Tuesday morning, a panel of Justices Angelina Mensah Homiah, Emmanuel S. Amedane, and Douglas Seidu dismissed Mr. Agyapong’s application for a stay of proceedings.

The Court reasoned that even if the High Court trial proceeds to judgment, such judgment would not be rendered nugatory should his interlocutory appeal succeed.

Lawyers for the plaintiffs, led by Samson Lardy Anyenini, had urged the court to impose hefty costs, describing the application as part of deliberate delay tactics that ought to be punished.

Counsel for Mr. Agyapong, Raphael Agyapong, pleaded for a reduction, and the Court eventually awarded GH¢10,000 against the former MP.

This marks the second failed attempt by Mr. Agyapong to stall the trial. His earlier application for stay of proceedings, filed in 2023 after the trial began, was dismissed by the High Court for being frivolous.

Background to the Case

The defamation suit stems from allegations made by Mr. Agyapong in July 2021, when he repeated claims, including that the Multimedia Group had demanded money from the government and harboured a vendetta against it.

The company described these as false and defamatory statements and announced its decision to sue, citing reckless attacks on its reputation and journalists.

The plaintiffs argue that the High Court was right to admit evidence of similar defamatory comments made by Mr. Agyapong in 2011, for which he retracted and apologised, but repeated in 2021. They contend that the repetition compelled them to sue, making the earlier conduct relevant to the case.

Trial Resumes

On 27th January 2026, the case resumed before a new judge, Justice Sedina Agbemava. The plaintiffs and their counsel were present, but the defendants and their lawyers were absent. The court adjourned proceedings to 11th February 2026, when it adopted prior testimony and continued the trial.

With the Court of Appeal now dismissing the stay application, the path is clear for the High Court to continue hearing the substantive defamation claims against Mr. Agyapong.

“I’m constructing an ICT facility, which, being named after him, was conceived five years ago; it’s a big project,” he stated.

He also commented on the attention Kennedy Agyapong received after polling 644 votes in the NPP presidential primary, compared to Dr. Mahamudu Bawumia’s 79 votes.

Some observers suggested that, although Afenyo-Markin did not publicly campaign for Agyapong, he may have influenced the outcome in his constituency.

According to the defence, the Court of Appeal found that the earlier High Court judgment was flawed due to what it described as a statutory breach that was “fundamental” and went “to the root, the very core” of the case.

While the specific nature of the breach is expected to be clarified in the full written judgment, the appellate court’s finding was sufficient to nullify the High Court’s decision and pave the way for a fresh hearing.

Background to the Case

The dispute began when Mr Baako, as plaintiff, sued Mr Agyapong for defamation. The High Court subsequently ruled in favour of Mr Baako.

However, Mr Agyapong’s legal team challenged that decision on appeal, raising, among other issues, concerns relating to statutory compliance and limitation periods.

“He is the plaintiff, but there is also a statute of limitation, so we are waiting,” counsel remarked, suggesting that questions surrounding the timeliness of the action formed part of the defence’s argument.

The lawyer also revealed that attempts had been made to settle the matter amicably.

“We tried to settle when Sir John was alive. We tried all means, but there was no success,” he said, referring to the late Sir John, a prominent political figure in the New Patriotic Party (NPP).

Refund and Next Steps

As part of its ruling, the Court of Appeal directed that all payments made to Mr Baako under the High Court judgment be refunded within 30 days. The order effectively resets the financial and legal positions of the parties pending the retrial.

Responding to the claims on Top Story, Fred Tetteh, Deputy Director of Research at the EC, dismissed the assertions as baseless.

“There is no iota of truth in what has been being circulated. That’s what I can say for now,” Tetteh stated on Friday.

The dismissal follows a press release from the Agyapong campaign, which called for heightened vigilance from the EC and the Ghana Police Service.

The statement alleged that, due to a shortage of official vehicles, the EC was using approved private vehicles to convey ballots, but cited “isolated incidents” in three regions where papers were allegedly moved without proper branding or escort.

According to Prophet Worlasi, the angel took him through a vision in which he initially believed Kennedy Agyapong had won the contest.

“I saw a whirlwind carry my spirit to another place. I noticed Kennedy Agyapong leading a congregation in celebration, and I thought the angel was showing me Ken’s victory. But the angel told me no,” he recounted.

He explained that the angel later showed him a voting scene where supporters of Kennedy Agyapong eventually switched allegiance to Dr Bawumia.

“He took me to a place where people were voting. Some were wearing Kennedy Agyapong’s attire, but after voting, they changed into Bawumia’s clothing. The angel told me that this would be the final outcome of the election — that Bawumia would be elected as the next flagbearer of the NPP,” he claimed.

The pastor further alleged that Kennedy Agyapong is facing spiritual opposition due to past actions, stating that “even the land has rejected him.”

“There is no way Kennedy Agyapong can win this contest,” he insisted. “Many things are working against him spiritually. His actions have created obstacles, and because he has not apologised for them, these issues continue to follow him.”

Prophet Worlasi said he has since received additional revelations reinforcing his claim.

The defamation case was filed by the Chief Executive Officer of The Multimedia Group, Kwasi Twum, and Joy FM against former Assin Central Member of Parliament, Kennedy Agyapong.

In 2021, The Multimedia Group sued the former lawmaker, his media organisation, and three of his employees over alleged defamatory statements made against the company and some of its staff.

The suit seeks, among other reliefs, an order compelling the defendants to substantiate the allegations made.

The court had earlier exercised its discretion in 2023 to put the trial on hold after dismissing an application for a stay of proceedings, pending an interlocutory appeal filed by Mr. Agyapong shortly after the trial commenced on October 17, 2023.

However, the court later indicated its readiness to resume the trial after it emerged that the defendants were no longer actively pursuing the appeal at the Court of Appeal.

The case has now been adjourned to February 11 for the adoption of proceedings and continuation of the trial.

Mr Dankwah noted that the wide margin points to a solid support base for Dr Bawumia, making it unlikely that any late surge by rival contenders would significantly alter the outcome of the contest.

Speaking on Asempa FM’s Ekosii Sen, Mr Dankwah explained that his firm’s daily tracking polls showed a sharp decline in Agyapong’s numbers immediately after videos of his attacks went viral.

“Towards the last month of the campaign, Kennedy Agyapong lost a bit of concentration, and by the last week, it became worse. The videos of his attack on Bawumia—when it happened on Monday, by Tuesday we saw him collapsing in our numbers,” he said.

Global InfoAnalytics conducted continuous polling between December 29 and January 23, sampling about 500 NPP delegates daily from Monday to Friday.

According to Mr Dankwah, the firm had the advantage of observing shifts in voter behavior in real time.

“Monday to Friday we do the polls, sampling 500 people daily, and it was very dramatic. We saw clearly what was happening,” he noted.

He explained that the controversial video did not energize Agyapong’s base as some supporters expected, but instead alienated many delegates uncomfortable with his open attacks on a leading party figure.

“So anybody who thinks the video gingered the base doesn’t know the NPP delegates,” Mr Dankwah stressed.

He revealed that as Agyapong’s support dropped, Abetifi MP and fellow contender Bryan Acheampong experienced a noticeable surge.

“Between the 16th and the 23rd, Bryan jumped and benefitted directly from Ken’s fall. The last five days of the polls showed that clearly,” he said.

Mr Dankwah added that Global InfoAnalytics released its full report on January 23, by which time the damaging video had already been widely circulated and its impact fully reflected in their data.

“We issued the full report on the 23rd and the video was already in circulation. Because we poll daily, we have the luxury of seeing in real time what is happening,” he explained.

He dismissed suggestions that the footage energized Agyapong’s base, insisting that NPP delegates reacted negatively instead.

The former Assin Central MP faced scrutiny after launching a series of attacks over comments made by Ashanti Regional NPP Chairman Bernard Antwi Boasiako, popularly known as Chairman Wontumi, which were wrongly attributed to Dr Bawumia.

Despite the backlash and calls for an apology, Dr Bawumia remained calm and urged his team to stay focused on the campaign.

“As a native of Assin Dompim, my degree is a qualification by experience. So immediately they gave me the document, I started reading,” he stated.

Mr Agyapong explained that his main concern was a clause which, he said, compelled candidates to accept the election outcome even if they believed the process had been flawed.

“When I got to point two on the document, it instructed us to sign and agree that, however the election goes, whether you’ve been cheated or not, you should accept it. That’s where I questioned the document because of precedence,” he said.

He pointed to what he described as irregularities in the 2023 NPP primaries to justify his stance.

“The last time someone was given 100 per cent, and in that area I got 92. In Nchumuru, I got 104, but I was given 14. In Bunkpurugu, I was given zero, although two people testified that they voted for me,” he said.

“All these happened in the past, and then today you put a document before me that I should sign. I said I won’t sign. If you don’t correct some things that went wrong, I won’t sign.”

He added that experience had taught him not to sign documents blindly.

“The so-called knowledgeable men signed. That’s how they go to the World Bank to drink tea and sign their death warrant. I am speaking to you from experience,” he added.

He noted that circumstances have since changed, making it possible that Mr Agyapong may not achieve the same percentage he recorded in 2023.

Mr Kyei-Mensah-Bonsu also expressed confidence in former Vice President Dr Mahamudu Bawumia, saying his message resonates strongly with party members.

“Sometimes, the loudest team does not win; rather, it’s the one that is well prepared. The message that Bawumia carries resonates with the people,” he said.

When host Evans Mensah challenged the claim that the “whole nation” wanted Kennedy Agyapong, Mr Amewu doubled down, pointing to what he described as the candidate’s electoral advantage.

“The competitive advantage Kennedy has for me, which makes me side with him in this particular election, is the call by the citizens that are going to vote,” he said.

He explained that elections are shaped by key swing factors, which he said account for between 65 and 70 per cent of electoral outcomes. These include both external factors, such as economic performance, and internal attributes of the candidate.

“The internal ones have to talk about the empathy of the individual, his leadership skills, his level of collaborations, his attentiveness, his vision,” he said.

After weighing these factors, Mr Amewu said Kennedy Agyapong stood out.

“When I have examined all these other five candidates, the best among them, the one that is most competitive in terms of this internal environment issue, is Kennedy Ohene Agyapong,” he said.

He added that his assessment was informed by direct personal engagement with the Assin Central MP.

“Most people may not have a direct relationship or have dealt with Kennedy directly. I have had this opportunity with my experience as a minister and MP,” he said.

While maintaining that the other contenders were strong, Mr Amewu said the 2028 election would test political weight and public backing in a way that favours Kennedy Agyapong.

“When it comes to the 2028 election, they may not be on the same level of platform with Kennedy in terms of the weight that people may have behind him,” he said.

“And so I think that Kennedy has this competitive advantage over the others,” he added. “This basically explains the rationale. I think Kennedy is the best.”

The comments come as the NPP begins early conversations about its future leadership following its loss of power, with several senior figures already being mentioned as possible flagbearer candidates for the 2028 polls.

Kusi also claimed that electing Dr. Mahamudu Bawumia as flagbearer would likely result in another defeat for the NPP in 2028, arguing that Bawumia lacks a compelling message to persuade Ghanaians to give the party another mandate.

“After the elections, we all saw the results and weren’t happy. I went down to my constituents because I believe that to win any elections, you need to listen to minds and ideas,” she said.

Feedback from her constituents, she explained, highlighted key shortcomings, particularly the party’s failure to consider public sentiment on governance and national issues.

“I asked where we went wrong and what we could do differently. They told me one major fault was not listening to their views on governance and national matters,” she said.

According to Hon. Osei-Asare, the call for Kennedy Agyapong’s leadership came directly from the grassroots.

“I didn’t embark on this journey alone. My constituency executives and I agreed, and they are asking for me to bring Hon. Kennedy Agyapong so we can ensure victory in this constituency,” she said.

She stressed that effective leadership must be built from the base and guided by the will of the people.

“Every win starts from the base. My people have given me the opportunity to serve them, so I must listen to them,” she added.

Beyond her constituency, she said nationwide sentiments favor a candidate who is direct, pragmatic, and firm on discipline within the party.

“Currently, the country wants someone who is pragmatic, says it as it is, and can restore discipline within our party. I believe the discipline level has declined,” she noted.

Hon. Osei-Asare described Kennedy Agyapong as a politician known for honesty and firmness.

“Everyone stands for something, but for him, he stands for honesty and discipline,” she said.

Touching on youth participation, she emphasized that honesty and discipline would help the NPP regain the confidence of young voters, who form a significant portion of the electorate.

“Young people are more interested in jobs and opportunities than party loyalty. Kennedy Agyapong’s business background positions him to address these concerns,” she said.

She further linked his vision to the NPP’s industrialization agenda.

“He knows the business landscape and, with the industrialization drive through policies like 1D1F, we can champion even more ideas,” she said.

Hon. Osei-Asare revealed that Kennedy Agyapong’s visit to her constituency left a strong impression on residents.

“He came to my constituency and opened their eyes to the possibilities one can achieve,” she said.

He argued that the same principle applies to the presidency, adding that suggestions that Kennedy Agyapong is unfit for the role are unfounded.

He also noted that Ghana is even considering reducing the presidential age threshold to 30, underscoring his view that leadership potential is broad.

Dr. Sarpong said criticism against Mr. Agyapong often arises from how people feel treated rather than a full appreciation of the context in which he speaks.

He revealed that he has listened to several recordings of the presidential aspirant’s statements and believes many of them were made while defending the party. “Sometimes we jump into conclusions without listening to them completely,” he said.

Dr. Sarpong added that leadership involves managing people with firmness when necessary, noting that even when an employee faces dismissal or transfer, professional engagement can still take place.

“Even for me, when I want to fire someone from a job, I can have breakfast with them before that, or when it comes to transfer. Sometimes, I can engage someone to also talk to them. It is all about managing people,” he stated.

He also spoke about his theological background, disclosing that he is an alumnus of Trinity Theological Seminary. According to him, pastoral ministry carries responsibilities, and those who wear clerical attire are held to higher standards of conduct.

“For now, I can do whatever I want, but once I put on the clerical, things will take a different turn,” he said, adding that pastors should accept accountability when concerns are raised rather than interpret them as insults.

His comments come ahead of the NPP presidential primaries on Saturday, January 31, 2026, as campaign teams intensify advocacy for their preferred candidates.
