Speaking on Asempa FM’s Ekosii Sen show, Awuku said he had listened to arguments from both sides in court and was impressed by the quality of submissions from Nyindam’s legal team, noting that they were well-supported by decided cases.

He added that, just as Ernest Kumi prevailed in a similar case, he believes Matthew Nyindam will also be vindicated.

“I pray that as we listen to the arguments from both sides in court, we refrain from making premature conclusions and instead await the judgment. If you examine the quality of the arguments presented by the counsel for Matthew Nyindam, who referenced various decided cases to support his points, and contrast that with the arguments made by the other party, the NDC, you will see the difference,” he said.

“I trust that the judges will perform their duties diligently. I am confident, and it is my hope and prayer, that Matthew Nyindam will achieve the same victory that Ernest Kumi was able to secure,” Awuku added.

The Director of Legal Affairs for the New Patriotic Party (NPP), Gary Nimako, has disclosed that the late Ernest Kumi, former Member of Parliament for Akwatia, had intended to resign from Parliament just six days before his untimely death.

In January 2025, the Koforidua High Court had placed an interim injunction on Kumi, preventing him from being sworn in as MP for Akwatia. Despite the ruling, he went ahead with the swearing-in, prompting the court to cite him for contempt and issue a warrant for his arrest. In June 2025, however, the Supreme Court overturned the ruling, affirming his legitimacy as a legislator.

Speaking on Joy News on Tuesday, September 2, Mr. Nimako revealed that Kumi had grown frustrated by continuous harassment in his constituency and had confided his wish to quit politics.

“Ernest Kumi said that he wants to resign from Parliament. Are you aware? He said he was tired because of the harassment they were doing to him at the constituency. He was tired; he wants to resign from Parliament and go and stay at home,” Mr. Nimako stated.

He further emphasized the sincerity of his disclosure:

“Do you know I am an ex-seminarian? I went to Catholic school to become a Catholic priest. Ask my people who were with me, they will tell you. I will tell the truth to you, and the truth will set me free.”

Reflecting on the emotional strain Kumi endured before his death, Mr. Nimako added:

“The gentleman was harassed and over-harassed. Six days before he died… He said he was tired.”

Kumi’s sudden passing led to the Akwatia by-election, which was subsequently won by Bernard Bediako of the National Democratic Congress (NDC).

Dubbed “Se Asa”, meaning “It is finished”, the event saw participants walk through the principal streets of Akwatia and Boadu in the Eastern Region, culminating in final prayers at the constituency party office.

The vigil drew a large gathering of youth, members of the New Patriotic Party (NPP), and representatives from other political parties.

During the event, youth and political party leaders shared heartfelt memories of the late MP in interviews with Adom News, expressing their sorrow over his untimely death and the void his absence has created.

They described Ernest Yaw Kumi as a dedicated leader whose impact will be deeply missed.

According to Mr. Addo, the MP was actively engaged in plans for a thank-you tour across the constituency following the recent conclusion of a Supreme Court case that challenged his election.

“We were preparing to officially thank the people, the chiefs, and elders of Akwatia. Because of the court issue, we had delayed the thank-you tour. Now that the Supreme Court had ruled in his favour, we had finally begun planning.”

He said over the past weekend, which coincided with the traditional Akwasidae festival, there were a number of programmes lined up and he had spoken to the MP to confirm his participation.

“I called him to find out if he could make it to Akwatia because he had travelled to Takoradi,” Mr. Addo said. “He told me he was tied up and wouldn’t be able to attend.”

Later on Sunday evening, Mr. Addo received a message from Mr. Kumi confirming that he had arrived home safely.

“That was our last conversation. I never imagined it would be the last time I would hear from him,” he said, holding back tears.

The news of Mr. Kumi’s sudden passing on Monday, July 7, came as a complete shock.

Mr. Addo, in an interview on Adom FM’s morning show Dwaso Nsem, said he received several calls while at the constituency office but initially ignored them, thinking it was routine.

However, when the calls persisted, he decided to follow up.

“I tried calling his phone, but there was no answer. I called his wife too, but she didn’t pick up either. Eventually, I reached out to our former DCE who broke the news. He said Ernest had complained of chest pains early Monday morning, and not long after, he was gone.”

Upon hearing the tragic news, party executives rushed to the Lashibi Funeral Home, where they confirmed the MP’s death.

“We saw his lifeless body on the floor. It was heartbreaking,” he said.

Mr. Addo described Ernest Kumi as a humble, determined, and peace-loving individual.

“He wasn’t just my MP; he was like a younger brother. We’re from the same town. He was cool, respectful, and very committed to his work. People saw him as soft, but he was tough and focused.”

According to him, the party in Akwatia was built around Ernest Kumi’s leadership and vision.

“He wasn’t wealthy, but he supported many people in the constituency. He had suffered before becoming an MP, and it’s painful that just few months into his first term, death has snatched him away.”

“He was a go-getter. Not violent, not envious, always ready to help. We are shattered. Death has been unfair to us. But we can’t question God. As leaders, we have to encourage ourselves and keep moving.”

Mr. Kumi passed away at the age of 40 after a brief illness. He is survived by a wife and three children.

Speaking on Asempa FM’s Ekosii Sen show, Mr. Adjei revealed how he was informed of the tragic development and recounted his last moments with his friend.

“I’m devastated and hugely troubled because Ernest was not just a colleague politician, he was a personal friend. Life is indeed a journey, and I will learn a lot out of this,” he said emotionally.

According to him, he was in a meeting when Ernest’s wife called to inform him that the MP had been rushed to the hospital.

“I was at the office in a meeting when his wife called to say he was not feeling well and had been taken to the hospital. I was shocked because I had just spoken to him the day before,” Mr. Adjei narrated.

He revealed that Ernest had attended a funeral in the Western Region over the weekend and had told him he was back in Accra safely.

“When I got to the hospital, his wife hugged me and burst into tears, saying, ‘Your friend is lying down lifeless.’ I was heartbroken. I sat there with her, and looking at him, you wouldn’t even believe he was gone.”

Mr. Adjei, who was clearly struggling to come to terms with the loss, said Ernest was preparing for his moot exercise at the Ghana School of Law scheduled for Friday, July 11.

“He told me about it just yesterday. He was so full of life, so ready. This is a big blow.”

Despite being on opposite sides of the political divide, the National Democratic Congress (NDC) communicator stressed the strong bond he shared with the late MP.

“This is beyond politics. We were close friends even before we came to power. And it shows, because once the news broke, people from both the NDC and NPP rushed to the hospital. His human relationship was unmatched.”

He added that he is currently at the Lashibi Funeral Home, where the MP’s body has been taken.

“To his wife and three children, I say God strengthen you. May God preserve his soul. This is a big loss—not just to the NPP or Parliament, but to Ghana.”

The unexpected demise of Ernest Yaw Kumi has shocked Parliament and Ghanaians at large.

A first-time lawmaker with a bright future in law and politics, his passing has left many in disbelief and mourning.

“Sometimes, it’s even hard to believe what the Bible says — that we should give thanks to God for everything,” he said. “How do you thank God for something like this? It’s painful. But the Bible says we must give thanks, so we do, even when it’s hard,” he mourned.

Nana B recounted how he received the news during a National Executive Committee meeting at the party’s headquarters on Monday morning.

“We were discussing matters about Ablekuma North when our Director of Administration and Finance showed me the news on the internet. I was shocked and heartbroken,” he said.

According to him, the atmosphere in the meeting changed completely.

“I later saw the Regional Chairman returning to the meeting in tears. We had to pause everything. Executives like our General Secretary, Minority Leader, and other senior members were all visibly crying. That tells you how deeply this has affected the party,” he added.

Nana B praised the late MP for his dedication and intellect, noting that Ernest Kumi was one of the party’s most promising young politicians.

“He was a very brilliant and intelligent young man — deep in his submissions and hardworking. He had just overcome a legal battle regarding his seat and was ready to make his mark in Parliament. Unfortunately, that opportunity has been taken from him,” he lamented.

“This is a big blow to the NPP and Parliament. We’ve lost a rising star.”

The details surrounding Mr. Kumi’s death remain unclear, but reports indicate he died after a short illness.

A five-member panel led by Justice Gabriel Pwamang questioned whether Kumi had purged himself of contempt before seeking relief from the Supreme Court.

“We are all superior courts, and we are aware that the High Court in Koforidua made orders in the nature of contempt. If you are in contempt, you would purge yourself. You don’t avoid answering it and then you’re given a hearing,” Justice Pwamang stated.

Kumi’s counsel, Gary Nimako Marfo, argued that the High Court had disregarded documents filed by his client and that the Supreme Court motion predated the contempt ruling.

However, Bernard Bediako, counsel for the first interested party, countered that Marfo had already filed another motion seeking to overturn the contempt judgment.

Kumi, who was absent from proceedings, was represented by Minority Leader Alexander Afenyo-Markin.

After a brief recess, the court adjourned the matter to March 12 and ordered all parties to file written submissions within seven days.

The Koforidua High Court presided over by Justice Emmanuel Senyo Amadehe on Wednesday, February 19, 2025, issued the conviction.

The ruling also resulted in a bench warrant for the MP’s arrest after he allegedly defied an interim injunction preventing his swearing-in on January 7, 2025.

However, Mr. Kumi’s lawyer, Gary Nimako Marfo has argued that Justice Amadehe erred in law by assuming jurisdiction over the Akwatia parliamentary election petition despite the failure of the Electoral Commission’s(EC) to publish a Gazette notification of the results.

The legal team contends that this omission rendered the petition filed on 31st December 2024 legally incompetent, as it failed to properly invoke the High Court’s jurisdiction.

The MP’s lawyers further accuse the judge of bias and violating natural justice principles by proceeding with the contempt hearing, even though a motion challenging the court’s jurisdiction was pending.

They assert that Justice Amadehe unfairly denied Kumi’s legal team a hearing, arguing: “The learned High Court Judge was biased and highly prejudiced against the Applicant when he, among others, refused to grant Counsel for the Applicant audience on the basis that Counsel had not filed ‘Appearance’ in the Contempt application.”

As part of its reliefs, Kumi’s legal team is urging the Supreme Court to declare the entire proceedings void, contending:

“The Petition filed by the 1st Interested Party [Henry Boakye-Yiadom] on 31st December 2024 in the absence of the Gazette Notification is incompetent, and any Order founded on it is void and of no effect.”

Additionally, they seek an order to quash the contempt ruling and bench warrant issued on 19th February 2025.

Meanwhile, the Supreme Court is yet to schedule a hearing date for the application.

This conviction stemmed from Kumi’s decision to disregard an interim injunction that barred him from being sworn in as a legislator.

Presiding Judge Justice Senyo Amedahe not only issued the conviction but also a bench warrant for Kumi’s arrest after he failed to appear for sentencing.

The court had earlier ruled that Kumi should not take the oath of office until a related legal matter was resolved; however, he proceeded with the swearing-in despite the directive.

The ruling highlighted substantial evidence of willful defiance, leading the judge to conclude that Kumi’s actions amounted to contempt.

An official letter from the Minority Caucus explaining Kumi’s absence from the hearing was dismissed, reinforcing the court’s stance that he had disregarded its authority.

With the bench warrant now in effect, relevant authorities are expected to carry out the arrest.

Addressing the media on February 19, Afenyo-Markin described the court’s directive as a concern for the Minority Caucus, expressing dissatisfaction with the ruling.

“I am aware of the Koforidua High Court decision. We are yet to procure the court ruling and the orders of the court. The lawyers are going to brief the caucus, and we will come out with our position on the matter. Meanwhile, all necessary steps will be taken to ensure that our colleague is law-abiding and that the right thing is done.

“But we have to say that we are dissatisfied with the approach and we think that he has been treated unfairly. We will come out fully with our position when we receive full briefing from our lawyers,” he stated.

According to Ernest Kumi, the National Democratic Congress (NDC) would have averted such needless death if it had disbanded the Hawks.

His comment follows a shooting incident at the office of the Ashanti Regional branch of the NDC which led to the death of one and another seriously injured.

The incident happened during an altercation between the party’s taskforce and vigilante group, the Hawks. The National executives including the chairman, Samuel Ofosu Ampofo and General Secretary, Johnson Asiedu Nketia escaped unhurt.

The NDC maintains that the supposed members of the vigilante group are not affiliated to the party.

Speaking on Adom FM’s morning show, Dwaso Nsem Tuesday, Ernest Kumi expressed shock at the conduct of some NDC executives.

Citing Asiedu Nketia as an example, he claimed the NDC scribe peddled an obvious untruth by trying to blame others for the attack.

The NPP man said he would’ve preferred the NDC opened up in the matter by assisting the police to apprehend the suspects to avoid the embarrassment caused by the militia groups.
