The Supreme Court has thrown out an application seeking an injunction to stop the President from continuing with the process of appointing a new chairperson for the Electoral Commission.

A private individual Fafali Nyonator had asked the apex court to declare that the Chief Justice, Sophia Akuffo, breached the Constitution and exceeded the limits of her powers by defining the scope of a committee of enquiry that probed a petition for the removal of former EC chairperson Charlotte Osei.

But a while ago, a seven-member panel of Supreme Court judges hearing the case explained, Article 2 clause 2 of the constitution makes available remedies for a reinstatement if the court finds the removal of Charlotte Osei unconstitutional.
The court held that the application was not necessary because the court had the power to nullify the appointment of Mrs Jean Mensah if the substantive case succeeds.

However, Deputy AG Chair, Godfred Dame speaking to media said the president is likely to appoint the new EC chair within 24 hours.
