He described the decision as “mischievous” and “disingenuous.”

Speaking on Accra-based Citi FM, Mr Tamekloe expressed confusion over the EC’s reasoning for disqualifying the NDC candidate.

He argued that, the EC’s reference to an interlocutory injunction from the Sekondi High Court, related to her election during the May 12 primary, was unjustified.

“The disqualification is based on an injunction from the Sekondi High Court, which is highly mischievous. The EC was a party to the court case and was present during the proceedings. They even supervised the rerun election after we annulled the initial one. For Samuel Tettey to now cite this injunction is completely disingenuous,” he remarked.

Mr Tamekloe accused the EC of bias, suggesting it had deliberately disqualified Joana Gyan Cudjoe.

“When the EC opened nominations, the party submitted Joana as its candidate. After that, there were signs that the notice of poll printing was being delayed. We thought the matter had been resolved, but on October 10, Samuel Tettey issued a disqualification letter,” he said.

“The EC cannot behave like an octopus, reaching everywhere to disqualify a candidate whose election it oversaw,” he added.

In a letter dated October 15, addressed to the EC, Joana Gyan Cudjoe’s legal representatives, Ayine and Associates, emphasized that she remains the duly elected NDC candidate.

“We write as legal counsel for the National Democratic Congress (NDC) and Joana Gyan Cudjoe, the NDC Parliamentary Candidate for the Amenfi Central Constituency in the 2024 Parliamentary Elections (referred to hereafter as ‘our clients’), and on their instructions to address the matter above,” the letter opened.

The letter further highlighted that the clients were made aware of a petition dated September 13, 2024, and a follow-up letter on September 24, 2024, which was served to the EC.

In the petition, the claimants allege the existence of an interlocutory injunction barring Joana Gyan Cudjoe from presenting herself as the NDC’s parliamentary candidate for Amenfi Central.

Additionally, the injunction is said to restrict both the NDC and the EC from recognizing or granting her any rights or privileges in this capacity.

“The instruction of our clients is that they have become aware of an alleged petition dated September 13, 2024 and a subsequent letter dated September 24, 2024 served on your office wherein the petitioners claim that there is a purported pending order of interlocutory injunction restraining Joana Gyan Cudjoe from holding herself out as the duly elected NDC Parliamentary Candidate for the Amenfi Central Consistency in the Western Region, and also restraining both the NDC and the Electoral Commission, their agents and officers from holding out, allowing Joana Gyan Cudjoe to be held out, dealt with in any way, recognized or afforded any rights or privileges as the duly elected NDC Parliamentary Candidate for the Amenfi Central Constituency.”

Meanwhile, the current Member of Parliament for Amenfi Central, Peter Yaw Kwakye-Ackah, who lost the NDC primary to Joana Gyan Cudjoe, has announced plans to run as an independent candidate.

According to him, although Ms. Cudjoe hails from Amenfi Central, she does not vote in the constituency.

He alleged that, Ms. Cudjoe owns two party cards, one from Bantama and Amenfi Central which is against party rules.

 “Joana Gyan Cudjoe’s documents prove that she is a native of Amenfi Central but she does not vote here. She is not an NDC member there. She is an NDC member at Bantama so I have to go and verify. The woman owns two party cards which is against the party’s rules,” he said in an interview on Accra-based TV3. 

The Secretary, Richmond Daleke also stated that they cannot authenticate her membership in the party.

“Constituency executives are supposed to protect the seat. In protecting the seat we need to make sure that whichever candidate the delegates will elect, will be a credible one, who has no questionable character. Who can be presented to the general masses so that the person can win the seat for us?” he added.

Meanwhile, the Bantama constituency has also indicated the aspirant is not known there and it is strange how she got into the register.

The Chairman, David Kwesi Heridzi has therefore appealed to the national executives of the party to carry out thorough investigations to unveil the truth.

“In this case, I wiil just appeal to the people in Accra, the national executives if the case comes before them, they should look for the truth. Once they look for the truth the party will grow” he stressed.

Miss Cudjoe is one of five aspirants contesting the seat in the constituency.

But supporters of the candidate, a renowned business woman who stormed the venue of the vetting together with the candidate were hopeful things will go in her favour.
