The court, presided over by Mr Derick Pardden Eshun, granted him bail after entering guilty for him, following his plea of guilty with an explanation to the charge of assault.

The court also referred the case for alternative dispute resolution and adjourned it to June 17, 2024.

Chief Inspector Patient Afi Blihia, prosecuting, said the complainant was Mr James Kofi Zor, a driver.

He narrated that on March 1, 2024, at about 1210 hours, a witness reported to the police that someone had been assaulted by an unknown person at the Bingo Bet Centre near Ashaiman Traffic and bleeding profusely from his nose.

The police rushed to the scene and met the complainant, who identified Awaga as his assailant, and he was arrested, after which a complaint was made, and he was duly cautioned.

The investigation unearthed that both the complainant and the accused were at the Bingo Bet Centre in Ashaiman, staking bets, when Awaga tapped the complainant, who was on a phone call, blaming him for stepping on his toe.

Prosecution said the complainant ended his call, apologised to the accused, and began to walk out. But Awaga, who was still aggrieved, slapped him from behind, and he started bleeding from his nose.

Chief Inspector Blihia stated that upon seeing the complainant in that condition, the accused person pleaded for leniency and promised to assist the complainant to seek medical care, but while both complainant and accused were at it, the police arrived at the scene and arrested him.

During interrogations, the accused person admitted having assaulted the complainant out of anger.

The victim, Ketogloh Mawunyegah Edoh, has since been treated for his wounds and discharged from the hospital to await further treatment.

The plea of Oppong, who was charged with causing harm, was not taken and was remanded by the court, presided over by Mr Simon Gaga, to reappear on March 25, 2024.

However, the court will wait for the outcome of a surgery to be conducted on the victim, to ascertain the severity of the harm caused to him, as well as remove an object identified by medics in the stabbed area.

Police Chief Inspector Joyce Nyarko, prosecuting, said the complainant in the case was Dziedzorm Edoh, the wife of the victim, who claimed that on February 5, 2024, at about 2030 hours, the victim alighted from Oppong’s vehicle at Global, a suburb in the Tema West Municipality, after joining it at Adjei-Kojo.

According to the prosecution, a misunderstanding ensued between the victim and the accused person over a 50 pesewas balance, which the accused demanded from the victim after he offered to pay Gh₵ 4.50 pesewas instead of five cedis.

Chief Inspector Nyarko said the two quarreled and during which Oppong took a knife from under his foot carpet at the driver’s side of the vehicle and stabbed the victim with it at his back.

She said some onlookers assisted to disarm the accused person of the knife and rushed the victim to the New Crystal Hospital for treatment.

The prosecution said someone then alerted the complainant at home which was few metres from the scene, who, together with others, handed over the accused person to the Kanewu Police station, where a report was made.

Madam Nyarko said Oppong was re-arrested, and the knife retained as an exhibit, while police proceeded to the said hospital and met the victim on admission, responding to treatment.

Chief Inspector Nyarko said the victim was issued with a police medical report form, which the victim returned after being discharged from the hospital two days after the incident.

She said the police were informed by the medical officer that there was an object in the wound that needed further treatment through surgery.

The two, aged 25 and 31, were remanded after pleading not guilty to five counts of assault on public officers, offensive conduct, and disturbance of court.

The court, presided over by Mr. Simon Gaga, remanded them to reappear on February 8, 2024.

Prosecuting, Chief Inspector Christian Oscar Norgbedzi said the complainants in the case are Ms. Millicent Zogli, a janitor at the Ashiaman District Court.

The second, third, and fourth complainants, respectively, are Inspector Henry Tetteh Nartey, a prosecutor, Corporal David Kwame Nyong, a Court Warrant Officer (CWO), and Lance Corporal Rebecca Addo, also a CWO.

Chief Inspector Norgbedzi told the court that on February 1, 2024, the complainants arrested and brought to the Ashaiman Divisional CID the two accused siblings with a complaint that on the same day at about 13:45 hours while at the premises of the court, they, acting together disturbed the court sittings.

He said they attacked and rained insults on the complainants who tried to call them to order.

He said the siblings, on the day in question, accompanied their mother, Hamdiya Inusah, to the court in respect of a civil suit against her.

According to the prosecutor, while in the immediate vicinity of the court, Safianu publicly, verbally assaulted the first complainant using unprintable words.

He added that peeved by the court’s judgement against their mother, they started making noise to disturb the court proceedings.

Following their behaviour, the second, third, and fourth complainants, who are all Police officers, attempted to call them to order, which they fiercely resisted, attacked the complainants, and rained insults on them.

The prosecutor said the accused persons were, however, overpowered, arrested, and subsequently arraigned before the court.

Ibrahim Abdul Rakib, who has been charged with dishonestly receiving was among four accused persons who through their lawyers applied for bail at the Ashaiman Circuit Court on Tuesday, April 11 2023 

But it was only Rakib who secured bail on health grounds.

When the case was called on Tuesday, April 11, 2023, Abdul Fatawu Alhassan, the defence counsel for three out of the six accused persons including Rakib told the court that his client was battling a stomach ulcer and had been suffering in the police cells.

He, therefore, prayed the court to grant his client bail since the condition of his client could aggravate with time if not attended to. 

The fifth accused person, Yus­sif Mohammed who was also charged with dishonestly receiving an item, was also represented by lawyer Ishahadu Mohammed whose application for bail was not granted.

Medical reasons

Superintendent Sylvester Asare, representing the prosecution, opposed the bail applications by pointing out that Ibrahim Abdul Rakib, along with the other suspects, had been in police custody at the Police Headquarters, which was in close proximity to the Police Hospital, and had never reported any health issues to the investigators.

As a result, he urged the court to deny bail and instead keep the suspects in custody with the assurance that they would receive medical attention.

After carefully considering the arguments presented by the lawyers for the four accused persons and taking into account the seriousness of the charges and potential punishments, Judge Simon Gaga decided not to grant bail.

However, in the case of Ibrahim Abdul Rakib, the court deemed it necessary to grant bail based on medical reasons.

The remaining five persons arrested in connection with the killing of Private Imoro Sherrif, a soldier, on March 4, at Ashaiman in the Greater Accra and charged with stealing, robbery and receiving of dishonest goods were however remanded in police custody.

They are Safianu Musah alias Dayorgu, Samuel Tetteh, alias Wiper, Abu­bakar Sadick, alias Birdman, Yus­sif Mohammed and Abdul Gafaru Abdul Karim.

They would reappear in court on April 25, 2023. The Court further ordered the Prosecution to file disclosures on or by April 25, 2023. 

This was after the Prosecution had prayed the court to adjourn the case to enable them to advance investigations, which he said had gone far.

Superintendent Asare said in praying the court for adjournment said it was in the interest of justice and the safety of the accused persons that they remained in custody.

Second case

Meanwhile, Samuel Tetteh, alias Wiper, Abu­bakar Sadick, alias Birdman, who have been charged with conspiracy to commit murder in the same case will reappear appeared before the District Magistrate Court in Tema presided over by Benedicta Antwi on April 25, 2023, pending the advice from the office of the Attorney-General (A-G).

This was after the prosecutor, Superintendent Sylvester Asare, prayed the court to remand the suspects since they were awaiting advice from the office of the A-G.

Background

On March 4, 2023, police received information that a male adult had been found lying dead at Ashaiman Taifa in the Greater Accra Region.

According to the police, the crime scene team retrieved a number of items, including a knife with blood stains and a backpack, in the course of investigations.

In the backpack, police found one Samsung tablet, one Apple laptop, one military uniform with the name tag “Imoro”, eight other items of clothing, as well as a Ghana Card and a Health Insurance card bearing the name Imoro Sherrif.

The police said the content of the backpack suggested that the victim could be a soldier, so the military was notified of the incident, and the deceased was subsequently identified by the military as Imoro Sheriff, a soldier.

The prosecution said two of the accused persons attempted to rob the soldier, and in the process, one of them stabbed him in the arm, while the other four bought a stolen mobile phone taken from the soldier, now deceased.

The court presided over by Mr Simon Gaga convicted the accused after he had pleaded guilty to the charges.

The prosecutor, Chief Inspector Samuel Aperweh, said the complainant, Gloria Asantewaa Kwabi, 35, is a trader who lives at Spintex, Accra, while the accused Ofori is a driver’s mate and lives at Washington, a suburb of Ashaiman.

According to the prosecution, on December 28, 2022, at about 1530 hours, the complainant went to her husband one Daniel Kasereko at Ashaiman market, who then picked up the complainant on his motorbike with registration number M-13-AS3187 as a pillion rider home.

The Chief Inspector said on getting to a place called Janelex School at Gbetsile, they saw that the accused person also riding an unregistered black Royal motorbike with his accomplice as a pillion rider was speeding toward the complainant and the husband.

The prosecution told the court that on reaching the complainant and the husband, the accomplice pushed the complainant and she fell down from the motorbike.

The prosecution said in the process, the accomplice managed to overpower the complainant and snatched her lnflnix Hot 1Oi mobile phone valued at GHC 870.00 and cash in the sum of GHC601.00 which was kept inside the back cover of the phone, and they sped off.

The prosecution said the husband of the complaint gave the accused and his accomplice a hot chase, they abandoned their motorbike in the process and took to their heels.

The prosecution said with the help of other people, the accused person was arrested and brought together with the motorbike to the Police Station at Zenu Atadeka.

His accomplice, however, managed to escape with the phone and the cash, the said motorbike has been impounded at the Police Station.

The accused person admitted the offence in his investigation cautioned statement and gave the name of his accomplice as Amankwa.

The prosecution said Police and other security agencies have intensified efforts to arrest the accomplice.

The three are Bismark Appiah, an 18-year-old bus conductor; Emmanuel Attakora, a 22-year-old mason; and Mubarik Sayiti, a 19-year-old welder; all residents of Zenu Atadeka. 

The court presided over by Mr Simon Gaga, sentenced them on their own plea of guilty to two counts of conspiracy to commit crime and robbery contrary to the Criminal Offence Act 1960 (ACT 29). 

They were sentenced to three years on count one, and five years in hard labour on count two, the sentence however is to run concurrently. 

Chief Inspector Samuel Aperwah, prosecuting said, complainant Ms Evelyn Bortey Quaye, was a worker at Free Zone Company in Tema, and a resident of Atadeka a suburb of Ashaiman. 

Chief Inspector Aperwah said on October 7 this year, at about 2345 hours, the complainant closed from work and was alighted by the company’s bus on a portion of the Atadeka road. 

He said, whilst standing at the roadside in search of transport to her house, the accused persons who were on a motorbike stopped near her, held her to the ground and forcibly took her bag which contained automated teller machines (ATM cards), GH₵7.00 cash, and an Itel mobile phone valued at GH₵300.10, and sped off. 

The complainant, according to the prosecution, narrated her ordeal to two neighbourhood committee members, who spotted her shouting by the roadside some few minutes after the robbery incident. 

The neighbourhood committee member who was also on a motorbike pursued the three convicts, who later abandoned their motorbikes, and escaped when they saw that they were being chased. 

The neighbourhood committee members accompanied the complainant together with the abandoned motorbike to make a complaint at the Zenu Atadeka Police station. 

The court heard that on October 11, 2022, Bismark Appiah and Emmanuel Attakora went to the Katamanso Police Station to check whether they would see their motorbike there, they were however sent to New York Police Station since it was not at Katamanso.

The prosecution said at New York Police Station, the accused persons pointed out the said motorbike which was used in connection with the case and claimed ownership but failed to produce document. 

They were, therefore, detained, questioned, and investigations initiated after which they were prosecuted before the court.
