In a petition dated September 15, 2025, and filed through its legal representatives, Evans Adika Law, the club argued that the GFA acted unlawfully by proceeding with the August 12 congress despite being formally served with a notice of injunction.

“The Ghana Football Association (GFA) was formally served with a legal challenge to the alleged Annual General Meeting (AGM) held on August 12, 2025, and the resolution allegedly passed during that meeting,” the petition stated.

King Faisal is now seeking redress at CAS in Lausanne, Switzerland, where it is asking the tribunal to nullify the congress and address what it describes as serious governance and procedural breaches.

“This challenge, filed at the Court of Arbitration for Sport (CAS) in Lausanne, Switzerland, seeks to address significant governance and procedural irregularities that undermine the legitimacy of the GFA’s actions related to and during the alleged AGM. King Faisal Football Club asserts that the GFA’s inaction and actions render the August 12, 2025, AGM and its outcomes invalid,” the club stressed.

In its complaint, King Faisal outlined five key grounds for contesting the congress:

  • Abridged notice period without the unanimous consent of members.

  • Undisclosed real and potential conflicts of interest involving the chairperson of the AGM.

  • Improper bundling of issues voted on and instances of over-voting.

  • Denial of a poll after a show of hands.

  • Undue influence.

The club is seeking several remedies from CAS, including:

  • An injunction restraining the GFA from implementing or enforcing the resolutions pending arbitration.

  • A declaration that the August 12 congress and its resolutions are null and void due to conflicts of interest and procedural breaches.

  • An order recusing the GFA Executive Council from participating in remedial measures.

  • An order directing the GFA to amend the Normalisation Statute in line with Ghanaian law and register it with the Office of the Registrar of Companies (ORC).

  • An order barring the current GFA President from influencing any future amendments to the terms of his office while still in power.

  • Costs and any other relief deemed appropriate by CAS.

King Faisal further cited what it called the GFA’s “longstanding procedural failures,” particularly its failure to deposit the Normalisation Statute with the ORC following the FIFA Normalisation Committee’s tenure from August 2018 to October 2019, as a root cause of continuing governance lapses.

The club’s action represents a major escalation in its feud with the GFA, with the CAS ruling expected to carry far-reaching implications for football governance in Ghana.

Palace lose appeal against demotion from Europa League https://www.adomonline.com/palace-lose-appeal-against-demotion-from-europa-league/ Mon, 11 Aug 2025 09:08:31 +0000 https://www.adomonline.com/?p=2565767 Crystal Palace have lost their appeal against being demoted from the Europa League and will play in the Conference League this season.

The ruling from the Court of Arbitration for Sport (Cas) also means Nottingham Forest’s spot in the Europa League is confirmed, having been promoted in Palace’s place.

The Eagles qualified for the Europa League after winning the FA Cup last season but were punished by Uefa for breaching multi-club ownership rules.

American businessman John Textor owned a 43% stake in the club until he sold it in July and is the majority owner of Lyon, who have also qualified for the Europa League.

Uefa gave Palace until 1 March 2025 to show proof of multi-club ownership restructuring, but the club missed that deadline.

In July, Palace submitted an appeal to Cas against Uefa – which issued the punishment – as well as Lyon and Nottingham Forest.

In the ruling, Cas said:

  • Regulations are clear and do not provide flexibility to clubs that are non-compliant on the assessment date, as Palace claimed.
  • Textor still had decisive influence over both clubs at the time of Uefa’s assessment date.
  • The panel also dismissed Palace’s argument that they received unfair treatment in comparison to Nottingham Forest and Lyon.

Uefa rules state clubs owned, to a certain threshold of influence, by the same person or entity cannot compete in the same European tournament.

Palace argued Textor does not hold any decisive influence at the club, but Uefa did not accept the Premier League side’s defence.

Palace will face either Norwegian side Fredrikstad or Midtjylland of Denmark in the Conference League play-off round later this month.

FIFA initiates disciplinary action against GFA over CAS ruling non-compliance https://www.adomonline.com/fifa-initiates-disciplinary-action-against-gfa-over-cas-ruling-non-compliance/ Thu, 26 Jun 2025 10:44:20 +0000 https://www.adomonline.com/?p=2548587 World football governing body, FIFA, has initiated disciplinary proceedings against the Ghana Football Association (GFA) for failing to comply fully with a decision of the Court of Arbitration for Sport (CAS).

In an official letter from FIFA’s Legal and Compliance Division, dated June 3, 2025, and addressed to the GFA, which has been sighted by JoySports, FIFA stated that “…Ghana Football Association (the Respondent) did not comply in full a decision passed by the Court of Arbitration for Sport (CAS) (the Decision).”

FIFA identified this as a potential breach of “Art. 21 of the FIFA Disciplinary Code (FDC) – Failure to respect decisions.”

CAS ordered Hearts of Oak to pay Francis Adjetey on February 26, which was reported by JoySports, but GFA failed to enforce the decision

Following the investigation, the secretariat to the FIFA Disciplinary Committee proposed the following sanction:

“The Respondent shall pay to Francis Adjetey (the Creditor) as follows: CHF 1,000 as arbitration costs.”

The GFA has been granted “a final deadline of 30 days as from the present proposal becoming final and binding in which to pay the amount(s) due and to enforce the Court of Arbitration of Sport (CAS) decision.”

FIFA made it clear that failure to comply by the deadline would have financial consequences.

The letter warned that “upon expiry of the aforementioned final deadline and in the event of persistent default or failure to comply in full with the Decision, 20% of the next FIFA Forward instalment due to the Respondent will be withheld by FIFA until the amount(s) due to the Creditor are paid.”

Additionally, FIFA threatened escalated sanctions if the GFA continues to default:

“If, after the first withholding, payment has still not been made pursuant to the Decision, a further 20% of the next FIFA Forward instalment will be withheld by FIFA and, at the Creditor’s request, the matter may be referred to the FIFA Disciplinary Committee for further measures.”

The GFA has been given the option to either accept the proposed sanction or submit its defence:

“In line with art. 58 FDC, the Respondent may reject the proposed sanction and submit its position before the FIFA Disciplinary Committee (along with any document deemed necessary) within five days of the notification of this communication.”

In such an event, “regular disciplinary proceedings will be conducted, and the FIFA Disciplinary Committee will decide on the case using the file in its possession.” FIFA tentatively scheduled the disciplinary committee’s meeting for “19 June 2025.”

FIFA also provided detailed instructions for legal representation:

“Should the Respondent wish to be represented, we kindly ask it to upload the respective Power of Attorney in the Legal Portal, indicating the corresponding registration (email address) which the legal representative would like to use as login credentials.”

Finally, FIFA reminded the GFA that the proposed sanction will become binding if no response is submitted: “Should the Respondent accept the proposed sanction, or in the absence of any response within the stipulated deadline, said sanction will become final and binding.”

FIFA stressed that this proposed sanction is “without prejudice to any future decision issued by the FIFA Disciplinary Committee, in case the proposal at hand is rejected by the Respondent.”

The letter, signed by Américo Espallargas, Head of Disciplinary, was copied to Francis Adjetey c/o Professional Footballers Association of Ghana (PFAG).

FIFA further directed that “The Respondent is directed to notify the secretariat to the FIFA Disciplinary Committee of every payment made and to provide the relevant proof of payment. The Creditor is directed to notify the secretariat to the FIFA Disciplinary Committee of every payment received.”

Right to Dream triumphs at CAS over FIFA in landmark Ernest Nuamah transfer case https://www.adomonline.com/right-to-dream-triumphs-at-cas-over-fifa-in-landmark-ernest-nuamah-transfer-case/ Sun, 15 Jun 2025 14:01:47 +0000 https://www.adomonline.com/?p=2544786 Ghana’s acclaimed Right to Dream Academy has won a significant legal battle against FIFA at the Court of Arbitration for Sport (CAS) over the allocation of development fees linked to Ernest Nuamah’s record-breaking transfer, a report on African football news website AfricaSoccer.com has revealed.

The ruling, published by CAS and accessed by this outlet, annulled a controversial decision by FIFA that had directed solidarity contributions from Nuamah’s €25 million move to a club with only minimal involvement in the player’s early development.

The Lausanne-based court ruled in favour of Right to Dream and ordered football’s governing body to reassess its stance based on newly presented evidence.

CAS corrects history and redirects funds

At the heart of the case was Nuamah’s 2023 transfer from Danish club FC Nordsjaelland—owned by Right to Dream—to RWD Molenbeek in Belgium, before a structured loan agreement with French giants Olympique Lyonnais. The sale, facilitated by Lyon’s parent company Eagle Football Holdings, was the largest ever in the history of the Danish Superliga.

Under FIFA’s solidarity mechanism, five percent of international transfer fees are reserved for clubs that developed the player between ages 12 and 23. However, the governing body’s database listed Ghanaian side Stadium Youth Club as a primary beneficiary, despite the fact that Nuamah left them at around age eight.

CAS has now instructed FIFA to reassign those funds, determining that Right to Dream served as Nuamah’s true development club during the eligible period. The court estimated Right to Dream is owed at least €283,919 from the initial sale to Molenbeek alone, with additional payments expected once Lyon’s obligation to buy is activated this year.

FIFA stance overturned

FIFA maintained throughout that it followed its records in good faith and denied any procedural misstep. But CAS disagreed, ruling that the registration data in FIFA’s Transfer Matching System (TMS) was outdated and failed to reflect Nuamah’s actual youth trajectory.

Right to Dream’s legal team, led by Danish sports lawyer Jes Christian Fisker, argued successfully that the inaccurate listing deprived the academy of vital funding and undermined the spirit of FIFA’s own regulations.

“It’s a major victory for development academies in Africa,” a source close to the proceedings said. “The precedent it sets could encourage others to challenge similar administrative errors.”

Complex path to Lyon

Nuamah’s journey to the French top flight came via an unconventional route. Though sold to Belgian outfit Molenbeek in August 2023, the Ghanaian international was immediately loaned to Lyon with an obligation to buy in 2024—a structure made possible by the shared ownership under American investor John Textor.

While the transaction raised eyebrows in regulatory circles—some observers suspected a potential bridge transfer—both the Danish and French football associations cleared the move after assurances were given by relevant authorities.

Early years clarified

In an earlier interview with AfricaSoccer.com, Nuamah confirmed that he joined Right to Dream at age 10. Before that, he had spent two years with Real Soccer Angels FC, a local grassroots club that nurtured him from the age of eight. Right to Dream has already made a resale payment of nine million Ghanaian cedis to Real Soccer Angels for their role in the player’s formative years.

Conversely, Stadium Youth Club, which only worked with Nuamah between ages six and eight, ceased operations years ago. Had CAS not intervened, the solidarity payments designated for them would likely have been transferred to the Ghana Football Association, as per FIFA’s policy when a recipient club is defunct.

A rare setback for FIFA

FIFA rarely suffers legal defeats at CAS, making this decision a noteworthy blow to its credibility in managing youth development data and transfer payments. By reversing the ruling and returning the matter to FIFA for correction, CAS reinforced the need for diligence in maintaining accurate player records—especially in less digitised footballing jurisdictions.

Right to Dream’s victory highlights the vulnerabilities of young African players whose career data often becomes fragmented when they move abroad. The decision could embolden more academies across the continent to contest similar misallocations of solidarity compensation.

With Lyon set to finalise their purchase of Nuamah in the coming months, Right to Dream could benefit further from additional payments under revised conditions. Meanwhile, Nuamah continues to thrive with the Ghana national team and remains on the radar of Premier League clubs, joining a long line of exports from the West African academy, including Mohammed Kudus, Simon Adingra, and Kamaldeen Sulemana.

CAS orders CAF to reinstate Samuel Eto’o on Executive Committee candidate list https://www.adomonline.com/cas-orders-caf-to-reinstate-samuel-etoo-on-executive-committee-candidate-list/ Fri, 07 Mar 2025 08:51:39 +0000 https://www.adomonline.com/?p=2512412 Samuel Eto’o has won a crucial court case against the Confederation of African Football (CAF) after the Court of Arbitration for Sport (CAS) ruled in his favour, making him a candidate again for the upcoming CAF Executive Committee elections.

The judgment, delivered on March 7, 2025, in Lausanne, Switzerland, is a resounding victory for Eto’o and the Cameroon Football Federation (FECAFOOT), which had challenged his exclusion from the contest.

The conflict was sparked when the Executive Committee of CAF, in a decision made on January 25, 2025, omitted Eto’o’s name from the list of candidates who are qualified for election into the Extraordinary General Assembly on March 12, 2025, in Cairo, Egypt.

Invoking technicalities of process, the move by CAF was met with strong opposition by Eto’o and FECAFOOT, who saw it as an attempt to isolate a top football leader.

Determined to appeal the decision, Eto’o lodged an appeal with CAS on February 5.

Not only did CAS nullify the decision by CAF, but it also directed the organization to put Eto’o on the candidate list.

CAF was also directed to reimburse CHF 8,000 of Eto’o’s lawyer fees.

Last fortnight, the CAF Appeals Board ruled that the Disciplinary Board lacked jurisdiction in the matter, overturning the initial verdict to prohibit Eto’o from standing for election to the executive committee.

The victory is not just an individual triumph for Eto’o – it’s a fight for justice and honesty in African football administration.

His comeback paves the way for a more open and participatory leadership for the sport.

With Eto’o now preparing for the crucial March 12 elections, his focus is on bringing much-needed reforms and advocating for the growth of African football at all levels.

Cas upholds Algerian appeal in row over map of Morocco https://www.adomonline.com/cas-upholds-algerian-appeal-in-row-over-map-of-morocco/ Thu, 27 Feb 2025 09:56:58 +0000 https://www.adomonline.com/?p=2509190 The Court of Arbitration for Sport (Cas) has upheld an appeal by the Algerian Football Federation (Faf) against the decision to allow a Moroccan club to wear a shirt displaying an extended map of the country.

The Confederation of African Football (Caf) had approved RS Berkane’s kit to be worn in continental competition, despite the fact the map included the disputed territory of Western Sahara.

The design is seen as a political provocation in Algeria and caused a row which saw both legs of last season’s Caf Confederation Cup semi-final tie between Berkane and Algerian club USM Alger called off.

A Caf disciplinary committee awarded Berkane two 3-0 victories, and Caf subsequently dismissed an appeal from USM Alger.

The Algerian club and Faf took the case to Cas, which has ruled the shirts are contrary to Caf regulations and the laws of world governing body Fifa and annulled the decision by the Caf appeals body to maintain the approval of the shirts.

USM Alger hailed a “well-deserved victory” that “enhances the team’s rights and supports the principles of sports justice” in a post on social media.

Caf has been contacted for comment.

What did Cas rule?

Cas determined the extended map on Berkane’s shirt depicts “a message, a demonstration or propaganda of a political nature” as it represents “the assertion of a territorial dispute that is contested and still unresolved”.

The Lausanne-based body also stated that, under Caf’s regulations and Fifa laws, it is prohibited to convey any content of a political nature on all equipment.

The Cas decision included the assertion Caf “is bound to respect and implement the duty of political neutrality”.

The outcome of the case will have no bearing on the final result of the 2023-24 Confederation Cup, which was won by Egyptian club Zamalek after Berkane received their walkover to the final.

USM Alger and Berkane could meet again in the semi-finals of this season’s competition.

Why is the extended map controversial?

Algeria and Morocco share a nearly 2,000 km (1,242 miles) border, which has been a source of tension since independence from French colonial rule.

Diplomatic relations between the two countries are also frosty and the long-running dispute about Western Sahara, a sparsely-populated territory annexed by Morocco in 1975, has also strained relations.

Its indigenous Sahrawi people, led by the Polisario Front and with a government in exile in Algeria, mounted a 16-year-long insurgency that ended with a United Nations-brokered truce in 1991.

The extended map of Morocco, including the territory of Western Sahara, does not correspond to official cartography of the country as published by the UN.

Berkane had their shirts confiscated by customs officials on arrival in Algeria for the first leg of their Confederation Cup clash last April and refused to wear an alternative shirt.

USM Alger declined to take to the pitch in the second leg in Morocco.

The extended map has also caused issues in other sports, as Algeria withdrew from the Arab Youth Handball Championship last year because the Moroccan side were “wearing shirts with political connotations”.

CAS dismisses Rubiales appeal against Fifa ban https://www.adomonline.com/cas-dismisses-rubiales-appeal-against-fifa-ban/ Sat, 22 Feb 2025 10:04:53 +0000 https://www.adomonline.com/?p=2507410 Luis Rubiales’ appeal against a three-year Fifa ban from football has been dismissed.

Football’s world governing body suspended the former president of the Spanish Football Federation (RFEF) from any football-related activity for three years in October 2023.

It followed a kiss on the lips of Spain player Jenni Hermoso during the medal ceremony after the team won the 2023 Fifa Women’s World Cup final.

On Friday the Court of Arbitration for Sport (CAS) dismissed Rubiales’ appeal, external on the grounds that “the sanction imposed is reasonable and proportional”.

CAS agreed with Fifa’s appeals committee – who upheld the suspension in January 2024 – that Rubiales “behaved in a manner contrary to the principles of the Fifa Disciplinary Code”.

On Thursday, Spain’s High Court convicted Rubiales of sexual assault for kissing Hermoso, 34, without consent and fined him 10,800 euros (£8,942).

Rubiales, 47, was also banned from going within a 200m radius of the Tigres player – and from communicating with her for one year.

He was acquitted of coercion, for allegedly trying to pressure Hermoso into saying publicly that the kiss was consensual.

Rubiales resigned from his position as the RFEF president but has always maintained the kiss was consensual.

Both Rubiales and Hermoso intend to appeal the verdict.

I accepts CAS’ decision – George Afriyie https://www.adomonline.com/i-accepts-cas-decision-george-afriyie/ Mon, 06 May 2024 14:39:44 +0000 https://www.adomonline.com/?p=2390597 Former Vice President of the Ghana Football Association (GFA), George Afriyie has acknowledged the ruling by the Court of Arbitration for Sport (CAS) affirming his disqualification from the 2023 GFA presidential race.

Afriyie’s disqualification left GFA President Kurt Okraku running unopposed after he failed to garner the required endorsements from GFA members for his candidacy.

The Election Committee cited Afriyie’s use of an ineligible individual, Jeffrey Asare, to endorse his nomination forms.

It was later revealed that, Asare was not a Director at Victory Club Warriors FC as claimed.

Despite filing an appeal, Afriyie’s hopes for a reversal were dashed when the appeal was turned down.

He then took the matter to CAS, the Swiss-based international body responsible for resolving sports-related disputes through arbitration.

Following CAS’ decision, Afriyie stated, “I have today received the decision of the Court of Arbitration for Sport (CAS) regarding my appeal against the Decision of the Elections Committee of the Ghana Football Association (GFA). The CAS, in their decision, has upheld the decision of the Elections Committee of the GFA. I take the decision in good faith. I express my sincere gratitude to everyone who supported me during this period.”

George Afriyie’s appeal case against GFA dismissed by CAS https://www.adomonline.com/george-afriyies-appeal-case-against-gfa-dismissed-by-cas/ Mon, 06 May 2024 14:06:16 +0000 https://www.adomonline.com/?p=2390586 The Court of Arbitration for Sport (CAS) has rejected the appeal of George Afriyie, a Presidential aspirant for the Ghana Football Association (GFA), against his disqualification from the 2023 Elections.

This decision solidifies Kurt Okraku’s position as the GFA President for a second term, as he ran unopposed last year.

Afriyie’s disqualification came after he failed to meet the required number of GFA members supporting his candidacy.

Despite his appeal to the Elections Appeals Committee, which upheld his disqualification, Afriyie pursued legal action by filing an appeal at CAS.

However, the ruling delivered on Monday, May 6, confirms the dismissal of Afriyie’s appeal, directing him to pay legal fees amounting to 1000 Swiss Francs (15,266 Ghana Cedis).

In last year’s elections held in Tamale on October 5, incumbent GFA President Kurt Okraku retained his seat with a significant majority.

Mr Okraku secured 117 out of 120 votes, with two delegates voting against him and one abstaining.

Cas to hear Algerian appeal in Morocco map row https://www.adomonline.com/cas-to-hear-algerian-appeal-in-morocco-map-row/ Fri, 03 May 2024 08:30:54 +0000 https://www.adomonline.com/?p=2389381 A row over an extended map of Morocco on a football shirt has escalated after the Algerian Football Federation (Faf) and club side USM Alger lodged an appeal with the Court of Arbitration for Sport (Cas).

Both legs of the Caf Confederation Cup semi-final between USM Alger and RS Berkane were called off because the latter club insisted on wearing a strip bearing a map of Morocco which includes the disputed territory of Western Sahara.

The map is seen as a political provocation in Algeria.

Faf and USM Alger have asked Cas to rule that the Berkane shirt “contravenes the laws of the game, Confederation of African Football (Caf) regulations and Fifa rules”.

The world governing body’s equipment regulations state that no item of kit which includes political statements or images may be worn.

Cas said an arbitral panel is being appointed, but did not give any timescale on when the case would be heard.

The Switzerland-based organisation added that written submissions from all parties, which include Caf, the Royal Moroccan Football Federation (RMFF) and RS Berkane, are being exchanged.

“Once constituted, the arbitral panel will issue instructions for the next phase of the proceedings, including the holding of a hearing,” a statement on the Cas website said.

Berkane appear set to progress to the final of the Confederation Cup, having been handed a 3-0 win in the first leg despite refusing to play in Algeria after their shirts bearing the disputed map were confiscated.

The RMFF says Berkane have been awarded another 3-0 win – and will progress to the final 6-0 on aggregate without a ball being kicked – but Caf has not made an official announcement on the matter.

The final is scheduled to be held over two legs on 12 and 19 May.

Disputed territory leads to call-offs

Algeria and Morocco share a nearly 2,000 km (1,242 miles) border, which has been a source of tension since independence from French colonial rule.

The border is currently closed between the countries and Algeria severed diplomatic ties three years ago.

A long-running dispute about Western Sahara, a sparsely-populated territory annexed by Morocco in 1975, has also strained relations.

Its indigenous Sahrawi people, led by the Polisario Front and with a government in exile in Algeria, mounted a 16-year-long insurgency that ended with a UN-brokered truce in 1991.

Against that backdrop, Algerian customs officials seized RS Berkane’s kit on the squad’s arrival in the country last month.

The Moroccan side refused to wear alternative shirts and did not emerge from their dressing room for kick-off in the first leg on 21 April.

Host side USM Alger were punished with a 3-0 defeat by a Caf panel, and an appeal against the decision was rejected by the continent’s governing body.

A Caf committee has previously granted permission for Berkane to wear the shirts with the extended map, and Faf and USM Alger failed in a bid to overturn that in a previous request to Cas on 26 April, two days before the second leg.

USM Alger travelled to Morocco for the return tie but did not take to the field on Sunday, and the match was cancelled.

The Algerian club’s hopes of retaining the Confederation Cup title now appear to lie with the case at Cas.

Zamalek await in the final, with the Egyptian giants scheduled to be away from home in the first leg on 12 May before the return tie in Cairo seven days later.

CAS throws out Tema Youth’s appeal against relegation from DOL https://www.adomonline.com/cas-throws-out-tema-youths-appeal-against-relegation-from-dol/ Sat, 23 Sep 2023 11:39:38 +0000 https://www.adomonline.com/?p=2297488 The Court of Arbitration for Sport (CAS) has dismissed Tema Youth FC’s application for an injunction to halt the club’s relegation from the Division One League.

This decision comes as CAS awaits the final verdict in Tema Youth FC’s substantive case against the Ghana Football Association (GFA).

Previously, on July 26, 2022, CAS turned down Tema Youth FC’s request for a stay of execution regarding the GFA Appeals Committee’s decision concerning payments related to the transfer of player Joseph Paintsil.

Following this, Young Red Bull FC pursued a case for enforcement of payment against Tema Youth FC, leading to a continued 3-point deduction for Tema Youth FC after each match, in accordance with the Disciplinary Code, due to their non-compliance with the Appeals Committee’s decision.

Recalling the Appeals Committee’s ruling on June 11, 2022, Tema Youth FC was instructed to make the following payments within 14 days: EUR 688,000 to Young Red Bull, EUR 150,000 to the GFA and EUR 150,000 to the Ghana League Clubs Association (“GHALCA”).

Tema Youth’s Latest Application to CAS

On August 25, 2023, Tema Youth FC once again approached CAS, seeking provisional measures to halt their relegation from Division One League Zone 3 to Division Two League until CAS issues a final decision in the ongoing case.

After careful consideration of the arguments presented by both Tema Youth FC and the GFA, the CAS Panel has determined the following:

– The “Petition on Demotion,” treated as a request for provisional measures, filed by Tema Youth Football Club on August 25, 2023, in the matter CAS 2022/A/9010 Tema Youth Football Club v. Ghana Football Association, has been dismissed.

– The costs associated with this Order will be established in the final award or any other conclusive disposition of this arbitration.

With this recent CAS decision, Tema Youth FC’s obligation to Young Red Bull FC for payment enforcement will persist.

Consequently, for every match played, the club will incur a 3-point penalty until the outstanding debt to Young Red Bull FC is settled.

2023 GFA Elections: George Afriyie heads to CAS over disqualification https://www.adomonline.com/2023-gfa-elections-george-afriyie-heads-to-cas-over-disqualification/ Tue, 19 Sep 2023 13:06:46 +0000 https://www.adomonline.com/?p=2295810 Disqualified GFA presidential aspirant, George Afriyie, has asked his lawyers to file and appeal at the Court of Arbitration for Sport (CAS) against the decision of the Appeals Committee to uphold the ruling of the Elections Committee disqualifying him from this year’s polls.

JoySports understands, aside from the appeal to be filed at CAS, an application for injunction on the GFA elections will be filed at the Accra High Court.

Mr Afriyie’s appeal was dismissed by the Appeals Committee on the grounds that he did not meet the requirements to contest for the position of president of the football governing body in Ghana.

It noted that “The invalidity of any document cannot be cured by reference to article 8(3) of the Elections Regulations. Indeed, if Mr George Kwasi Afriyie had submitted invalid Tax Clearance Certificate or invalid Police Clearance Certificate, it would have made his nomination invalid.”

This was in reference Mr Afriyie’s appeal with claim the Elections Committee misdirected itself on the law of requirements to contest for the GFA Presidency and also misapplied article 8(3) of the GFA Regulations on Elections and article 13(2)(j) of the GFA Statutes 2019, thus, describing the disqualification as erroneous.

Aside from this, the Elections Committee, which is supposed to be comprised of five members per article 54 of the GFA Statutes 2019, were six during his vetting, and this, he says, is contrary to the mandated composition of the panel.

However, the Appeals Committee said the said sixth person is an “…in-house lawyer of the Ghana Football Association. The lawyer was not part of the Vetting Team and did not ask George Kwasi Afriyie any question. The lawyer provided administrative assistance to the committee.”

In response to his position that the Committee breached rule of “Natural Justice and Fair Hearing” of his candidature when it failed, neglected, and refused to apply article 8(3) of the FA regulations on elections, the Appeals Committee said “…it is not a case that a Police Clearance Certificate or passport picture had not been included which would have warranted the application of article 8(3) of the Elections Regulations.”

Based on these, the committee dismissed his appeal. It is unclear when the appeal at CAS will be filed, but sources say “soon.”

The last elections of the FA saw Wilfred Osei Kwaku Palmer head to CAS after he was also disqualified by the Elections Committee.

CAS upheld the decision of committee.

His comments come after the Insha Allah lads suffered relegation from the topflight in the concluded 2022/23 Ghana Premier League.

Despite their relegation, King Faisal filed a protest against Tamale City for fielding an unqualified player in their game staged at the Aliu Mahama Stadium, a game they suffered a 4-0 defeat.

King Faisal are demanding the points they lost during the game should be awarded to them.

However, the appeal has been dismissed by the Disciplinary Committee of the Ghana Football Association (GFA).

Following the dismissal of the appeal by GFA, King Faisal have resorted to seek justice at the Court of Arbitration of Sports (CAS).

Alhaji Grusah, speaking to Asempa FM on the Ultimate Sports Show, revealed that the General Secretary of the GFA, Prosper Harrison Addo has refused to release the record of proceedings of the case to him despite their request.

A furious Grusah threatened to drag Harrison Addo and the leadership of the Ghana Football Association (GFA) to the Office of the Special Prosecutor over disrespect and unfair treatment. He also gave the country’s football governing body the close of day tomorrow to have the proceedings of the case.

The Black Stars management committee member further added that he has a good case but the GFA is frustrating him. He also cautioned that he will expose the GFA if he is being pushed.

Should CAS rule in favour of King Faisal, the 2023 MTN FA Cup finalists who finished 17th last campaign with 42 points will return to the top flight.

Meanwhile, the Ghana Football Association on Monday released the official fixtures for the 2023/24 Ghana Premier League.

I was disappointed in GFA’s decision to suspend players – Ex-Ashgold captain after CAS ruling https://www.adomonline.com/i-was-disappointed-in-gfas-decision-to-suspend-players-ex-ashgold-captain-after-cas-ruling/ Mon, 31 Jul 2023 07:31:26 +0000 https://www.adomonline.com/?p=2278594 Former AshantiGold SC player, Amos Addae, says he was disappointed in the Ghana Football Association (GFA) for initially suspending players allegedly involved in match-fixing.

The Court of Arbitration for Sport (CAS) last week overturned all punishments imposed on the players by the GFA.

Some 21 players were sanctioned by the Disciplinary Committee of the Ghana FA as they were said to have been found guilty of manipulating the results of the match day 34 encounter between Ashgold and Inter Allies, a game that ended 7-0 in favour of the home side two seasons ago.

Quizzed about how the suspension affected him, Addae who was the captain during the alleged match-fixing, said he was unhappy about the decision taken by the GFA initially because it affected most players negatively.

“I sometimes get disappointed at the GFA. Players in the Ghana Premier League are not paid well and suspending the players affected them. How were they going to feed their family?” he told Adom FM.

He revealed that he is currently in the United Kingdom trying to start from scratch with the help of his wife.

“If not for the help of my wife in the UK, how would I have fed the family? Life here is difficult. The amount of money spent on renting an apartment for a month in the UK can be used at a 5-star hotel in Ghana for seven months,” he said.

“Our leaders need to sometimes take their time in taking decisions. One player who was suspended had a contract in Serbia but he came back due to the suspension tag placed on him,” he added.

Amos Addae played 50 games for AshantiGold SC in the Ghana Premier League and scored nine goals.

Some 21 players were sanctioned by the Disciplinary Committee of the Ghana FA as they were said to have been found guilty of manipulating the results of the match day 34 encounter of a Ghana Premier League game two seasons ago.

Following the decision to ban them, the Professional Football Association of Ghana appealed to CAS through the International Federation of Professional Footballers (FIFPro) to overturn the decision.

The players were handed the go-ahead to register for the 2022/23 season after the appeal. The directive was to allow them to play competitive football while the case was being heard and determined by CAS.

However, after several months, CAS has announced its decision, annulling all sanctions imposed on the players.

Below is the decision from CAS:

The Ghana FA has also been ordered to pay the players $7,357 with each player expected to receive $345.77 in compensation.

King Faisal heading to CAS as appeal against Tamale City is dismissed – Alhaji Grunzah https://www.adomonline.com/king-faisal-heading-to-cas-as-appeal-against-tamale-city-is-dismissed-alhaji-grunzah/ Sat, 24 Jun 2023 14:45:18 +0000 https://www.adomonline.com/?p=2264241 Bank roller of King Faisal Football Club, Alhaji Karim Grunzah, has confirmed he will be heading to the Court of Arbitration for Sport (CAS) to seek redress after King Faisal’s case against Tamale City was dismissed by the GFA Appeals Committee.

King Faisal protested at the Disciplinary Committee after their 2022/23 Ghana Premier League match day 30 game with Tamale City, which took place at the Aliu Mahama Stadium on May 6.

According to the Kumasi-based club, Tamale City FC fielded an unqualified player; Isaac Mensah/Jireh Kojo Nissi, during the match but the case was dismissed by the Disciplinary Committee.

Faisal filed an appeal and the Appeals Committee of the GFA dismissed their case on Friday, affirming the Disciplinary Committee’s decision.

The Committee in its ruling also charged the GFA Prosecutor to investigate the registration of player Jireh Kojo Nissi and prosecute all guilty parties.

Reacting to the news that his case has been dismissed by the Appeals Committee, the owner of King Faisal, Alhaji Grusah, told Luv FM his lawyer has requested for the record of proceedings.

He added he will proceed to CAS for a resolution on the matter.

“I just spoke to my lawyer and we are writing to the GFA for the record of proceedings.

“At first, you could protest and lose at Disciplinary Committee, then you go to the Appeals Committee and lose but there was review in the end.

“Now since we don’t have review [committee], I have to go to CAS.

“During the era of Kwesi Nyantakyi, they cheated Palmer and he went to CAS and so, I am going to CAS,” he told Luv Sports.

The Appeals Committee also ruled that the 2021/22 Division One League season registration of Jireh Kojo Nissi should be expunged from the records of the GFA.
