024, and another on January 6, 2025. According to the NDC, the latter notice superseded the first, making it the operative date for calculating the filing period, and therefore the petition was properly filed within time.

The Supreme Court, however, ruled against the NDC’s argument, with the majority finding in favour of Mr Nyindam.

Speaking to journalists after the ruling on Wednesday, Majority Chief Whip in Parliament and NDC MP for South Dayi, Nelson-Rockson Deafeamekpor, said the party was “grieved” by the outcome but emphasised that constitutional and legal options remain open.

“This is not the end. This matter is not the end. The ruling of the court will be filed according to the court’s own decision by February 6. When we obtain the certified true copy and study it, we will advise ourselves. There is a review option, so this matter is not the end,” he maintained.

He urged party supporters, both in Accra and in the Kpandai constituency, to remain calm and law-abiding as the party evaluates its next course of action.

However, the Director of Legal Affairs of the NPP, Gary Nimako Marfo, has described the Supreme Court’s decision as clear, emphatic and final.

According to Mr Nimako Marfo, the ruling leaves no ambiguity regarding the legal position, explaining that the Tamale High Court judgment was lawfully quashed, thereby maintaining Mr Nyindam’s status as the duly elected Member of Parliament for the Kpandai constituency.

Addressing journalists after the court ruling on Tuesday, Mr Marfo, who doubles as Mr. Nyindam’s lawyer said the Supreme Court had removed all uncertainty surrounding the case.

“I think that the Supreme Court has spoken emphatically that the decision of the Tamale High Court was made without jurisdiction, and so the court has quashed it,” he stated.
“Honourable Nyindam still remains the MP for the people of Kpandai. That position is maintained.”

He explained that by quashing the High Court’s ruling, the apex court had lawfully preserved Mr Nyindam’s status in Parliament.

Mr Nimako Marfo also underscored the importance of respecting judicial authority, stressing that once the courts have spoken, all parties must comply with the outcome.

“When it comes to court, the decision goes one way or the other. You take the legal route, and the court has said thus. That should be it,” he added.

His comments follow a 4–1 majority decision by the Supreme Court to set aside the judgment of the Tamale High Court, which had earlier nullified Mr Nyindam’s election. The five-member panel was presided over by Justice Gabriel Scott Pwamang, who dissented from the majority.

The apex court’s intervention came after Mr Nyindam filed an application invoking the Supreme Court’s supervisory jurisdiction, arguing that the High Court committed a jurisdictional error in handling the election dispute.

After considering the application, the Supreme Court agreed, holding that the Tamale High Court acted without the requisite jurisdiction when it annulled the parliamentary election. The ruling effectively restores Mr Nyindam’s mandate and confirms him as the duly elected Member of Parliament for the Kpandai Constituency.

He noted that although litigation may produce winners and losers, the rule of law depends on collective respect for court decisions, especially after all legal avenues have been exhausted.

At the commissioning ceremony, the Medical Superintendent of the hospital, Dr Joseph Sonlaar, said the facility would serve residents of Kpandai and neighbouring enclaves that previously had limited access to standard mortuary services.

He explained that the project forms part of the hospital’s long-term vision to strengthen health infrastructure and enhance service delivery in the area.

According to Dr Sonlaar, the mortuary is fitted with modern equipment to ensure the dignified preservation of bodies while easing the emotional and logistical burden families face during bereavement.

He also noted that the facility would create employment opportunities for young people in the district, contributing to local economic growth.

“This mortuary complex includes a temporary holding ward, taking into account the concerns of our Muslim brothers, a main mortuary with cold rooms divided into VIP and general sections, offices, bathrooms and water closets, a bathing and dressing area, and a proper septic drainage system to address public health concerns. I wish to assure the people of Kpandai that we will deliver quality services with the support of a competent and dedicated mortuary staff,” Dr Sonlaar said.

Despite the achievement, he raised concerns about the absence of a dedicated power transformer for the facility, which he described as crucial to its effective operation.

He appealed to politicians, corporate bodies, benevolent individuals and other stakeholders to assist the hospital in securing a transformer to guarantee an uninterrupted power supply.

Dr Sonlaar added that reliable electricity would help maintain high operational standards and ensure the full benefits of the mortuary are realised across the district.

The mortuary has a capacity of between 350 and 400 bodies. Dr Sonlaar disclosed that the project was financed mainly through the hospital’s internally generated funds, with significant support from 24 dedicated health workers who committed their salaries to the project after proposals for external funding and bank loans were unsuccessful.

The General Secretary of the Evangelical Church of Ghana and Guest of Honour at the event, Bishop James Aluruba, congratulated the hospital’s management for its foresight and commitment to improving healthcare infrastructure in Kpandai.

He described the mortuary as a timely intervention that would bring relief to families and communities within the district and beyond.

Bishop Aluruba commended the hospital for its consistent responsiveness to the needs of the people and urged continued support from government, political leaders and the wider community to ensure the facility’s sustainability. He also pledged the continued backing of the church council for the ECG Hospital in Kpandai.

He said the apex court’s injunction was justified and prevents a potential waste of state resources.

The lecturer said this on JoyNews on Tuesday, December 16.

“It’s surprising, but it is a very fair decision of the Supreme Court. I think it is just right that they took this particular decision, and I say this on the basis that a certiorari application, if granted, would literally wipe out the entire judgment of the High Court.”

The rerun was suspended pending the determination of a certiorari application seeking to quash the initial court order that mandated the fresh election.

The lecturer affirmed that the court’s intervention, while unexpected given the advanced preparations for the rerun, was ultimately the correct course of action.

“Spending money, time in rerunning an election which could potentially be wiped out by a grant of a social application would not serve any use for the persons, for anyone.”

The lecturer was also particular about the protocol drama over inadequate preparation, which would have been caused in Parliament, provided the suspension was not granted.

“Indeed, it would also mean that whoever even emerges the winner of the election to be run on the 30th, assuming everything was to go on, would also have to leave parliament in a day or two right after he became a member of parliament. And then the old or former member of parliament returned to Parliament. That whole drama would not serve anyone’s interest. In fact, it becomes a useless exercise of judicial resources, and if you like public resources,” he explained.

Justice Abdullai believes the pause creates an opportunity for a more robust process.

“I think the Supreme Court, on this particular occasion, got it absolutely right, thought through all the options, and came out with arguably one of the best decisions that favors both parties. It’s a balancing decision that each party never goes home dry.”

The Supreme Court’s injunction has put the Kpandai rerun on hold with political parties and the Electoral Commission awaiting the court’s final ruling on the pending application.

The comments come ahead of the Supreme Court’s scheduled hearing on Tuesday of an application filed by Matthew Nyindam over the Kpandai parliamentary seat. Mr Nyindam is seeking to overturn a High Court judgement that annulled his 2024 election victory.

Responding to questions on whether all parties involved had been properly served with court processes, Mr Tanko disclosed that the NDC and its candidate, Daniel Wakpal, had not been officially notified as of Monday, December 15.

He added that he had personally contacted the party’s candidate, who confirmed that he was not aware of any service of process.

“I called him, and he said he is not aware and that he has not been served. So, well, let’s see what happens,” Mr Tanko added.

He further stated that since the NDC candidate has not been served, the hearing cannot happen.

Dankwah noted that the NDC’s challenge goes beyond headline numbers, pointing to signs of uncertainty within its support base, especially among women voters.

“If you look at those who voted for this candidate, some of the women are saying they are undecided. So, something is not right in NDC there,” he observed, adding that internal party divisions could cost the opposition if not addressed quickly.

However, this strong presidential backing has not translated into a clear lead for the NDC’s parliamentary hopeful, Daniel Nsala Wakpal. The race remains a statistical dead heat, with the New Patriotic Party’s (NPP) candidate, Hon. Mathew Nyindam, polling at 50% against Wakpal’s 46%.

The disconnect appears rooted in local priorities.

When asked what would most influence their vote, constituents pointed to jobs (34%), the economy (18%), and roads (15%)—issues they will weigh against the candidates’ local records and promises.

“The top issues which will influence voters’ choice on whom they would vote for are jobs, economy, and roads,” the poll summary stated, setting the stage for a campaign focused on local delivery.

The poll, which sampled 1,065 voters between December 11 and 13, 2025, shows 3% of voters are undecided, making them the key target for both campaigns in the final stretch.

The seat became vacant after the 2024 election result was nullified.

The final survey is scheduled for December 25-28, just days before voters return to the polls to determine if their positive national outlook will ultimately benefit the NDC’s local candidate.

Speaking in an interview on Adom FM’s morning show Dwaso Nsem, Mr. Nyindam said Parliament is meant to be a place where every MP can be heard, but he feels he has been denied that right.

“The Speaker has not been fair to me. When we talk about democracy and the rule of law, Parliament is where an individual should be heard. What he has done to me means he has not given me a fair chance,” Nyindam said.

He added that as Speaker, Bagbin should have protected him, recalling that the Speaker has previously witnessed and handled similar disputes.

“Even in the Gyakie Qyayson issue, he was there as the Speaker and witnessed the matter. Everyone who becomes an MP and has an issue in Parliament, the Speaker has seen it. So to treat me like this, I don’t know the motivation behind it,” he said.

Mr. Nyindam expressed confusion over the decision to contest his seat, insisting that he should have been allowed to present his side of the story.

“Whatever they took to court, I don’t understand why I am being treated this way. I don’t even know why they want to take my seat from me. At least allow me to tell my side, but they didn’t, and subjecting me to this kind of treatment leaves me speechless,” he said.

His remarks come after a Tamale High Court ruling annulled his parliamentary election victory and ordered a rerun in the Kpandai Constituency within 30 days. Following the ruling, Parliament formally notified the Electoral Commission (EC) of the vacancy.

In a letter dated December 4, 2025, the Clerk to Parliament, Ebenezer Ahumah Djietror, informed EC Chairperson Jean Mensa that the judgment delivered on November 24, 2025, necessitates a fresh election.

The notification, issued under Article 112(5) of the 1992 Constitution, officially triggers the electoral processes required for the rerun in Kpandai.

Speaking on the Joy Super Morning Show on Tuesday, Mahama Ayariga said the Minority’s attempt to block debate in the chamber ultimately worked against their own interests.

According to him, the law is clear that once a court orders a rerun of an election, the Clerk is mandated to notify the Electoral Commission (EC), unless a court order is in place to stay the judgment.

“What I know is that as the law is, the Clerk acted properly within the law. He cannot be faulted,” he said. “Once you don’t have an order of the court saying that its judgment should be stayed, the time keeps running. And as we speak, the Clerk, having communicated to the Electoral Commission, the 30 days have started running.”

He argued that the chaos that erupted in Parliament on Tuesday could have been avoided if MPs had allowed a proper discussion on the floor to enable the Speaker to give a ruling. 

Instead, he said, the Minority disrupted proceedings and blocked him from explaining the legal position.

“What the Speaker actually meant was that we should have allowed a discussion in the chamber in an atmosphere that would enable him to give a ruling. They prevented that from happening,” he said, adding that “they are the ones who have suffered the legal consequences.”

Parliament descended into confusion on Tuesday night after Minority MPs demanded an adjournment following Speaker Alban Bagbin’s decision to defer his ruling on the Kpandai seat matter. 

Minority Chief Whip Frank Annoh-Dompreh insisted no government business should continue until the issue was resolved.

But Speaker Bagbin ruled after a voice vote that proceedings would continue, prompting Minority MPs to chant and attempt to disrupt the sitting.

The tension follows a letter dated December 4, 2025, in which the Clerk to Parliament formally notified EC Chairperson Jean Mensa of a vacancy in the Kpandai Constituency. 

The notification was issued after a High Court ordered a rerun of the 2024 parliamentary election in the area.

Mahama Ayariga, who represents Bawku Central on the NDC ticket, said the Majority had every right to defend their candidate, just as the Minority had previously done in similar instances.

“They must be seen fighting for their own. They have forgotten that the person Nyindam defeated is also an NDC person, so we also have a stake in fighting for our own,” he said. 

“If you feel you should fight for your own, you think we shouldn’t be fighting for ours? How unreasonable could you be—especially when the law is on our side?”

He warned that preventing open debate on legal matters in Parliament would undermine the country’s democratic foundations.

“If we start allowing that, then we’ll be destroying the democracy,” he said.

The EC is expected to issue further directives as preparations begin for the ordered rerun of the Kpandai parliamentary election.

However, the petition challenging Nyindam’s victory was filed by the National Democratic Congress (NDC) candidate, Daniel Nsala Wakpal, on January 25, 2025—a significant 32 days after the Gazette publication.

This means the petition was filed 11 days after the legal deadline had expired.

Nyindam’s affidavit submitted to the Supreme Court emphatically states the jurisdictional error:

Mr. Darko added that the delay is severely affecting the legal rights of the sitting MP, who intends to file an appeal and has applied for a stay of execution of the High Court’s directive ordering a fresh election.

“It’s completely unacceptable. We haven’t been given time by the court for the application on stay of execution. This is a constitutional matter, and the people of Kpandai are being denied their representation,” he stated.

The dispute follows Justice Plange Brew’s ruling that annulled the results from all 152 polling stations in Kpandai and ordered a rerun within 30 days—a decision the Minority insists is questionable.

The pending re-run stems from a legal challenge to the 2024 Kpandai parliamentary results, a matter both parties have contested for months.

While the Speaker’s ruling temporarily halts the enforcement of the court decision, the Majority maintains that the political reality remains unchanged.

“The effect of the order, to my understanding, is that the EC is to conduct a rerun election within 30 days, implying that the original declaration of Hon. Matthew Nyindam as winner is invalid and the member is no longer an MP.”

However, Bagbin highlighted statutory provisions that prevent an immediate declaration of vacancy. Citing the Court of Appeal Rules, 1997 (CI 19) as amended by CI 132, he explained that Rule 27(3) imposes a mandatory seven-day stay of execution on all appealable High Court decisions.

He referenced legal precedents, noting that the Supreme Court in Mensah v GCB (2005–2006) held that any execution before the expiration of the seven-day window is “premature and void.” The Court of Appeal also reinforced this principle in Clenam Construction Ltd v Valcum Crest (April 7, 2022), emphasizing that the automatic stay allows the losing party time to consider an appeal.

Bagbin added that this statutory stay remains active until December 1, 2025, and the High Court ruling “cannot form the basis for the Speaker to instruct the Clerk to notify the EC that the Kpandai seat is vacant.” He further noted that if Nyindam chooses to appeal, additional procedures under CI 27(1) would apply.

His clarification follows calls from the Majority caucus for the Speaker to immediately declare the seat vacant, citing precedents such as former Assin North MP James Gyakye Quayson. Minority Leader Alexander Afenyo-Markin, however, insisted that Nyindam must not be barred prematurely and said the Minority will oppose any move that sidesteps due legal process.

When the Honourable Gyakye Quayson was ordered by the court to go through a re-run, members of this side, mainly led by the now Minority Leader, spoke vociferously against allowing him to continue in this House. Eventually, he had to leave. This is a path we have travelled. Precedent has been set. Nobody can tell us today that the Honourable Nyindam must have a voice in this House. It won’t happen,” he said.

Addressing journalists in Parliament, Minority Leader Alexander Afenyo-Markin dismissed the Majority’s call, stressing that Mr. Nyindam continues to hold his seat until all legal processes are fully exhausted.

“Let me speak directly to the people of Kpandai: your Member of Parliament remains the sitting MP for the Kpandai Constituency. He is a full Member of Parliament and a proud member of the Minority Caucus and the NPP,” Mr. Afenyo-Markin stated.

He added that until the court’s decision is fully finalized and proper procedures are followed, Mr. Nyindam’s status as MP remains unchanged.

This comes after Mr Nyindam reportedly prepared to contribute to proceedings.

The Majority Chief Whip, Rockson-Nelson Dafeamekpor, immediately rose to his feet, vowing to block any attempt by the annulled MP to debate.

Speaking on the floor of Parliament on Wednesday, November 26, he insisted that Mr. Nyindam can no longer be recognised as a Member of Parliament.

“Mr. Speaker, the High Court in Tamale has ordered that the outcome of the December 7, 2024, election, which brought Honourable Nyindam to this House as the MP for Kpandai, was flawed. Therefore, that election has been ordered to be rerun. Ipso facto, the Honourable Nyindam is no longer a member of this House,” he stated.

Dafeamekpor argued that Parliament has already been served with the court’s judgment and supporting documents, stressing that the House is bound by the ruling until overturned.

“The mere filing of an appeal or a stay of execution does not operate to stop the judgment of the court,” he added. “We will not allow Nyindam to continuously carry himself as an MP, and we will not allow him to speak.”

“Mr. Speaker, these are very serious matters,” Dafeamekpor said. “He cannot enter the chamber and even attempt to debate.”

The stance by the Majority follows Monday’s ruling by the Tamale High Court, presided over by Justice Emmanuel Brew Plange, which annulled the Kpandai parliamentary results and ordered a fresh poll within 30 days.

The criticism, by Rashid Tanko Computer, Deputy Director of Elections and IT for the NDC, comes in response to the NPP’s rejection of the Tamale High Court ruling, which annulled the 2024 parliamentary election in Kpandai and ordered a fresh poll following a petition by NDC candidate Daniel Nsala Wakpal.

The NPP has filed a notice of appeal and a motion for stay of execution, insisting that the ruling is flawed and that the original results remain valid.

Speaking on JoyNews’ The Pulse on Monday, November 24, Tanko Computer described the NPP’s move as premature.

“They [NPP] have spoken about going for an appeal and filing a stay of execution. But have they even looked at the reasoning behind the ruling?

“The judge just said our petition was upheld and that the reasoning will be given to us on Friday. You have not even seen it, and you’ve gone to file for appeal. What are you appealing for? So you see how interesting the NPP can be?” he said.

Speaking on Asempa FM’s Ekosii Sen, Mr. Nyindam claimed the National Democratic Congress (NDC) had signalled to constituents a week earlier that the court would call for a fresh election, raising suspicions about the outcome.

The MP, who won the election by a margin of 3,734 votes, insisted his victory was legitimate and fully backed by all pink sheets. He accused the NDC of attempting to disrupt the collation process after realising they had lost, alleging the party mobilised a group to cause chaos at the collation centre.

He also dismissed the NDC’s claims of irregularities in 41 polling stations, including allegations that some electoral officers failed to record ballot ranges or total vote counts on certain pink sheets.

“I know the love my constituents have for me, and I love them too. I am surprised, however, that I am not more shocked because if the elections had been rigged, I would be disturbed. I won by a margin of 3,734 votes, which is a significant victory. During the elections, the NDC realized they had lost, so they organized a mob to come and destroy things at the collation centre. Fortunately, we had our pink sheets,” he said.

According to Nyindam, out of 152 polling stations, only two lacked signatures from party agents—one from the NDC and one from the NPP.

“For security reasons, we went to the regional EC office for the results to be declared, but the NDC refused to cooperate. They raised objections for 41 polling centres where I won, claiming irregularities. They alleged that electoral officers had not indicated allocation ranges or recorded total votes on some pink sheets. Out of 152 polling stations, only two were objected to by agents: one from the NDC and one from the NPP,” he explained.

Nyindam added that the NDC’s early announcements about a rerun had prepared him for the ruling. “I’m not surprised because a week before today, they started announcing in the constituency that they were going to rerun the elections. We work with the law, so we prepared the appeal,” he said.

Meanwhile, the NPP has officially rejected the court’s judgment, describing it as fundamentally flawed. The party has filed both a notice of appeal and a motion for stay of execution as it seeks to overturn the decision.

In an interview with Adom News, Nana Atorsah II expressed frustration over what he described as years of neglect by successive governments.

He said residents of Kpandai are fed up with unfulfilled promises and will no longer support leaders who fail to deliver meaningful development.

“Why should we continue to vote for you while you drive in big cars, spending our money, yet refuse to fix our roads?” the chief lamented, voicing the anger of his people.

He explained that the poor road network has crippled economic activities, disrupted transportation of goods and services, and made access to healthcare and education extremely difficult for residents.

The chief also appealed to the Minister of Energy to address the persistent low voltage and unreliable power supply that has plagued Kpandai and its neighbouring communities. According to him, the unstable electricity has negatively impacted local businesses and slowed the area’s growth.

“We are pleading with the Energy Minister to help fix the low current situation. Our people deserve stable power to improve their livelihoods,” he stated.

Nana Atorsah II reaffirmed his commitment to advocating for the welfare of his people and urged the government to prioritize infrastructure and energy development in rural communities like Kpandai.

Beyond the schools, over 20 houses have been destroyed, leaving many residents displaced and suffering economic losses.

ASASE 91.5 FM, an affiliate of Adom 106.3 FM, was also hit, with its transmission tower completely crushed.

The station manager confirmed the destruction and called for assistance to restore operations

At Buya Basic School, the storm ripped off the roofs of classroom blocks, leaving both students and teachers stranded.

Many expressed concern over their losses and appealed to the Member of Parliament for the constituency, Hon. Mathew Nyindam, as well as the government, NGOs, and other stakeholders, to provide immediate relief and support.

The NPP Constituency Chairman for Kpandai, Mr. Kennedy Gyato, speaking on behalf of the MP, assured residents that their concerns would be relayed for urgent attention.

He also called on benevolent organizations and the government to assist those affected.

Despite the extensive damage, no casualties were recorded.

The agitated crowd, armed with bottles and sticks, threatened to burn down the building if the Electoral Commission (EC) declared Nyindam the winner.

The situation escalated, with Biometric Verification Devices (BVRs) being taken away and some ballots destroyed during the fracas.

Military personnel were swiftly deployed to the scene to restore order and prevent further destruction.

The incident has added to the tension in the constituency as the nation awaits the final election results.

Authorities are yet to issue an official statement on the incident.

Residents in these communities, especially during the dry season, face acute water shortages.

Mr. Nyamah secured support from the Ghana National Gas Company Limited and the Public Utilities Regulatory Commission (PURC) to address the issue.

Speaking at Nkanchina Nursing College, Mr. Nyamah expressed satisfaction in fulfilling his promise to address the water challenges faced by the communities and pledged to continue serving the people in the Kpandai Constituency.

“I am truly personally satisfied for living up to my words as a principle bequeathed to me by my late father who said ‘Don’t use your mouth to promise what you can not fulfill’ This is to his memory,” he said.

The District Chief Executive of the Kpandai District, Kofi Atta Emmanuel Tatablata inaugurated five (5) member committees in every community for the management and maintenance of the projects to ensure their sustainability.

Students of Nkanchina Nursing College expressed their happiness as their long search for potable water is finally over.

Residents from the communities also expressed their gratitude to Mr. Nyamah for alleviating their plight.

The items donated by Muslims communities in the Northern Region were to be distributed to persons affected by the Akosombo dam spillage, especially in Lonto and Kpadjai in the Kpandai District.

The Kpandai district NADMO Director, Peter Nayo Nyarko, in an interview with Adom News said the MP assisted in bringing the items from Tamale which include bags of rice and clothes to kpandai but rather sent the items to his house at Katiajeri without discharging the items at their NADMO office in Kpandai the district capital.

The MP’s reason, Mr Nyarko revealed is that, he paid for the truck which transported the items from the donors from Tamale to Katiajeri in the Kpandai district, including its loading hence must be paid GH¢6,500 before releasing the items.

This, Mr Nyarko described as thievery leading to the heated exchange with the MP.

Meanwhile, the MP for Kpandai constituency, Daniel Nsala Wakpal has refused to comment on the issue.

Modern slavery in various forms are depriving many people, especially women and children, of their fundamental rights and freedoms. The International Labour Organisation estimates that almost 50 million people, or one in every 150 worldwide, are in situations of modern slavery.  

It is at the back of this statistics that the Program officer, Action Aid Ghana in the Northern Region has implemented the Combatting Modern Slavery project with funding support from the Norwegian Agency for Development Corporation (Norad) to support women in the northern region.  

She added that centuries on from the abolition of slavery in major economies worldwide, enforced labour is still a huge problem and to address these human rights abuses, ActionAid Ghana and Ethiopia have been undertaking the project to implement measures to prevent, identify and protect vulnerable groups and victims of modern slavery. 

Mrs. Beatrice Biije made the comments while handing over the startup material to 20 project beneficiary in the Kpandai District.

The beneficiaries received various start up kits from various training such as, Soap making, Vegetable farming, Animal Rearing, among others.

She said businesses have also been engaged and trained to implement anti-modern slavery measures to prevent, identify and tackle the use of human trafficking and forced labour, including the worst forms of child labour, in their own operations and supply chains. 

Some of the beneficiaries in an interview with Adom News thanked Action Aid Ghana for the kind gesture and also promise to use the items judiciously for intended purpose.

Finally, the District Director of Kpandai District Assembly also in an interview with Adom News acknowledged the partnership of Action Aid Ghana and the District Assembly for the past five years and also assured the Assembly’s full support towards action Aid in the District.

He also seized the opportunity to call on the beneficiaries not to sell the items given to them but rather use them judiciously for their intended purpose.
